This permit is approved with the following conditions: 1. APPROVED PROTECT Approval is based on the tree management plan (TMP) dated October 15, 2015 prepared by Brent Wahlberg (ISA Certified Arborist #WE-3276), including an arborist report written by Michael Bench (ISA Certified Arborist #WE-1987), consisting of thirty-seven (37) pages except as may be amended by conditions in this approval. 2. TREE REMOVALS All trees specified for removal in the Tree Management Plan (TMP) may be removed in the established timeframe of 2015-2016 without a separate tree removal permit. The applicant shall provide a notice to the city and post removal notices on said trees at least two weeks in advance of removal date. 3. TREE REPLACEMENTS Proposed tree replacement(s) shall take place within 30 days of removal(s). The applicant shall provide a Ietter to the city from a certified arborist confirming that the replacement trees have been planted in accordance with the TMP and are in good health standing. 4. TREE INVENTORY The applicant shall maintain an inventory documenting all of the tree removal(s) and replacement(s) and provide to the cify an update after the conclusion of each planned tree management year. 5. MODIFICATIONS TO APPROVED TREE MANAGEMENT PLAN Any additional tree removal(s) which are not included in this TMP and/or future modifications of the TMP will require separate review and approval from the Community Development Depariment, and may not be limited to additional discretionary applications, tree removal permits, and public notices. �� '�` 10880 Northpoint Way � TMP-2014-02 6. HERITAGE TREES No heritage tree removals are approved as part of this TMP. 7. INDEMNIFICATION Except as otherwise prohibited by law,the applicant shall indemnify and hold harmless the City,its City Council, and its officers,employees and agents (collectively, the"indemnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys'fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 8. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree management plan permit in accordance with Section 14.18.140 and Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this decision. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the tree(s) cannot be removed until a final decision on the appeal has been made. If no appeal is made within the appeal period, the tree(s) may be removed after November 18, 2015 according to the approved Tree Management Plan. I U800 Northpoint Way,Cupertino,CA 95015 �� manaQert�r�nort hpoi nth oa.com ,"� �_`� �' _ �� NORTHPOINT HOMEOWNERS ASSOCIATION TREE MANAGEMENT PLAN Proposal The Northpoint Home Owners Association has proposed a 3-year tree management plan to remove and replace 79 trees, 57 in 2015 and 22 in 2016.The complex started construction in 1972 and continuing until its completion in 1976.A large percentage of the existing trees were planted in that time frame making some of the trees more than 40 years old.These are mature trees,some in decline,some at this point are overcrowded,some have out grown the space in which their roots occupy and many are causing infrastructure damage. . In the past,trees have been removed and replaced with a tree species better suited to the location (plant the right tree in the right place).The trees removed were either dead,in decline,overcrowded, damaging utilities and hardscape, or considered to be hazardous.The criteria used to remove trees in the Tree Management Plan(TMP)will be the same. Replanting will be proposed using 24 inch box trees with an already established 1:1 ratio using tree species that are sustainable in the long term and better suited to the planting location.A replacement tree list is attached that includes mature tree height,tree form and average yearly growth rate. A current(2015)tree inventory has been completed.All trees have been tagged,mapped and identified on an EXCEL spread sheet.This EXCEL document will be used to track all future activities performed on all trees within the complex.This will include pruning, Plant Health Care, removing,and planting.As new trees are added they will have a new tree number and be added to the inventory. Noticing and Posting procedures will be followed according to Section 14.18.130 of the Protected Trees Ordinance.This will include notifying the City two(2)weeks in advance before trees approved under the TMP are removed.The HOA shall post notices on the trees scheduled for removal at least 2 weeks in advance priorto removal.An ISA-certified arborist shall confirm in writing that the required replacements have been planted properly and according to plan.The HOA shall provide this documentation to the City within 30 days of the tree removals.The HOA shall maintain a log of the tree removals and replacements and provide to the City to include in the TMP file. There will be occasions when trees not in the TMP will need to be removed.All procedures outlined in Chapter 14.18: Protected Trees(included as Addendum)will be followed.This includes a Tree Removal Permit Application and its requirements, noticing and posting procedures,and tree replacement. Observations I reviewed the trees at the site proposed for replacement and the locations of the proposed new plantings on May 28, 2014. The documentation was excellent. The