SUBJECT: SIGN PROGRAM ACTION LETTER—Application SP-2014-02:
This letter confirms the decision of the Director of Community Development, given on May 15, 2014,
approving a sign program for the Saich Way Station shopping center located at 20803 Stevens Creek
Boulevard (APN 326-32-042) and 10033-10095 Saich Way (APN 326-32-041). This approval is based on,
and subject to, the following findings and conditions of approval.
FINDINGS
Prior to approval, the Community Development Director must make the following findings as outlined
in Section 19.104.130 of the City of Cupertino Municipal Code. Staff analysis is shown below the
required findings in italics.
A. The Sign Program complies with the purpose of t1Tis chapter.
The proposed sign program complies with the purpose of the sign ordinance by establishing a
comprehensive plan serving to identify and enhance tenants in the shopping center. The proposed
plan maintains the aesthetic appearance of the City by establishing a high quality and consistent set
of sign standards for all tenants on the subject site that includes direction as to the number,
placement, size, color, and material of future signs.
B. Proposed signs are creative, and are in harmony with tlie structures they identify, other signage on the site,
and the surrounding development.
The proposed signs allow for unique and creative tenant logos, and are in harmony with the
structures they identify in that they are appropriate in scale and are to provide equidistant spacing
on the surfaces they are affixed, and incorporate colors and tones approved for the site.
C. The Sign Program contains provisions to accommodate future revisions that may be required because of
changes in use or tenants.

CONDITIONS OF APPROVAL
1. APPROVED PROTECT
Approval is based on the master sign program received on May 14, 2014 consisting of 19 pages
prepared by Arrow Sign Company entitled, "Saich Way Station Master Sign Program;" except as
may be amended by conditions in this resolution.
Refer to the current City of Cupertino Sign Ordinance for provisions not specified in this sign
program. Where there is a conflict between the sign program and the Sign Ordinance, unless
specifically approved in the sign program, the regulations in the Sign Ordinance shall apply.
2. SUPERSEDENCE OF PREVIOUSLY APPROVED SIGN PROGRAM
The sign program approved under file no. SP-2014-02 shall supersede all prior sign program
approvals for the shopping center.
3. FINAL GROUND SIGN DETAILS
The final exterior treatment plans for the ground sign on Stevens Creek Boulevard identified in the
sign program as Exhibit A shall be reviewed and approved by the Director of Community
Development prior to issuance of building permits. The Director of Community Development may
approve additional designs or make minor variations as deemed appropriate. The final building
exterior plan shall closely resemble the details shown on the approved sign program plans. Any
exterior changes determined to be substantial by the Director of Community Development shall
require a modification approval.
4. FUTURE MODIFICATIONS TO THE SIGN PROGRAM
Any proposals for new permanent sign locations not shown on the sign program, illumination of
existing non-illuminated signs, or modifications to existing sign program standards shall require
City review through a sign program modification and an additional discretionary permit if
determined necessary by the Director of Community Development.
5. BUILDING PERMIT REQUIRED
This Sign Program approval does not constitute building permit approval. A building permit is
required for each separate sign indicated on the sign program unless the City of Cupertino Building
Division determines that it is not necessary to obtain one.
6. MINOR CHANGES TO SIGN LOCATIONS SHOWN ON SIGN PROGRAM
If necessary, the Director of Community Development may review and approve minor changes to
signage locations shown on the approved sign program's site and elevation plans upon building
permit review.

7. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and require additional review.
8. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
9. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
10. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
Staff has made all of the findings that are required for approval of a Sign Program as required by the
City of Cupertino Municipal Code, Section 19.104.130(C). Please be aware that if this permit is not used
within one year, it shall expire on May 15, 2015.
Please note that an appeal of this decision can be made within 14 calendar days from the date of this
letter. If this happens, you will be notified of a public hearing, which will be scheduled before the
Planning Commission.

SIGNAGE DESIGN GUIDELINES
1.0 Purpose
The guidelines established for the Saich Way Station tenants will provide a coordinated sign system to communicate
information in a distinctive and aesthetically pleasing manner. The visual consistency that this criterion creates will
minimize confusion and confirm an image of quality, uniting all the individual establishments within The Center.
The main ID and tenant monument sign will provide customers with easily identifiable branding and the services offered
within the Center.
It shall be the responsibility of each tenant to submit design drawings of the proposed signage first to the Landlord for its
written and/or starnped approval and subsequently to the City of Cupertino for approval prior to the installation of any
signage. The use of professional designers and/or sign companies to prepare these drawings will be required. The
guidelines and requirements for the submittal process are located in section 4.0"Submittals and Review".
Design Criteria:
a. All signs shall be of a high material and design quality.The signs shall be durable, and resistant to weather and wear.
b.All signs shall architecturally compatible and in harmony with the building with which it is principally associated, by
incorporating its colors, materials, shape and design.
c. Internally illuminated signs shall not have a directly visible light source.
d.The sign's color and illumination shall not produce distraction to motorists or nearby residents.
e. Background colors shall be opaque/dense/matte to minimize glare.
f. Letters shall project from the face of ground signs.
g. Sign copy shall be simple and concise,without excessive description of services or products.
h.Wall signs shall be consistently mounted with consistent illumination and projection.

