Tantau Avenue. Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The decision is reported to the City Council and Planning Commission in fime to allow an appeal of the decision within fourteen calendar days. BACKGROUND � The City Council approved a 3.4 million square foot office, research and development campus in October 2013 for Apple Inc. The project site is located in the area bound by Homestead Road on the north, N. Tantau Avenue on the east, I-280 to the south, and N. Wolfe Road to the west. While the October 2013 approval permitted the construction of Phase 2 of the campus, the architectural details of this phase was approved on November 13, 2014 at an Administrative Hearing. DISCUSSION Since obtaining entitlements on Phase 2, Apple has been preparing plans to obtain building permits. Due to the size and complexity of the project, minor refinements/changes are being proposed to the parking structure and service yard on Site D (located between Calabazas Creek and I-280 on the east side of N. Tantau Avenue) and the office building on Site C (located between Calabazas Creek and I-280 on the west side of N. Tantau Avenue) Site D—East side of N. Tantau Avenue Parking Structure The parking structure is being modified as follows: Plan&Hei�ht Dimensions ■ Basement building footprint increased in East-West direction from 159'-10" to 160'-2"; DIR-2015-15 Apple Campus 2—Phase 2 Refinements August 4,2015 ■ Basement building footprint reduced in North-South direction from 179'-6" to 165'-8 '"; ■ Structure footprint increased in North-South direction from 254'-6" to 258'-10"; ■ Floor to floor height reduced between Levels 02 to 05 from 11'-6" to 10'-9"resulting in the reduction of the total height of the structure by three (3) feet from 57'-6" to 54'-6". Circulation ■ Direction of vehicular ramp reversed from north side to south side of the garage; ■ Stairs rotated 90-degrees and set back 8 feet from garage fa�ade; and ■ Hallway circulation reconfigured to run along the perimeter of the basement. Location Chan�es ■ Electrical, telecom rooms, mechanical shaft and elevator cores relocated; and ■ Restrooms/showers and bicycle storage from basement to Level 01 (under ramp in center bay of garage) relocated. Parkin ■ Total stall count increased from 620 to 649; and ■ Accessible stalls and EV stalls relocated. Exterior ■ Mesh fa�ade eliminated in compliance with conditions of approval of ASA-2014-08; ■ Final design details for light glare shield to cable rail system along north east corner of garage nearest neighbors prepared per Condition of Approval of ASA-2014-08; and ■ Photovoltaic layout altered to accommodate elevator core and shaft relocations. Satellite Plant and Service Yard The Satellite Plant and Service yard equipment layout has been modified as follows: ■ Chiller room reduced in size from 2,800 sq. ft. to 1,554 sq. ft. and relocated; ■ Cooling towers relocated from the roof level of a previously anticipated two level satellite plant to an at-grade location adjacent to the chiller room; and ■ Location of access gates and walkways etc. identified. At-grade Parkin� The at-grade parking has been modified as follows: ■ Total surface stall count has increased from 158 to 160. Site C— West side of N. Tantau Avenue The office building has been modified as follows: Location Changes ■ Fire Access and berming around the site has been modified to allow for safe access around the building while staying out of the 50-foot riparian buffer as much as possible 2 DIR-2015-15 Apple Campus 2—Phase 2 Refinements August 4,2015 Pa� ■ Total surface stall count has reduced from 75 to 55; and ■ Total basement parking staff count has reduced from 279 to 276. ■ Minor changes to a stairwell on the south-west corner of the building leading from the basement parking to the grade level. Environmental Review The California Environmental Quality Act(CEQA) requires that all State and local governments consider the consequences of projects over which they have discretionary authority. The . Environmental Impact Report (EIR) created as a result of review under CEQA must disclose the significant environmental impacts of the project and, in addition,identify the following: ■ Significant cumulative impacts of the project in combination with past, present and reasonably foreseeable future projects. ■ Mitigation measures and alternatives to reduce these effects; ■ Significant impacts that cannot be avoided; ■ Growth-inducing impacts; and ■ Effects found not to be significant. An EIR was prepared for the Apple Campus 2 project in accordance with the requirements of CEQA. The EIR reviewed the Phase 2 portion of the project based on the building envelopes proposed by Apple and was certified by the City Council on October 15, 2013. A subsequent addendum to the Final EIR analyzed the architectural refinements proposed for Phase 2 of the campus in a memo dated November 4, 2014 prepared by LSA Associates, Inc. The addendum found that the plans prepared for Phase 2 of the project did not require major revisions to the Final EIR. Staff has reviewed the plans proposed with this Minor Modification application against the plans previously approved and finds that the modifications being sought by the applicant are consistent with the plans previously approved. Minor refinements have been made to the square footage of accessory parking uses on the site (less than 1% increase in size) and the height of the structure is reduced by three (3) feet below the plans approved in November 2014. The overall site plan reduces the impervious area and the amount of excavation required to provide parking facilities below what was studied in the Final EIR. Most other changes are interior to the buildings and do not intensify the uses approved for the site/structures. The total amount of parking provided on site does not exceed the total number of stalls approved for the project. The overall proposed changes to the structures do not cause any conflict with setbacks previously established for the site or cause any adverse aestlietic impacts as previously analyzed in the Final EIR. Therefore, the proposed plans would not require major revisions to the Final EIR, due to new or substantially increased significant environmental effects. Furthermore, there have been no substantial changes with respect to the circumstances under which these minor modifications 3 DIR-2015-15 Apple Campus 2—Phase 2 Refinements August 4,2015 would be undertaken that would require major revisions of the Final EIR due to new or substantially increased significant environmental effects, and there has been no discovery of new information of substantial importance that would trigger or require major revisions to the Final EIR due to new or substantially increased significant environmental effects. The certified Final EIR adequately identifies all environmental effects and adequate mitigation measures for the proposed modifications to the previously approved project. Therefore, no subsequent or supplemental EIR is required prior to approval of the minor modifications to the Apple Campus 2 Project described above. ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modifications minor and approves the modifications with the following conditions: 1. APPROVED EXHIBITS This approval is based on the plan set prepared by Foster + Partners, Watry Design Inc., consisting of sixteen (16) sheets labeled P-8.00, P-8.03, P-8.10, P-8.20, G-1.1, A2.0, A2.1, A2.2, A2.5, A2.6, A3.1, A3.2, and A7.2, A11.0, A11.1 and A11.2 except as may be modified by the conditions enumerated below. 2. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans in addition to all previous conditions of approval. 3. BUILDING PERMIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 4. ACCURACY OF THE PROjECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Minor errors may be corrected if in compliance with the assumptions and supporting data for this approval, subject to the review and approval of the Director of Community Development. However, misrepresentation of property data that is considered major by the Direetor of Community Development may require additional review by the Planning Commission and/or City Council. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 5. CONCURRENT APPROVAL CONDITIONS The conditions of approval contained in file nos. ASA-2011-14, DP-2011-04, TR-2011-39, TM-2011-03, U-2011-11, DIR-2014-11, DIR-2014-29 shall be applicable to this approval except as amended. 4 DIR-2015-15 Apple Campus 2—Phase 2 Refinements August 4,2015 6. TREES No trees have been approved for removal with the approval of this permit. 7. PARKING STALLS The applicant shall ensure that no more than 1,140 parking stalls are provided for Sites C and D of Phase 2 of the campus project. 8. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 9. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant shall pay such attomeys' fees and costs within 30 days following receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 10. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval is effective August 4, 2015. The fourteen calendar day appeal period will expire . on August 18, 2015. If no appeal is made within the appeal period, building permits may be issued on August 19, 2015.
