Subject: Summary of City Review and Approval for Verizon/AT&T cell tower at City Hall,

BACKGROUND:
In early September 2014,Verizon Wireless and AT&T Wireless submitted separate plaiuling
applications for proposed,jointly developed personal wireless service facilities that could
accommodate both carriers' radio coverage needs in the Cupertino Civic Center area. The
antennas would be collocated on a single 80-foot tall treepole with Verizori s antennas proposed
at a height of 66 feet,and AT&T's antennas proposed above that at 78 feet. The proposed cell
site at the northeast corner of the Civic Center property was selected by the City Council as the
preferred location at its meeiing of July 16,2013. Both carriers also started work with the City
Attorney's Office to draft a land lease agreement with the City.
In late 2014 or early 2015,AT&T stopped all permit work on new cell tower development across
the country. Verizon elected to continue the joint project,preserving the original facility design
proposal that could accommodate both carriers. The Verizon led proposal was presented to the
Plaruting Commission at its public hearing on August 25,2015 and approved by the �
Con�unission on a 5-0 vote with no modifications.
The Conunission decision to approve was subsequently appealed by a neighbor and the City
Council heard the appeal and lease agreement at its meeting of October 6,2015. Then Vice
Mayor Chang was absent and Councilmember Vaidhyanathan recused herself,leaving the
remaining three councilmembers to decide the appeal. No resolution was adopted as the
Council vote was 2-1 in favor of denying the appeal and a majority of the Council (three votes)
was needed to make a Council decision. As a result of the motion failing,the P1aruling
Commission decision to approve was upheld (Attachment A).
The lease agreement was continued by the City Council with additional direction to staff and
the applicant to:
1) The applicant to run field tests at a pole height of 55 feet and up to 66 feet in order to
determine the acfual m;n;mum height requirement for the antenna array.
2) Staff to contact AT&T Wireless to see if it continues to be interested in the joint project
and obtain its input on two potential solutions: a) what antenna height was needed if it

collocated above the Verizon antenna array on the same treepole,and b) what was the
minimum antenna height needed if it built its own treepole in the same area.
3) Staff to bring back the following design options for Council review: a) Construct the
Verizon treepole at the min;mum height requirement with the flexibility to extend the
height for another wireless provider;or b) construct another treepole for the second
provider at the m;nimum height required (Attachment A).
ACTIONS TAKEN:
Verizon Wireless hired a third party contractor,Yupana LLC to conduct its wave testing at City
Hall on November 16,2015. As a result of that testing,Verizon Wireless concluded that it could
lower the height of its antenna array to 55 feet(measured to the top of the antennas) and still
meet its coverage objectives if the tops of the adjacent trees could be trimmed to eliminate likely
radio interference (Attachment B).
Staff contacted AT&T Wireless to determine its current interest in the Civic Center cell location
and the carrier provided the attached written response (Attachment C). AT&T is extremely
interested in improving its radio coverage in the Civic Center area and using the recently
approved facility proposed at City Hall. But to use the same treepole as Verizon and provide
useful coverage, AT&T states its antennas need to be above Verizori s antenna array by about
20 feet. AT&T also states that it would commit to filing an application for antenna collocation
by the end of the first quarter of 2016 with a tall treepole approval that provides 20 feet of
vertical separation from the Verizon antenna array. AT&T is coYrunitted to the higher antenna
height so a separate treepole constructed by AT&T at the same location would not reduce the
visual impact of the wireless facility.

Executive Summary
introduction
In November 2015 Yupana LLC was engaged by Verizon Wireless to conduct CW testing of a location which is being considered by
Verizon RF Design department for a future cell site location. CW testing allows the RF design engineer to have accurate RF propagation
data, which gives a better indication of the RF conditions than other methods (using software predictions and simulations) Using these
CW results, the design engineer can assess the signal levels that would be expected, under various design settings. By adjusting the RF
hardware and parameters (e.g. antenna type, antenna tilt, output power, antenna azimuth, antenna height) it is possible to have an
accurate measurement of the RF propagation and resulting signal levels for various RF design scenarios
Overview of Scope
Using industry standard RF transmitters, and associated temporary support structures, Yupana transmitted RF test frequencies at the
required design azimuths and at 3 different heights (52 ft, 57 ft and 62 ft) One key purpose of the testing was to verify the signal levels
which would result from mounting the antennas at the three different height options. For each design scenario, Yupana collected the CW
signal levels using industry standard RF scanning receivers and associated drive test hardware and software tool. The resulting data was
post processed and analyzed, and a detailed Engineering Report was delivered to Verizon RF department to assist with the design
decision process in relation to the optimum height required to satisfy the RF design requirements.
Results
Based on the results of the CW testing and the data in the Engineering Report, as graphically shown in the attached maps, Verizon
Wireless were able to determine that the antenna height of 52 ft would satisfy the design requirements for RF coverage.

