Subject: Director's Minor Modification (DIR-2015-27) to allow the addition of three (3)
panel antennas and associated equipment on an existing personal wireless service
facility located at 10121 Miller Avenue.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND
Michelle Martinea, Crown Castle, is proposing to add three (3) panel antennas and
associated equipment for T-Mobile on its existing personal wireless service facility
located at 10121 Miller Avenue. No increase in the height of the facility, expansion of
the existing equipment pad, or increase in the number of equipment cabinets contained
within is proposed.
DISCUSSION .
The existing T-Mobile personal wireless service facility consists of six panel antennas
mounted at a height of about 54 feet above grade on a monopine. The proposed
modification adds three new antennas to the wireless facility at the same height as the
existing antennas. The new antennas and associated mounted equipment will be
painted to match the monopine and will be additionally camouflaged by the monopine
foliage from public right-of-way views. Radio frequency (RF) energy emissions from the
new antennas continue to be forecasted to be below federal safety standards for
exposure to RF emissions. The project will thus comply with the City's Wireless
Facilities Master Plan and the City's Wireless Communications Facilities Ordinance
(CMC chapter 19.136).

Recent federal regulations per section 6409 of the Middle Class Tax Relief and Job
Creation Act of 2012 further limit the ability of cities to regulate the modification of
existing personal wireless service facilities. The T-Mobile proposal falls within this
federal legislation and must be approved by the City. Staff continues to monitor
changes in state and federal wireless legislation and will notify decision makers of its
impacts on local wireless facility regulation.

ACTION
In accordance with Cupertino Municipal Code Section 19.164, the Director of
Community Development deems the modification minor and approves the
modification described in the plan set titled: "T-Mobile" prepared by CLS Group
Telecommunications, and consisting of twelve (12) sheets labeled T1, C-1 through C-7,
G1 and G-2 last revised 10/29/15, except as may be modified by the conditions
enumerated below.

1) BUILDING PERMIT REQUIRED
This approval does not constitute building permit approval; a separate building
permit is required.

2) ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data
including but not limited to property boundary locations, building setbacks,
property size, building square footage, any relevant easements and/or
construction records. Any misrepresentation of any property data may invalidate
this approval and require additional review.
3) CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
4) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, .
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
5) RADIO FREQUENCY ENERGY EXPOSURE
The independent and cumulative emissions for the proposed facilities sha11 meet
Federal Communications Commission regulations and guidelines to prevent
public exposures to radio frequency energy emissions that are in excess of
federal safety standards. Any cautionary signage should be in multiple
languages, including English and Spanish.
6) ABANDONMENT
In the event the antennas, associated equipment, or any portion of the facility
thereof, are left unused for a period of 18 months the property owner or
applicant shall bear the entire cost to remove the subject equipment and to
restore the site_to its previous condition.

7) INDEMNIFICATION
Except as otherwise prohibited by law, the applicant sha11 indemnify and hold
harmless the City, its City Council, and its officers, employees and agents
(collectively, the "indemnified parties") from and against any claim, action, or
proceeding brought by a third party against one or more of the indemnified
parties or one or more of the indemnified parties and the applicant to attack, set
aside, or void this Resolution or any permit or approval authorized hereby for
the project, including (without limitation) reimbursing the City its
actual attorneys' fees and costs incurred in defense of the litigation.
The applicant shall pay such attorneys' fees and costs within 30
days following receipt of invoices from City. Such attorneys' fees and costs shall
include amounts paid to counsel not otherwise employed as City staff and shall
include City Attorney time and overhead costs and other City staff overhead
costs and any costs directly related to the litigation reasonably incurred by Cify.
This approval is effective December 16, 2015. The fourteen calendar day appeal period
will expire on December 30, 2015.