trees proposed for replacement were clearly indicated on the maps provided and were easy to find at the site. The proposed locations of the planned new trees were marked by stakes at the site, shown on the maps provided, and were easy to locate in the field. Without exception,�the trees recommended to be removed for replacement were in poor condition and were certainly appropriate for replaceinent. The recommended locations of the replacement trees and the species suggested were appropriate for the existing site conditions. Brent Wahlberg has made appropriate recommendations, for which I do.not disagree with respect to the current site conditions. The plan proposes to remove a specific number of trees for each of 3 years and to replant these trees on a 1:1 replacement ratio during each of those years. The replacement trees should be expected to live 50-100 years, making the replacement trees the long range aspect of this plan. However, in my opinion there lies the problem. I estimate the trees selected for replacement may live only a few years. It appears that this plan, however, appropriate for the moment, presumes that the conditions will remain the essentially saine for the long term. I am referring to the fact that our water resources are becoming less and less available. There is a lot of discussion about the "worst drought in decades," and there is considerable discussion about conservation. I have read many media reports that seem to imply that once this drought is over, we will all go back to normal. However, this is not the report by water experts. Aside from this current drought, the experts report the simple fact is that demand is increasing at a fairly rapid and steady pace and the supply is being stretched. The indications are that water for landscapes will have to be drastically reduced in order to provide for the basic water needs of a growing population. Prepared by Michael L. Bench, Consulting Arborist June 27, 2014 1 Three Year Plan Review Northpoint HOA Homestead Road, Cupertino Focusing on the replacement species of this plan for this year, 2 replacement trees (Coast redwood) are High water consumers, 24 of the trees are Moderate water consumers, and 8 are low water consumers for 2014. Another way of stating this is: 5% = High Water Consumers 71% =Moderate Water Consumers 24% = Low Water Consumers We could debate the relative merits of each species on the list and possibly coine up with a little different percentages. By my estimate, 76% of the trees to be planted are moderate to high water consumers. In my opinion, this approach is short sighted and will not likely be able to be maintained over the long term. I suggest consideration be given to the following strategies. l. The replacement trees proposed by this plan are somewhat scattered over the property. This makes it very difficult and perhaps too costly to modify the conditions of all of these areas at one time. I suggest to concentrate on a defined areas, modifying the irrigation system within that area to low water usage and planting only low to very low water consuming plants for the majority of landscaped areas. This may involve a reduction in the quantity of plants and greater use of mulched surfaces. 2. This strategy does not suggest that all Moderate consumers of water have to be eliminated (for example, Japanese maples), but that they reduced to small defined areas with other plants of similar needs. 3. It is inefFicient to attempt to irrigate trees, shubs, ground cover, and turf on the same irrigation lines. I suggest to install separate valves to irrigate trees, separate values to irrigate shrubs and ground cover, and separate valves to irrigate turf. In general, I suggest that turf areas be reduced or eliminated unless they are highly used areas. Turf is one of the highest water consumers. An alternative would be to convert some turf areas to Carex cluinp grass areas, which only require irrigation about every two weeks. 4. Some areas are over planted with trees. I suggest that the number of trees be reduced in those areas as part of the plan. Replace some of those trees with large shrubs/small trees, possibly for screening or other purposes. 5. Several small planter beds in parking areas or small planter beds adjacent to side walks are too small to support trees. There are many trees performing poorly in those areas, because of the liinited root space. I suggest that trees not be replanted in those areas. It is possible that a justifiable argument could be made for some specific areas, that there is not sufficient space to replace all of the trees. 6. It appears that there may be some areas, in which Bio-Swale water retention systems could be installed to reduce the winter run off and to make better use of the storm water for the existing plants. Make a stated commitment to reduce the landscape water consumption by a defined number. I believe if you do not make such a commitment now that you will be required to do so in the near future. 8. I believe the failure to do so would result in a relatively short term plan, whereas a plan incorporating highly efficient water landscape management element with the majority of the plants being low to very low water consumers could be a plan for several generations.
