SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2015-46
This letter confirms the decision of the Director of Community Development, given on October 26, 2015
approving a Tree Removal, Permit to allow the removal and replacement of one protected,
development tree at an existing shopping center, located at 1655 S De Anza Blvd.
The tree is not a specimen tree, and only served as a required development tree. Staff has made the
#inding that the protected tree is a detriment to the subject property due to limb failure and cannot
be adequately supported on the subject property. The proposed replacement plan is consistent with
the Protected Tree Ordinance since the applicant is replacing the tree on site, and the number and
size of replacement is consistent with the ordinance. The finding is necessary to grant the tree
removal permit in accordance with section 14.18.180 (A) (1) and (3).
The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Kris Yamaguchi (#WE-8142A), dated
August 17, 2015, consisting of five pages including photos and a tree removal and replacement site
plan, and a two-page clarification statement dated September 28,2015 and a one page clarification
statement dated October 7, 2015, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENT
The required replacement tree is one 30-inch box Platanus acerifolia 'Yarwood' as per replacement
plan. The applicant shall provide the Deparhnent of Community Development adequate
documentation, including but not limited to photographs, receipts or invoices, to verify that the
replacement tree has been planted within 30 days of replanting.
3. PROTECTED TREES
The applicant understands that replacement trees are protected trees and may not be removed
without a Tree Removal Permit and that they shall be responsible for ensuring the proper

maintenance and care of the trees. The applicant shall also disclose the location and species of all
replacements trees on site upon sale of the property.
4. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS
The conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Governxnent Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.

SUMMARY ARBORIST REPORT
For the Removal of one (11 Eucalyptus sp., Eucalvptus located in landscape planter
in front of the center adjacent to the sidewalk.
Tree Height: 40-45 feet
Tree Diameter (DBH): Co-dominant stem; #1 Stem: 24" #2 Stem: 21" Total: 45"
Tree Condition: Numerous limb failures; liability: parking lot/driveway entrance.
Tree Health: Good
Tree Structure: Poor
InsectlDiseases: None present
This tree has co-dominant stems that pose a potential liability to the property owners
and visitors of this shopping center.
For this reason, we request that a Tree Removal Permit be issued so that this potential,
future liability can be address sooner than later. .
In addition to this tree removal project, the owners also intend to remove and replace
the tree cut-out in the concrete curb which surrounds the landscape planter.
This cut-out is an obtrusive obstacle in the parking lot and often is considered a
nuisance to visitors.

As mitigation for the removal of this tree, a replacement tree will be planted of twenty-
- four inch box size and will be maintained to ensure survival.
Currently, the trees on this property contain two primary species. There is a row of
mature Hollywood Junipers planted in between the parking lot and the storefronts. A
row of Italian Cypress borders the rear of the center befinreen the parking lot and the
surrounding residential homes.
The location to plant a replacement tree is limited on this site. To be consistent with the
existing trees on site, we recommend that the replacement specie be: Italian Cypress.

Clarification Needed:,
1. Nature of Tree:Many trees have co-dominant stems,what does that mean to the "potential
liability"? Please clarify whether there is history of limb failure for this tree,or for these species in an
urban setting,etc. To what extent do you think this"potential,future liability"is more a concern
than any other tree?If there are,please include other weaknesses in the tree to warrant removal.
RESPONSE: This Eucalyptus tree has a co-dominant stem that has bark inclusions. If the two stems emerge
at an acute angle, bark sometimes becomes included or embedded within the union instead of growing apart of
it. A naturally strong connection cannot be formed, resulting in weak attachment. Inclusion in unions are
among the most severe branch defect. Inclusions on this co-dominant stem is a "potential liability"because the
mechanical stress from the heavy load being supported by the weak union is likely to result in tree failure;
adjacent to the sidewalk and street.
Clarification Needed:
2. Replacement Tree: On the one hand,the proposed replacement tree would be consistent with the
existing palette of Hollywood Junipers and Italian Cypress;on the other hand, the location of the
replacement tree at the driveway entrance would warrant a different species as the junipers and
cypresses on-site are used as hedging.Please suggest additional species that would work well in the
landscape planter,and with the existing streetscape.
RESPONSE: Based on the tree species along the same side of the street,we recommend that the replacement
tree species be: One(1),Platanus acerifolia'Yarwood', of twenty four inch box size

3. Additional Permit:The application and arborist report indicate that the tree cut-out planter will be
removed and replaced.Please clarify the scope of work(maintenance and repair or creating a flush

site work on the commercially-zoned property will require filing for discretionary application(s),
dependent on scope of work.
RESPONSE: In the Arborist Report,I made an assumption that the damaged tree cut out would be removed
and replaced. This reporting of the removal and replacement should not have been included in this Arborist
Report and any info in regards to it should have been limited to the fact that it was damaged by the existing
Eucalyptus tree roots only. The Property Management will contact and contract the services of a professional
asphalt/concrete company, licensed to do business in the City of Cupertino,who will act accordingly in
obtaining any necessary Permits for tha't. We understand that this application only pertains to the removal
and replacement of the one existing Eucalyptus tree on this property. .