We would like to appeal the flugust 25, 2015 decision of the Ctepertino Pla.nning Commission to allow a
Development Permit and Hei�ht Exemption r�Verizon u'ireless to hui3d a t�ireless facility at Cupertino
City Hall parking lot. Many of us aet very poor cell reception in c�ur homes and support im�roved
wireless in the area. However,we str�ngly disagree with the choice of placin�the facility in a residential
neighbochood.
Our objection is based on the following:
l. The facility violates several policies defined by the Cupertino Wireless Master Plan (CWMP).
2. The facility will aesthetically dama�e the surrounding residential neighborhood.
3. Alternative locations were not fully investigated.
4. Safety concerns have not been ful]y addressed.
5. Affected residents were not adequately notified.
1. 'I'he facility vi�lates the Cu�ert�no �Nireless lv�aster Plan (C P).
The Staff re�ort claims the �lan is in accordance with the Cupertino Wireless 1Llaster Plan(CWMP). We
would argue that it is not. The CWlY1P states as one of its goals to"Protect community aesthetics and
promote safety by planning for well sited and 4ve11-designed personal wireless service facilities that fit
unobtrusively in the Cttpertino environment"{pg. 4). The proposed facility does nat satisfy these
conditions.
The CWMP lists"Ne�� Structures in Residential Areas" as the Least Preferred location for wireless
service facilities. The proposed facility is borclered in three quadrants by residences. Some of these homes
look out directly on the area where the artificial tree will be placed. One home is only 84 feet a��ay. The
city hall buildings are the least aftected properties in the area(farthest a`vay and fe«rest site lines).
The followinb are policies laid out in the CWMP that we feel the proposed plan violates,followed by our
reasoning:

-Residential areas border the proposed facility in three quadrants. The CWMP defines obtrusive
as: "A term used to describe a personal wireless service facility that is visually dominating to its
surrounding environment."The proposed facility will dominate the area that surrounds it,
towering over buildings and vegetation. Several residences will look out directly on the facility.

that visually contrasts with its sut-roundings to the point of conflicting«�ith it...."The proposed
tree is visually intrusive on the residences that surround it. Many residents will hav.e a clear,
unobsn-ucted view of the facility�ft-om their l�omes. The artiflcial eucaly�tus tree will conflict with
its surroundings,tivhich���ill Ue a sparsely landscaped area whell the project is finished.

-The proposed tree appears at least ri��ice the size of surrotulding trees and buildings(if��ot more)
and thus not appropriately scaled. l�lany of the trees that are cui-�•ently located in that area will
have to be removed for installation, further removing any cover the area c;«rrently provides. The
new facilit��will be anything but harmonious with its surroundinas.

-An �0-foot artificia.l eucalyptus tree will not blend ��ith the far smaller a.cacia n�ees and one-to-
two-story bui]dings that will surround it.
The CW1�1P further goes on to sta.te that wh�n an artificial tree is used: "[it] should be of a fonn siinilar to
the surroundina trees to which it is being visually integrated, and be canstructed of materials that retain a
natural ap�earance for the life of the personal�vireless service facility"(pg. 24). �1Daiii,the pi•oposed tree
is not of a form similar to surrounding trees. The faux tree is eucalyptus and the s��rro�uiding trees are
acacia. Later in the CWMP it reiterates, "The artificial tree should not be significantly taller than the
sui-�•ounding vertical elements(i.e., buildings,trees, structures, etc.)"(pg. 2�). The proposed artificial tree �
is clearh� in violation of fhis guideline and is significantly taller than surrounding trees and structures.
Santa Clara County al5o has a docuinent called the Wireless Telecomm��nications racilities Design
Guidelines, which requests facrlities"blend with and/or complement the color, design and/or character of
the surrounding context,whether natural backdrop, building or existing facility."The document gives
several examples of tree poles that are or are not cited properly highlighting"the importance of blending
with surroundings."The example given of a poorly sited tree pole notes: "The constructed"tree"bears no
relationship to the size, shape and character of surrounding physical elements."The proposed City Hali
facility is one such poorly situated tree.
Community��ireless faciiity plans like those prepared by Cupertii�o ancl Santa Clara County exist to
protect neighborhoads and residences fi•om unsightly and oversized facilities tha.t threaten their aesthetic
and property values. These lengthy ai�d well-developed plans should nat be so easily ib�zared. �
Furtllermore, i�owhere in the variotts ��olicies and buidelines does it state that siting and desi;n
requirements can be ignored fo�•20-30 years as new landscaping grows to cover and s�n-round the 80-foot
artificial tree. They all require that siich conditions e�ist or are put in place immediately. in these
documents, all of the examples of properly located artificial trees show them among mature,full grown
trees of comparable size to the artiFicial tree.
2. The fa�ili$y will aestheti�ally dama�e �he s�i o�an�ing ��siden�i� n�i�hbo�hood.
As noted above,the proposed wireless facilit;�will not blend in to its surroundings and will tovver over
surroundiiag trees aud buildings,darnaging the appearance of the neighborhood. Per the Staff Report,
"Planning staff is requesting that the Planning commission defer review and approval of the landscape
plan to the City Council and the Public Works Department"—however, landscaping is key in this proposal
if it is to "blend in"as plans require. Several of the acacia trees that were cited as providing camouflage
and cover will be removed for the installation of the facility. Furthermore, as stated in the Staff Report,
per the governo�•mandate the area cannot be irrigated,thus we question if and when ne�v trees will be
planted. All reports seem to indicate that the drought will not let up anytime soon. The ar;ument that ne«�
landscaping wil( be easily added to camouflage an 80-foot tree is specious. As stated before, no���here in
the various guidelines prepared by the city or the county does it state that the facilit_y will have 20-30
years to meet the requirement of"blending in"«itl� surroundings. With technology changing at such a
rapid rate, we question if the facility ��rill even be in use rn 20-30 years.
3. �ternative locations �vere r�ot fa��y investigate�.
The Alternative Site Analysis provided by Verizon Wireless notes that they were unable to contact or
reach agreements with surrounding buildings. We argue that their efforts did not go far enough. An Apple
building is listed as a preferred location but the document notes they were unresponsive to their form
letters. Could no connections be made to allow this facility to be considered? Furthermore,the Cypress

