SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2015-37
This letter confirms the decision of the Director of Community Development, given on September 8
2015 approving a Tree Removal Permit to allow the reinoval and replacement of 5 protected,
development trees at an existing office complex, located at 10351 Bubb Road.
The trees are not specimen trees, and only served as the required development tree. Staff has made the
finding that the protected trees are a detriment to the subject property and carulot be adequately be
supported according to good urban forestry practices due to overplanting or overcrowding of trees on
the subject property. The proposed replacement plan is consistent with the Protected Tree Ordinance
since the applicant is replacing the trees on site, and the number of replacements is consistent with the
ordinance. The finding is necessary to grant the tree removal permit in accordance with section
14.18.180 (A) (3).
The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Samuel Oakley (#WE-9474A), dated May
21, 2015, consisting of two pages includulg a tree removal and replacement site plan, except as may
be amended by conditions in this resolution.
2. TREE REPLACEMENT
The required replacement trees include four 36" box standard Olea Europaea 'Swan Hill' olive and
two 36" box Lagerstroemia indica'Muskogee' trees . T'11e applicant shall provide the Department of
Community Development adequate documentation, including but not limited to photographs,
receipts or invoices, to verify that the replacement trees have been planted.
3. PROTECTED TREE
The applicant understands that replacement trees may not be removed �vithout a Tree Removal
Permit and that they shall be responsible for ensuring the proper maultenance and care of the tree.
The applicant shall also disclose the location and species of all replacements trees on site upon sale
of the property.
4. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute `vritten notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Please note that an appeal of this decision may be made within 14 calendar days from the date of
this letter. Do NOT REMOVE THE TREE(S) until the end of the appeal period. If an appeal is
filed, you will be notified of a public hearing, which will be scheduled before the Planning
Commission.

Re: Five (5) Tree Removals at 10351 Bubb Road, Cupertino, CA �
To whom it may concern
This letter intends to propose the reinoval of five(5) trees located on the 10351 Bubb Road property
in Cupertino,California. Two(2)of the proposed tree removals are located directly outside the front
entrance in the landscape area. The remaining three (3) proposed removals are adjacent to the
northern-side of the building in the planting area(see Fig. 1 of Exhibit 1).
Descriptions of the proposed removals on the 10351 Bubb Road property are as follows:
• Tree #l: Pyrus kawakamii (evergreen pear) is twelve (12) inches diameter and eig�(8) �s
inches in diameter at fifty-four(54)inches above grade. It is approximately twenty(20)feet
in height and twenty(20) feet wide(red arrow in Fig. 2�.�
• Tree#2: Pyrz�s kawakamii(evergreen pear) is twel�e(12)inches diameter at fifty-four(54)
inches above grade. It is approxiinately twenty(20) �'eet in height and twenty(20)feet wide
(yellow arrow in Fig. 2). -
• Tree#3: Tristaniopsis lazrrina(water gum)is s:�x(6)inches diameter at fifty-four(54)inches
above grade. It is approximately fifteen(15)feet in height and five(5)feet wide(blue arrow

• Tree #4: Tristaniopsis laurina (water gum) is sever�`(7) inches diameter at fifty-four (54)
inches above grade. It is approximately fifteen (15) feet in height and five (5) feet wide
(green arrow in Fig. 2). --�
• Tree #5: Tristaniopsis laurina (water gum) is fiv (5),�ches diameter at fifty-four (54)
inches above grade. It is approximately fifteen (15 feet in height and five (5) feet wide
(purple arrow in Fig. 2). ,

The trees listed above are recommended for the following reasons:
• The Brisbane box trees are water-needy and have been declining due to the prolonged
drought occurring in the region. The decline has been manifested as sub-average twig
elongation, thinning crown density, and crown dieback.
• The pears are distressed by a severe fire blight bacterial infection, a secondary infection due
to the prolonged drought. Fire blight is caused by the bacterium Erwinia amylovora. Fire
blight control consists of removing diseased wood and chemical applications, which are
expensive, leave a distorted form of the tree,expose tenants to toxic chemicals, and often do
not provide adequate control even with multiple applications.
• In light of the proposed conversion of the enclosure on the back of the property to an outdoor
patio, the tenant would like to take the opportunity to renovate unsightly, diseased, and
declining trees on the property. The removal and replacement of the subject trees with high-

quality specimens have been identified to make the most visual impact on the property in
conjunction with the proposed renovation of the enclosure.
The trees listed above are considered protected pursuant to Section 14.18.035 of the City of
Cupertino's Municipal Code and require a permit from the City's Planning Department prior to their
removal. To mitigate the removals, we propose to replace with six (6) 36-inch box trees as
replacement for the five (5) proposed removals pursuant to Section 14.18.185C of the City of
Cupertino's Municipal Code.
The proposed replacements are of the following species and quantity. Locations are shown in Fig.
1:
• Four(4) standard Olea europaea `Swan Hill' (Swan Hill olive); shown with green arrows
in Fig.l. Two (2) of each located on both sides of the front entrance.
• Two (2)Lagerstroemia indica `Muskogee' (Muskogee Hybrid crape myrtle); shown with
yellow arrows in Fig.l. Located at the front entrance in the same location as the proposed
pear removals.
The selected species will establish quickly due to their size and will perform well within the existing
landscape. The new trees will be selected by Apple arborist to ensure optimal structure, health, and
no girdling roots,and then trained from an early age as needed to optiinize branching structure which
will extend the aesthetically and structurally sound lifespan of the tree.
