SUBJECT: TREE REMOVAL PERMIT ACTION LETTER-Application TR-2015-18
This letter confirms the decision of the Director of Community Development, given on June 16, 2015,
approving a Tree Removal Permit to allow the removal and replacement of 5 trees in conjunction with
site modifications at an existing office building, located at 10725 S De Anza Boulevard.
Staff received comment from the adjacent property owner in opposition to the project; the property
owner's comment is noted.
Staff has made the finding that the removal of four (4) Red Ironbark and one (1) Sweetgum restricts the
economic enjoyment of the property by limiting the use of the property in a manner not typically
experienced by owners of similarly zoned and situated property, and the applicant has demonstrated
to that there are no reasonable alternatives to preserve the trees. The current location of the trees is in
the way of proposed development and grading. The finding is necessary to grant the tree removal
permit in accordance with Section 14.18.180 (A) (3).
The application is approved with the following conditions:
1. APPROVED PROJECT
This approval is based on the arborist report prepared by Sam Oakley (#WE-9474A), dated March
27, 2015, consisting of nine pages; including a removal site plan, a replacement site plan and
photographs, except as may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant is required to replant five (5) thirty-six inch box trees (four silver linden and one
arbutus) in accordance with the Protected Tree Ordinance. Modifications to the tree species and
location may be made to the approved replacement plan pending staff approval.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exaction, pursuant to Government Code Section 66020(a), has begun. If you fail to file a
protest within this 90-day period complying with all of the requirements of Section 66020, you will
be legally barred from later challenging such exactions.
Please note that an appeal of this decision may be made within 14 calendar days from the date of
this letter. Do NOT REMOVE THE TREE until the end of the appeal period. If an appeal is
filed, you will be notified of a public hearing, which will be scheduled before the Planning
Commission.

To whum it may concern,
This letter intends to address five(5)trees growing in the southern perimeter planting strip on the De Anza 8
property at 10725 De Anza Boulevard in Cupertino,California. Please see Exhibit l.l for the relative location
of the subject trees i�idicated with yellow shading. The assessment is in conjunction with proposed capital
improvements to the property, an ADA-compliant ps�thway that is to be installed through the locations of the
subject trees. This report has been drafted in preparation for proposed capital improvements in that the trees
will require removal prio►-to the installation of the improvements. The assessment oP the subject trees was
performed on March 4,2014.
Metrics for the proposed removals are found in the following tabte:

The trees were determined to be in the proposed area for the ADA pathway(see E�ci►ibits 1.3- 1.8 for images
of the subject trees). Each of the Protected Trees has been assigned a condition percentage from 0%to 100%
(0%to 20%_"very poor;'21%to 40°/a°"poor;"41%to 60°/a="moderate;'61%to 80%-_"good;" 81%to
100%-"excellent"). Condition rating percentages are used to identify the overall valiie of an existing tree on-
site and it's suitability for preservation. The subject trees are in poor to moderate condition(see below).
Moderate: Higher (evel and/or incidence of deficiencies noted in health and/or structure, including possible
hazardous conditions signs and symptoms observed, with higher corrective measures and input required to
improve condition and where applicable,mitigate hazard. Three(3)individuals were identified as in moderate
condition and require removal:
Tree #1: this tree has several massive, overarching laterals that hang over the parking area. The
codominant branching poini is considered weakly attached in this species.
Tree#3:this tree also has several massive,uverarching laterals that hang over the parking area. The
codominant branching point is eonsidered weakly attached in this species.
Tree#5:this individuai is young and vigorous but has codominant growth at the trunk base. Although
the tree rating is towards the top of the moderate condition-range, it is in the proposed ADA path of
travel and will require removal.

Poor: Significant deficiencies noted in health and/or structure,some irreversible,and may include hazardous
condition signs and symptoms observed requiring corrective action. Two(2)individuals were identified as in
poor condition and require removal:
Tree#2: this specimen has multiple converging branches at a weakly attached point. The individual
also exhibits an unbalanced crown of the parking area,a bowed trunk,and stunted growth.
Tree#4:this leaning individual has converging branches at a weakly attached point.
We recognize that the trees are considered Protected Tree and require a tree removal permit prior to their
removal pursuant to Section 14.18.035 Paragraph C of the City of Cupertino's Municipal Code. We
respectfully ask for your permission to remove the trees to install the proposed improvements.
The trees will require replacement, selected to ensure optimal structure, health, and no girdling roots. The
selected trees should be trained from an early age as needed to optimize branching structure, extending the
aesthetically and structurally sound lifespan of the tree. Five(5)36-inch box trees are required as replacement
for the five(5)proposed removals pursuant to Section 14.18.185C of the City of Cupertino's Municipal Code.
