Staff has made the finding that the tree is irreversibly diseased, in dailger of fallulg, or can cause potential damage to existing or proposed essential structures, or interferes with private on-site utility services and cannot be controlled or remedied through reasonable relocation or modification of the st-ructure or utility services. The proposed replacement plan is consistent with the Protected Tree Ordinance in that the applicant is plailting the required number of replacement trees on site . The finding is necessary to grant the tree removal permit in accordance wifh section 14.18.180 (A) (1). The application is approved with the following conditions: 1. APPROVED PROJECT The approval is based on the arborist report prepared by Mark HirschUek (#WE-9931), dated September 3, 2015, consistuzg of four pages and a tree removal and replacement site plan, except as . may be ameizded by conditions u1 this resolution. 2. TREE REPLACEMENT The required replacement txees are �liree (1) 24-ulch box ap�le t�•ee and (1) 24-inc12 Italian cy�a�ess, as per the replacement plan. The applicant shall provide the Department of Community Development adequate documentation, including but not limited to photographs, receipts, or invoices to verify that the replacement tree have been planted witl-iin 30 days of replanting/removal. 3. PROTECTED TREES The applicant understands that replacement txees are protected trees and may not be removed without a Tree Removal Permit and that they shall be responsible for ensuring the proper maintenance and care of the trees. The applicant shall also disclose the Iocation and species of all replacements trees on site upon sale of the property. 4. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government�°Code Section 66020(d) (1), these Conditions constitute written nofice of a statement of the amount of such fees, and a description of the dedications,reservations, and otller exactions. You are hereby,notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exaction, pursuant to Goverrunent Code Section 66020(a), has begun. Sincerely, Tiff r Assocaite Planner (408) 777-1356 tiffanyb@cupertino.org Hirschbek tree surgery 9/03/15 Nancy Gabriel 1496 Rose Garden Ln Cupertino, CA Arborist Recommendation for Removal On September 1, 2015, Mrs. Gabriel asked me to give my opinion on removal of a large deodora-cedar tree in the back of her property due to continuing nuisance. Location: The deodora-cedar is against the fence in the back left corner of the home (1496 Rose Garden Ln, Cupertino) Description: The deodora-cedar is approximately 60 years old with a DBH of 27 inches. The height of the tree is approximately 35 ft. tall with a canopy spread of approximately 45 ft. Conclusion: The cedar tree produces pollen, which the homeowner and neighbor are highly allergic to and the tree is growing in the middle of the power lines. The roots are causing structural damage on walkways, a fence, and shading property which is hindering growth of other trees. I believe this tree is too large and is a nuisance to my client, causing unnecessary structural damage & health issues. Removal of this tree would prevent further nuisance and damage in the future. My client will be replacing this tree with(2), 24-inch box trees (still deciding which trees will be best suitable) and will be supervised by a certified arborist. I hope my observations aid in the decision regarding this tree.
