Wolfe Road and N. Tantau Avenue (APN: 316-20-112). Chapter 19164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his or her decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND On September 4, 2012 City Council approved the Main Street Cupertino mixed use project consisting of 130,500 square feet of retail, a 180-room hotel, a five-level parking garage with two levels of underground parking, 260,000 square feet of office, a 120-unit market-rate live/work rental loft residential development with a 9,146 square foot retail condominium unit and shared parking plan. The 18.7-acre Main Street project is located at the northwest corner of the Stevens Creek Boulevard and Tantau Avenue intersection. The office and commercial coinponents of the project have been constructed. The apartments,hotel,park,major retail, and shop 6 are under construction. Dean Isaacs, representing Main Sireet Cupertino Aggregator, LLC, is requesting a Director's Minor Modification to allow minor moclifications to a previously approved landscaping and site plan(ASA- 2012-15)for the interior plaza area between Shops 2 and 3 at the Mauz Street Cupertino project. DISCUSSION The intent of the project is to further enhance and improve the pedestrian visibility and experience of the interior plaza area between Shops 3 and 4 by the implementing the following measures: ■ Elitninating a previously approved 23 foot tall stone fire place; ■ Constructing an internally illuminated,nine foot tall glass water feature; ■ Incorporating new landscaping around the base of the water feature. The proposed modifications continue to meet the intent of prov�iding an enhanced feature within this plaza area and are substantially in conformance with the prior approval. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS The approval is based on Exhibits Titled Fountain Plan, Main Street Cupertino Aggregator, LLC, date received December 9, 2015 for the modifications to the plaza in between Shops 3- 4 and consisting of one sheet, except as may be amended by the conditions contained in this resolution 2. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 3. ACCURACY OF THE PROLECT PLANS The applicant/property owner is responsible to verify all pertulent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. PREVIOUS CONDITIONS OF APPROVAL A�l previous conditions of approval form Resolution No. 12-098 shall remain in effect unless superseded by or in conflict with subsequent conditions of approval, including the conditions contained herein in this resolution. 5. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to properfy boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 6. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indenlnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the "indexnnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 7. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest withuz this 90-day period corriplying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This Director's approval is effective January 5, 2016. The fourteen calendar day appeal period will expire on January 19,2016. Attachments: A.
