Staff has made the finding that the protected trees are dead and cannot be controlled or remedied through reasonable relocation or modification. The proposed replacement plan is consistent with the Protected Tree Ordinance since the applicant is replacing the trees on site, and the number of replacements is consistent with the ordinance. The finding is necessary to grant the tree removal permit in accordance with section 14.18.180 (A) (1) and (3). The application is approved with the following conditions: 1. APPROVED PROTECT ' This approval is based on the arborist report prepared by Michael Bench (#WE-1897A), dated September 29, 2015, consisting of four pages including a tree removal and replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENT The required replacement trees are four 36-inch box Columnar Blue Atlas Cedar (Cedrus atlantica) and one 72-inch box Shumard Oak (Quercus shumardii), as per replacement plan. The applicant shall provide the Department of Community Development adequate documentation, including but not limited to photographs, receipts or invoices, to verify that the replacement trees have been planted prior to final occupancy of the main office building at the Apple 2 campus. 3. PROTECTED T'REES The applicant understands that replacement trees are protected trees and may not be removed without a Tree Removal Permit and that they shall be responsible for ensuring the proper maintenance and care of the trees. The applicant shall also disclose the location and species of all replacements trees on site upon sale of the property. If /; / 4. Cas iVlanagr A Review of Pine Trees Located on Tantau Avenue Apple Campus 2 Project Cupertino, California Assignment I was asked by Meg Thotnas and Dave Muffly, Apple Arborist, to make an. inspection of the perimeter trees. Observations I inspected the subject trees on September 29, 2015. Concerning the transplanted trees, the current loss rate is 1 Coast Redwood Tree (I do not have its number), which is 1%. The olive trees around the oce building located at the corner of Pruneridge and Tantau Avenues are currently being boxed for transplant. These will be stored in a parking lot across the street on Tantau off of Forge Drive. Once these olive trees are boxed and moved to this storage area, there will have been 99 trees boxed for transplant. Many of the trees have already been transplanted into the new landscape. Thus, the current loss rate is slightly less than 1%, which is remarkable. I think this may be the lowest loss rate of any large project that I have been associated. _ However, a few other transplanted trees are showing signs of stress and are still - struggling. Time will tell whether or not these other transplanted trees will survive. It appears that all of the transplanted trees are adequately irrigated at this time. The majority of the perimeter trees are in good condition. However, the Monterey Pine (Pinus radiata) Trees #2977 and 2983, both on Tantau Avenue have suddenly died this past month. I inspected the trunks of these trees and I discovered that each of these trees has an infestation of Red turpentine beetle (Dendroctonus valens), an insect which commonly attacks pine trees in stress, especially drought stress. Prepared by Michael L. Bench, Site Observations: 1 Consulting Arborist September 29, 2015 /i. +./ , Wolfe Road At Cupertino Village Cupertino, California Also, in the same area of Tantau Avenue, I inspected the trunks of two other Monterey pine Trees#2988 an 2974. These trees are alive but are showing a moderate level of stress at this point. These two trees (2988 and 2974) are also under attack by the Red turpentine beetle (Dendroctonus valens). I found 6-8 active exit holes on Tree# 2988 and 2 active exit holes on Tree#2974. There is nearby irrigation for transplanted Coast redwood trees. I asked Dave Muffly to extend the irrigation to include both 2988 and 2974. Irrigation is the common treatment for Red Turpentine beetle. I expect that Tree# 2974 will survive the beetle attack as a result of the supplemental irrigation. It appears that the survival of Tree#2988 is questionable. I have seen Red Turpentine beetle in prolific numbers this past year and the year before. In my opinion, the attack by this insect on pine the trees at this site appears to be primarily a result of the severe drought and likely very little to do with construction. , Respectfully submitted, ---s1_\_ Michael L.
