SUBJECT:TREE REMOVAL PERMIT ACTION LETTER—Application TR-2015-59
This letter confirms the decision of the Director of Community Development, given on November 24,
2015 approving a Tree Removal Permit to allow the removal and replacement of one Fraxinus uhdei
(ash)tree located in a planned development zone at 10200 N. Tantau Avenue.
Staff has made the finding that the protected trees are dead and cannot be controlled or remedied
through reasonable relocation or modification. The proposed replacement plan is consistent with
the Protected Tree Ordinance since the applicant is replacing the trees on site, and the number of
replacements is consistent with the ordinance. The finding is necessary to grant the tree removal
permit in accordance with section 14.18.180 (A) (1) and (3).
The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Dave Muffly (#WE-4279), dated October
15, 2015, consisting of five pages including a tree removal and replacement site plan, except as may
be amended by conditions in this resolution.
2. TREE REPLACEMENT
The required replacement tree is one 48-inch box Fraxinus v. 'Rio Grande' (Arizona Ash), as per
replacement plan. The applicant shall provide the Department of Community Development
adequate documentation, including but not limited to photographs, receipts or invoices, to verify
that the replacement trees have been planted within 30 days of replanting.
3. PROTECTED TREES
The applicant understands that replacement trees are protected trees and may not be removed
without a Tree Removal Permit and that they shall be responsible for ensuring the proper
maintenance and care of the trees. The applicant shall also disclose the location and species of all
replacements trees on site upon sale of the property.
4. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government. Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.

The tree in question is a 23 inch diameter at breast height Mexican Evergreen or
Shame) Ash (Fraxinus uhdei).
Tree was found with the condition shown in the photo below. Three large buttress
roots were cut close to the trunk, with their cut ends painted white. Excavation on
the street side of the tree found no buttress roots on that side of the tree, visible
below. Thus, the tree had no surface supporting roots for nearly 180 degrees
around the circumference of the base of the tree. This lack of support rendered
the tree an immediate hazard, which could potentially land on multiple cars in the
parking lot. Had the tree failed, it would have been a common hinge-type failure.
Human casualties were also a real possibility, given the level of use the parking
lot receives. The tree represented a grave risk to human safety and property.
Removal of the tree was necessitated to mitigate this substantial and
unacceptable risk.

The photo below shows the size of the tree. As can be seen, the tree already had
a canopy unbalanced toward the parking lot, making the risk of catastrophic
failure that much •reater.

We propose to replace this tree with a 48" box Canby Red Oak (Quercus canbyi)
to match other plantings in the vicinity. We strongly recommend against
replacement with the same species as before, Shamel ash. Shame) ash is a
heavy water user, and thus not sustainable in our drought defined climate.
Shamel ash is known for extreme surface rooting, which typically causes
substantial infrastructure damage, with attendant large maintenance cost.
Shamel ash is rarely grown in California, as professionals throughout the state
have learned, from painful experience, just how costly and destructive this tree
species is.

IIIThese are mature Canby red oaks on an eroded street median. Like most oak
trees, Canby red oak is drought adapted and deep rooted, causing little
infrastructure damage. The photo below shows fall/winter foliage coloration of
Canby red oak. This is the tree species being used along Homestead Road at the
north side of the Apple Campus 2 project. Canby red oak is relatively new to
California, but is catching on rapidly.
