SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2015-52
This letter confirms the decision of the Director of Community Development, given on October 1 2015
approving a Tree Removal Permit to allow the removal and replacement of a dead 12" diameter
Goldenrain tree located in a Planned Development Zone, located at 10460 Bandley Drive.
Staff has made the finding that the protected tree is dead and cannot be controlled or remedied
through reasonable relocation or modification. The proposed replacement plan is consistent with
the Protected Tree Ordinance since the applicant is replacing the trees on site, and the number of
replacements is consistent with the ordinance. The finding is necessary to grant the tree removal
permit in accordance with section 14.18.180 (A) (1) and (3).
The application is approved with the following conditions:
1. APPROVED PROLECT
This approval is based on the arborist report prepared by Sam Oakley (#WE-9474A), dated August
10, 2015, consisting of three pages and a tree removal and replacement site plan, except as may be
amended by conditions in this resolution.
2. TREE REPLACEMENT
The required replacement tree include one 36" box Goldenrain tree. The applicant shall provide the
Department of Community Development adequate documentation, including but not limited to
photographs, receipts or invoices, to verify that the replacement trees have been planted within 30
days of replanting.
3. PROTECTED TREES
The applicant understands that replacement trees are protected trees and may not be removed
without a Tree Removal Permit and that they shall be responsible for ensuring the proper
maintenance and care of the trees. The applicant shall also disclose the location and species of all
replacements trees on site upon sale of the property.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.

To whom it may concern,
This letter intends to address one (1) Koelreuteria paniculata (Goldenrain Tree) located street-side on the
western perimeter area between the street and the sidewalk at 10460 Bandley Drive in Cupertino,California.
Please see Exhibit 1.1 for the relative location of the subject tree indicated as a red dot,and for the location of
the replacement tree.

The tree was determined to be dead (see Exhibit 1.2) due to its extensive loss of foliage, severely desiccated
foliage,and lack of any green growth. A test for live cambium tissue had negative results. Goldenrain Trees
are deciduous trees and should have a full crown throughout the summer months. The other nearby street trees
on the property are green and healthy with vigorous growth.
The tree likely succumbed to water-stress as a result of the region-wide drought. Important soil respiration has
likely been reduced due to the lack of water. Lack of water and nutrient uptake is exacerbated by the heat-
island effect caused by the reflected heat from the surrounding hardscape surfaces,scorching any stressed,live
tissue.
Removal of a dead tree does not require a tree removal permit prior to its removal pursuant to Section 14.18.140
Paragraph B of the City of Cupertino's Municipal Code;however,a subsequent application must be filed within
five(5)working days,included with this letter.
The tree will require replacement, selected to ensure optimal structure, health, and no girdling roots. The
proposed replacement is one(1)36-inch box Goldenrain Tree. The selected tree will then be trained from an
early age as needed to optimize branching structure,extending the aesthetically and structurally sound lifespan
of the tree.
