SUBJECT: SIGN PROGRAM ACTION LETTER—Application SP-2015-03:
This letter confirms the decision of the Director of Community Development, given on August 12, 2015,
approving a sign program for an existing commercial shopping center located at 10211-10235 S. De
Anza Boulevard (APN: 359-10-060). This approval supersedes the sign program elements of DIR-2006-
28 and ASAC 51,674.11 and is subject to the following findings and conditions of approval.
FINDINGS
Prior to approval, the Community Development Director must make the following findings as
outlined in Section 19.104.130 (C) of the City of Cupertino Municipal Code. Staff analysis is shown
in italics below the required findings.
A. The Sign Program complies with the purpose of this chapter.
The proposed sign program complies with the purpose of the sign ordinance by establishing
a comprehensive set of design standards serving to identify and enhance tenant signs in an
existing retail center.
B. Proposed signs are creative, and are in harmony with the structures the�identify, other signage on
the site, and the surrounding development.
The proposed sign program establishes a set of design standards that allows for unique and
creative tenant signage that is harmonious with the site and surrounding development.
C. The Sign Program contains p�•ovisions to accommodate future revisions that may be required because
of changes in use or tenants.
The proposed sign program accommodates future use and tenant changes by allowing
tenants to choose their own sign font, to manipulate sign color, and to design sign layout,
with landlord and City approval. The sign program also states that the monument sign will
accommodate sign changes as assigned by landlord.
Additionally, this Sign Program includes a 12'-5" tall monument sign located near the eastern
property line along S De Anza Blvd. Per Section 19.104.130(D) of the Zoning Ordinance, minor

modifications to the requirements within the chapter may be permitted, provided that the
proposed Sign Program meets the following criteria in addition to Section 19.104.130(C)
Findings listed above.
1. Special circumstances, unique to the site and building locations, exist that require a modification
from the standards in this chapter.
The existing monument sign was previously approved at its current scale and staff can
support this modification to the requirements of the chapter since the site grading limits
ground locations and the sign height is proportionate and harmonious with the structures
on-site and consistent with the surrounding monument signs for shopping centers along S
De Anza Blvd.
2. Demonstrates unique design and exhibits a high degree of imagination, inventiveness, spirit, and
thoughtfulness.
The standards established for the monument sign allow selected tenants the flexibility to
incorporate creative and innovative signage while regulating and standardizing panel
material and lighting to achieve a quality benchmark.
3. Provides high quality graphic character through the imaginative use of color, graphics, proportion,
quality materials, scale, and texture.
The tenant panels are designed with white backgrounds that are internally illuminated in
order to maintain color consistency among panels, and to continue the rectilinear form
proportionate and scaled to the structure. Additionally the tenant signs will provide relief
by incorporating sign detailing and texture to the monument sign with push-through
lettering. Furthermore the monument sign will be painted to match the primary colors of the
building.
CONDITIONS OF APPROVAL
1. APPROVED PROJECT
Approval is based on the Master Sign Program received on July 27, 2015 and revised sheets
received on August 3 and August 5, consisting of eight (8) pages prepared by Vardy Shtein, titled
"Shtein Properties Master Sign Program S De Anza Blvd," except as may be amended by conditions
in this resolution.
Refer to the City of Cupertino Sign Ordinance for provisions not specified in this sign program.
Unless specifically approved in the sign program, the regulations in the Sign Ordinance shall apply.
2. PREVIOUSLY APPROVED SIGN PROGRAM
This sign program (SP-2015-03) shall supersede all prior sign program approvals for the project site.
3. FUTURE MODIFICATIONS TO THE SIGN PROGRAM
Any proposals for new permanent sign locations not shown on the sign program or modifications
to existing sign program standards shall require City review through a sign program modification
SP-2015-03 Action Letter 10211-10235 S.De Anza Boulevard August 12,2015
and additional discretionary permit if determined necessary by the Director of Community
Development.
4. MONUMENT SIGN
The property owner or designee shall demonstrate compliance with this Sign Program's standards
by painting the monument sign to match the building's colors and installing the site address on the
monument sign as indicated on Sheet 8 of the sign program. The painting and installation of the
address on the monument sign shall occur within 180 days from the approval date of this sign
program.
5. BUILDING PERMIT REQUIRED
New signage shall obtain the property owner's approval prior to submittal of a building permit.
New signs are required to obtain a building permit with approval by the Planning Department
prior to installation,unless a permit is not required as determined by the Building Department.
6. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and require additional review.
7. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible for consulting with other departments and/or agencies with regard to
the proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
8. INDEMNIFICATION
Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its
City Council, and its officers, employees and agents (collectively, the "indemnified parties") from
and against any claim, action, or proceeding brought by a third party against one or more of the
indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside,
or void this Resolution or any permit or approval authorized hereby for the project, including
(without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of
the litigation. The applicant shall pay such attorneys' fees and costs within 30 days following
receipt of invoices from City. Such attorneys' fees and costs shall include amounts paid to counsel
not otherwise employed as City staff and shall include City Attomey time and overhead costs and
other City staff overhead costs and any costs directly related to the litigation reasonably incurred by
City.
9. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,

reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
Staff has made all of the findings that are required for approval of a Sign Program as required by the
City of Cupertino Municipal Code, Section 19.104.130(C) and 19.104.130(D). Please be aware that if this
permit is not used within one year, it shall expire on August 6, 2015.
Please note that an appeal of this decision can be made within 14 calendar days from the date of this
letter. If this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.

GENERAL SPECIFICATIONS
1. On the building no animated signs, paper signs, rotating signs, moving light signs or signs painted directly on the
building wail.
2. The computation of the sign area should be in accordance with the City of Cupertino Sign Ordinance 19.104.
3. Tenants shail submit their sign design to the landlord for approval prior to submitting to the Planning
Department. The design submittal shall be in the form of professionally drawn, accurately scaled drawing,
indicating length, height and color of all elements of sign,
4. Tenants shall obtain Planning and Building Department approval of sign permit(s).
5. All signs shall be attached to the building fascia (except free standing building 10211) and centered or as
otherwise directed by the landlord.
6. All penetrations to the building structure required for sign installation shall be neatly sea(ed in watertight
condition.
7. Tenants shall employ the services of a qualified licensed contractor and repair any damage caused by his/her
work. _
S. The entire cost of signs including design, permit acquisition, fabrication and installation shall be the tenant's sole
expense. When tenant vacates space,tenant sign(s) must be removed and all penetrations to the building must
be patched and painted at tenant's sole expense.
TENANT SIGN REQUIREMENTS.
1. Tenant shall be allowed one attached building sign per store frontage subject to landlord and city approval.
2. All attached tenant building signs shall be internally illuminated channel letter block or script.
3. Letter height shall not exceed 30".
4. Logos shall be allowed 3' height&9 square feet maximum area and well integrated into the sign design.
5. Sign colors and layout shall be tenant's choice with landlord and city approval.
6. Maximum sign area is limited to 1 sq. feet perlinear feet of store frontage on which sign is located.
MONUMENT SIGN
1. Center will have one 79.2sq.foot, double face and freestanding, internally illuminated, multi-tenant monument
sign to accommodate 4 tenants.
2. Tenants who are allowed on to monument sign shall be assigned by the landlord.
3. Tenant panels will maintain visual and color consistency(i.e. panel background,depth of push-through lettering).
4. Tenant panels shall utilize push-through lettering with visually consistent materials (i.e. polycarbonate,vinyl,
etc.).
