Subject: Director's Minor Modification, DIR-2015-10, to allow the construction of a new patio area at
an existing office complex located at 10261 & 10341-10351 Bubb Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports their decision to the City Council and
Planiiing Commission in time to allow an appeal of the decision within fourteen
calendar days.
DISCUSSION
The applicant, Michael Donaldson, representing the property owner, Apple, Inc., is proposing minor
site modifications to an existing office building located at the above referenced address. The project
includes the following changes:
• New patio area Raised planters at the patio area
• Raised planters at patio area
• Patio furniture (chairs, tables, and umbrellas)
• Tree Removals (three protected trees)
The site improvements will require that the existing trash enclosure be removed. Apple and Recology
have an agreement to consolidate trash into a single location at 10300 Bubb Road.
As a condition of approval, upon the expiration or early termination of Apple Inc.'s lease at 10261 Bubb
Road or 10341-10351 Bubb Road, Apples is required to remove these improvements and construct of a
conforming trash enclosure.
The project requires the removal of three Canary Island Pines, which are considered development trees
that are protected under Cupertino Municipal Code Section 14.18.050 Protected Trees. The removals
will be replaced by three (3) thirty-six (36) inch box trees; two (2) Swan Hill Olives and one (1) Coral
Bark Japanese Maple. A concurrent condition of approval been added, so that the conditions of
approval contained in file numbers TR-2015-10 and TR-2015-11 are applicable to this approval.

ACTION
The Director of Community Development deems the modification minor and approves the project with
the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits entitled: "Apple, Bubb 8/10 Patio" prepared by Kier & Wright, dated
April 2015, consisting of three sheets labeled C-001, C-002, and C-003; except as may be amended
by the conditions contained in this resolution.
2. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of
the building plans.
3. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building permits
for the proposed project.
4. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file nos. TR-2015-10 and TR-2015-11 shall be applicable to
this approval.
5. MODIFICATIONS TO THE PATIO AREA
Any modifications to the patio area shall be reviewed and approved by the Department of
Community Development.
6. PATIO FURNITURE
Prior to permit issuance, the final patio furniture shall be reviewed by the Department of
community development prior to installation.
7. TRASH ENCLOSURE
Upon the expiration or termination of lease at 10261 Bubb Road or 10341-10351 Bubb Road, the
applicant shall construct a compliant trash enclosure.
8. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
9. ACCURACY OF PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.

10. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
11. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
This approval of the modification is effective June 17, 2015. The fourteen calendar day appeal period
will expire on July 1, 2015.
