Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACICGROUND The applicant, David Elliot, representing the BSP Cupertino Union, LLC, is requesting architectural and site modifications to previously approved enhancements at an existing auto service station at 21530 Stevens Creek Boulevard. On May 22, 2012, the Plaru�ing Coininission approved a Use Permit (U-2011-09) and Architecfural and Site Approval(ASA-2011-10) for the following: e Remodel an existing service station, add 527 square feet, and convert the service bays to a convenience market • 24-hour operations, seven days a week,with beer and wine sales ceasing at mici�light e Concurrent sale of gasoline and alcohol(beer and wine) within the convenience market s A 2,580 square foot office developinent On October 28, 2014, Plaruiing Division Staff approved Director Minor Modification (DIR-2014- 13) for the following: � • Removal of the office component of the project e Height increase to north and south elevation entry towers by three (3) feet, and total buildulg height increases of six inches (for a total height of 16 feet, 7 inches). DIR-2015-25 21530 Stevens Creek Blvd Page 2 DISCUSSION The proposed relocation of a transformer pad on-site is being required by PG&E which has resulted .in other site modifications. In addition, the applicant is proposing modifications to landscaping,utility fencing, power main, and an accessible path of travel. • Transformer: The transformer is relocated from under a tree adjacent to a trash enclosure located at the rear of the properfy. The transformer is screened in materials and colors that match the previously approved trash and propane tank enclosures. ' • Parking: The relocation of the transformer necessitates the removal of one parking space along the rear of the property. The applicant has added three (3) parallel parking stalls along the eastern end of the parking lot for a total of twelve (12) parking stalls on site, where ten(10) are required. • Landscaping: The Applicant also proposes to reduce the number of plantings within the portion of the property previously to be developed with an office building. The project will still be required to maintain consistency with Cupertino Municipal Code (CMC) Chapter 14.15: Landscaping Ordinance. • Utility Fence and Power Mains: The power main for the building has been relocated to the southeast corner of the building. In order to help conceal the power unit, the extent of a previously approved utility fence has been enlarged. A Condition of Approval has been added requiring the box to be painted to match the building. • ADA Accessibility: The ADA path of travel from the accessible parking stall has also been relocated. ACTIOIV The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS , Approval is based on exhibits titled: "7-Eleven. 21530 Stevens Creek Blvd., Cupertino, CA 95014," prepared by David J. Elliot & Associates, received September 18, 2015 consisting of seven (7) sheets labeled A1.1, A1.4, LP-1, LP-2, LI-1, LI-2, and LI-3, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL The following previous conditions of approval for the project pertairung to use and architectural/site details shall remain in effect: DIR-2014-13 • All conditions - DIR-2015-25 21530 Stevens Creek Blvd Page 3 U-2011-09 • AIl conditions, except that the approval for the 2,580 square foot office building is no longer valid ASA-2011-10 • All conditions, except that the approved architectural and site details shall be superseded by this approval, and that the approval for the 2,580 square foot office building is no longer valid DIR-2008-12 • All conditions,provided the Phase II vapor recovery system will be in operation U-1988-23 e All conditions, except that the convenience market approved under U-2011-10 has superseded the permitted uses onsite U-196�-08 � All conditions, except that the convenience market approved under U-2011-10 has superseded the permitted uses onsite 3. LANDSCAPE PROTECT SUSMITTAL Prior to issuance of buildin��permits, the applicant shall submit a fu11 landscape project submittal, including the Water-Efficient Design Checklist (Appendix A of Chapter 14.15), Landscape and Irrigation Design Plans, and Water Budget Calculations, for review and approval to the satisfaction of the Director of Community Development, per section 14.15.040 of the Landscaping Ordinance. ' 4. LANDSCAPE INSTALLATION REPORT A landscape installation audit shall be conducted by a certified landscape professional after the landscaping and irrigation system have been installed and prior to final occupanc�. The findings of the assessment shall be consolidated into a landscape installation report. The landscape installation report shall include, but is not limited to: inspection to confirm that the Iandscaping and irrigation system are installed as specified in the landscape and irrigation design plan, system tune-up, system test with distribution uniformity, reporting overspray or run-off that causes overland flow, and preparation of an irrigation schedule. The landscape installation report shall include the following statement: "The landscape and irrigation system have been installed as specified in the landscape and irrigation design plan and complies with the criteria of the ordinance and the permit." 5. LANDSCAPE AND IRRIGATION MAINTENANCE A maultenance schedule shall be established and submitted to the Director of Commtuzity Development or his/her designee, either with the landscape application package, with the DIR-2015-25 21530 Stevens Creek Blvd Page 4 landscape ulstallation report }�rior to issuance of final occupanc�, or any time before the landscape installation report is submitted prior to issuance of building permits. a) Schedules should take into account water requirements for the plant establishment period and water requirements for established landscapes. b) Maintenance shall include, but not be limited to the following: routine inspection; pressure testing, adjustrnent and repair of the irrigation system; aerating and de- thatching turf areas; replenishing mulch; fertilizing; pruning; replanting of failed plants; weeding;pest control; and removing obstructions to emission devices. c) Failed plants shall be replaced with the same or functionally equivalent plants that may be size-adjusted as appropriate for the stage of growth of the overall installation. Failing plants shall either be replaced or be revived through appropriate adjustments in water, nutrients,pest control or other factors as recommended by a landscaping professional. 6. SCREENINING All mechanical and other equipment on the building or on the site shall be screened so they are not visible from public street areas or adjoining developments. Screening materials/colors shall match building features and materials. The height of the screening shall be taller than the height of the mechanical equipment that it is designed to screen. The location of equipment and necessary screening shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. WASTE TRIO SET � Applicant or property owner must install one permanently mounted waste trio set designed for outdoor use pursuant to Section 9.16.040(E) CMC adjacent to the business near the sidewalk for public use and patrons of the facility. The trio must Ue shown on a site plan for advance review by the Environmental Programs Division. See example of trios at www.cupertino.org/nowaste 8. STORM DRAIN INLET MARKERS � All storm drain inlets on the parcel must be clearly marked with "No Dumping Flows To Creek" Pursuant to Section 9.18.210(4)(A) GMC. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requireinents. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 10. INDEMNIFICATION To the extent permitted by law, the applicant shall indemnify and hold harmless the City,its City Council, its officers, employees and agents (the "inderrulified parties") from and against any claim, action, or proceeding brought by a third party against the indexnnified DIR-2015-25 21530 Stevens Creek Blvd Page 5 parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant and City shall use best efforts to select mutually agreeable legal counsel to defend such action, and the applicant shall pay all compensation for such legal counsel, following the applicant's receipt of invoices from City, together with reasonable supporting doctunentation. Such compensation shall include reasonable compensation paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. If the applicant and the City cannot in good faith agree on joint counsel, the City shall have the right to retain counsel of its own choosing, separate from the applicant's litigation counsel: 11. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth hereul may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Govemment Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective October 19, 2015. The fourteen calendar day appeal period will expire on November 3, 2015.