Hotel was rejected after no agreements could be made with the owners. The hotel has been purchased by
new owners who have not yet been contacted. Lastly, much of the discussions with building owners
happened several years ago and we argue that it is worth doing another round.
The only"new build" sites considered were at City Hall. Local parks such as Wilson Park were not
considered, even though they have groves of tall trees. Within City Hall property, other locations were
rejected because they were not visually pleasing and did not have enough visual cover. However, as
already stated above,tlie current proposed site does not have enough visual cover and will lose even more
during installation.Furthermore,the other proposed City Hall locations are farther from residences and
less in their visual site lines. �
It is also worth pointing out that this�Iternative Site Analysis document mentions that Verizon consulted
Santa Cruz County regulations regarding zoning, not Santa Clara County. We want assurances that this
facility meets the guidelines of the appropriate county. This glaring error calls into question the accuracy
and thoroughness of the document and process.
4. Saf�t�concerns have not be fully addressed.
In requesting the height exemption the staff report only addresses the safety of the facility with respect to
radio frequency energy emissions. It does not discuss the safety of the facility itself, such as:
• The safety of the generator.
• Susceptibility to flooding. A 2005 Cupertino City study in coaperation with FEMA indicated that

• Susceptibility to lightning strikes.
As the facility is close to numerous residences and located near a busy local library, and beside the side
walk, these safety concerns are not to be taken lightly.
5. Affectecl resiclents were no� adequately notifie�.
We do not feel that local residents were adequately notified. Many residents were confused by the signage
and flyers. The text calling attention to the wireless pole was done in white on a light background,
rendering it nearly illegible. Several different heights were also referenced(SO feet, 66 feet, 85 feet).
Many also feel that a greater radius than 300-feet is affected by�he facility. We ask if ordinance
]9.108.090B of the Wireiess Communications Facilities Ordinance applies, 4vhich requires mailed written
notice of public hearinas ti�vithin one thousand feet of tlie elterior boundary of the propei-ty. Per
19.108.l 0U, "A notice of Public Hearing for an [height] eYemption under this chapter shall be given in the
same manner as provided in Section 19.120.060 and Section 19.108.090(I3)(4)."

hearing following the appeal would allow us the opportutlity ta get the word out so that more voices can
be heard.

�19.12.170 Appeals. .
A. An appeal may be filed by any person, firm or corporation aggrieved or affected by any
grant, denial, modification or revocation of any permit, or any determination or interpretation
related to any provision of this title. �
B. Filing:
1. An appeal shall be in writing on forms prescribed by the City and shall be filed during
regular office hours with the City Clerk within fourteen calendar days after the City decision or
if a notice of decision is not required, from the date of the decision or determination,under this
title. An appeal not filed witivn such time shall be barred. The appeal sHall state the grounds
and basis thereof.
2. Appeals under this chapter are subject to an appeal fee as prescribed by resolution of the
City Council.
C. Noticing: Notice of hearing shall be given in the same manner in which the original notice
was given. If a project with no noticing is appealed, appropriate noticing shall be determined
by the Director of Community Development.
D. Appeal hearing body shall be determined in accord with Section 19.12.030.
E. Decision of the appeal hearing body: The decision or determination of the appeal hearing
body on any appeal shall be final and effective immediately.
F. Notice of.Decision: Notice of the appeal hearing body's decision shall be mailed to the
original applicant, to the person filing the appeal, and to any other person who has filed a
written request with the City Clerk.

SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
Development Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Plannulg Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
� 1) The proposed use, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be deirimental to the public health, safety,
general welfare, or convenience. The project will utilize an unused corner of the Civic
Center property and generate radio frequency energy emissions and noise in quantities that
will be below Federal safety standards and City standards respectively. The antenna mast
will be designed to mimic a tree to blend into the existing landscaping. Other constructed
features will utilize high quality materials and not block sight lines for vehicles or
pedestrians;
2) T'he proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan, the Wireless Facilities Master Plan, the Wireless
Communications Facilities Ordinance and the purpose of this title.
3) That the operation of the facility will comply with federal safety standards for radio
frequency energy emissions.

NOW, THEREFORE,BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted
in this matter, the application for Development Permit is hereby approved with the landscaping
and irrigation plan deferred for City Council approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are
based and contained in the public hearing record concerning Application No. DP-2014-07 as set
forth in the Minutes of fhe Pla��ululg Commission Meeting of August 25, 2015 and are
incorporated by reference as though fully set forth herein.

contained in this resolution.
2. NOTICE OF FEES DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which.you may protest
these fees, dedications, reservations, and other exactions, pursuant to Governxnent Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions. �
3. COLOCATION OF ANTENNAE
The treepole shall be structurally designed to accommodate the collocation of additional
antennae from other wireless carriers. The co-location agreement shall be at market rates
with reasonable compensation to the mast owner.

4. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period
of 18 months, said aerial and associated facilities shall be removed. The applicant shall bear
the entire cost of demolition and removal.
5. EXPIRATION DATE
This development permit shall expire ten(10) years after the effective date of the permit. The
applicant may apply for a renewal of the development permit at which time the Planning
Commission may review the state of wireless communication technologies, camouflage
techniques and maintenance to determine if the visual impact of the aerial facility can be
reduced.
6. TREE POLE APPEARANCE AND MAINTENANCE �
The applicant shall construct a eucalyptus style treepole to raise the height of the antennas
and shall meet the following design criteria:
a) Use a sufficient number of artificial branches to obscure the appearance of the panel
antennas and any associated mounting framework.
b) Panel antennas mounted away from the mast shall be covered in leaf socks to blend with
the green foliage of the artificial branches.
c) The mast shall be wrapped with a faux bark and any antenna mounted close to the mast .
shall be painted brown to mimic a tree trunk.
d) The foliage shall have a mottled green coloration.
The building permit shall be reviewed and approved to the satisfaction of the Community
Development Director to ensure the above condition is met. The applicant shall perform
regular maintenance of the tree pole to maintain its appearance and obscure the panel
antennas from public view.
7. EQUIPMENT ENCLOSURE
The base equipment enclosure shall be constructed of high quality materials and/or be
� ' screened by appropriate landscaping as determined by the City Council. The final enclosure
design shall be reviewed and approved by the Director of Community Development prior to
issuance of building permits.
8. TREE REMOVAL
The applicant shall apply to the City Streets and Trees Supervisor for permission to remove
.any Park trees associated with the construction of this wireless facility.
9. ACOUSTICAL ENCLOSURE FOR EMERGENCY POWER GENERATOR
To meet City Noise standards, the power generator shall be enclosed with a Leve12 Acoustic
Enclosure. The addition of the acoustic enclosure shall be noted on the building plans.

10. SETBACK OF ENCLOSURE FENCING FROM TRASH ENCLOSURE & PARKING LOT
CURBING
At the building permit stage, the applicant shall provide revised drawings of the equipment
enclosure demonstrating a minimum 2-foot setback of the enclosure fencing from the parking
lot curbing and a minimum 3-foot setback of the enclosure fencing from the trash enclosure
fencing.
11. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file nos. ASA-2014-10 and EXC-2014-12 shall be
applicable to this approval.
SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT

12. WIRE CLEARANCE EASEMENT
Prior to building permit approval,Applicant shall coordinate with Public Works staff to
vacate or otherwise address the wire clearance easement that affects the project.
13. LANDSCAPING AND IRRIGATION APPROVAL
Prior to building permit approval, Applicant shall coordinate with Public Works staff to
obtain City approval for new/replacement landscaping and irrigation for the project.
14. CONSTRUCTION STAGING PLAN
Prior to building permit approval, Applicant shall provide a construction management plan
that identifies the timing/duration of construction activities, and construction staging and
temporary construction improvement locations that shall be reviewed and approved by the
Director of Public Works.