SIGNAGE DESIGN GUIDELINES
2.0 Design Specification/All Tenants
All signs shall be reviewed for conformance with these guidelines and overall design quality. Approval or disapproval of
sign submittals shall remain the right of the Land Lord and the City of Cupertino.
The allowable square footage of individually applied letters for primary tenant identification is defined as when the sign is
composed of letters applied to the building without a distinctive background,the area of a sign may be measured by the
height of the letters times the length of each line of letters and may be computed at seventy percent 70%otherwise,the
area of the sign may be measured to the outside perimeter of the sign, including the area of any voids within a simple
bounding perimeter. Sign content shall be limited to the Tenant's name and primary graphic logo unless specifically
provided for herein.

2.1 General Construction Specifications
Signs must be constructed and installed to meet or exceed all applicable codes and City requirements. All building signs
shall be manufactured, installed and maintained at the Tenant's expense.
All exterior signs shall be secured by concealed fasteners; bolts, fasteners, clips, and conduits shall be generally hidden
from public view. If exposed, all sign parts shall be painted to match the exterior color of the surfaces on which they are
mounted.
All building fascia signs shall be attached and mounted directly to the wall or mounting surface.All penetrations of the
building structure required for sign installation shall be neatly sealed and watertight. Color and finish of attachments and
sealant shall match adjacent exterior finishes. External wireways are prohibited.
Surfaces of all signage are intended to be flat without bulges, oil canning or other imperfections.
All signage on the building fascia shall be of individual halo lit channel letters illuminated with LED's. No cabinet signs will
be permitted. Signage illumination shall not include flashing, moving or scintillating effects. All signs must be dimensional.
Signs painted directly onto the building will not be permitted.
Notwithstanding the following sign provisions,Tenants may utilize standard corporate logos and/or prototypical signage
graphics, subject to approval of the Landlord and local governing entity. Logos are limited to 9 square feet.
In no case may a sign extend beyond the roof parapet or adjacent building eave line. Signs are not allowed on or against
any roof structure. Signage on umbrellas and awings are prohibited.

SIGNAGE DESIGN GUIDELINES
2.2 Electrical and Illumination
Fabrication and installation shall comply with all Underwriters Laboratories requirements and applicable state and local
codes. All components shall bear the U.L. label indicating approval, and be manufactured and installed by a U.L. certified
company.
All wiring, conductors,transformers, ballasts and other equipment shall be concealed from public view. Primary electrical
service to all Tenant signs shall be tied to Tenant's electrical service. Tenant shall provide time clocks for use in conjunction
with the electrical service and be responsible for all associated costs. (Or connected to the energy management system if
applicablej.
a.The intensity of illumination for signs shall not exceed approxirnately 250 foot-lamberts.
b.The color and thickness of the sign panels as well as the brightness of the bulbs used to illuminate the sign shall be
designed in such a manner as to avoid excessive illumination and glare.
c. Illuminated signs which are not a necessary part of the security lighting systems for a business shall be turned off at
11:00 pm or within two hours after the business is closed,whichever is the later time.
d. All exterior lighting shall be placed in manner so that the light source will not be seen from off the site.
2.3 Installation and Removals
All penetrations of any building structure required for sign installations shall be neatly sealed and continuously maintained
in watertight condition.
The Tenant's sign contractor used for installation, removal or service calls shall be completely licensed by the state of
California, carry workman's compensation and public liability insurance, per the lease against all damage suffered or done
to any and all persons and/or property while engaged in the construction or erection of signs. Furthermore they must
provide Landlord with certificates of insurance prior to the commencement of any work
All methods of attachment to any structure must be detailed on shop drawings and be approved by the Landlord.
Sign removals shall include the patching and repairing of the entire work area, plus the repainting (break to break) of any
"ghostetl"areas as directed by the Landlord.
Tenant's sign contractor shall repair any damage caused by his work.Tenant's sign contractor mustfollow the rules and
regulations for T.I. contractors provided in each Tenant lease. Damage to any structure that is not repaired by the
contractor shall become the Tenant's responsibility to correct.

SITE ID SIGNAGE:
3.0 ID Monument/Tenant Signage
There will be one (1) main center ID/tenant sign for this project. It will be located on the corner of Stevens Creek and
Saich Way. It will serve as the primary identification for traffic traveling east and west on Stevens Creek.The sign will be
6 feet tall.The sign will be double faced.The tenants faces will be routed aluminum with flat cut out letters �logo. Center
ID will be routed w/1/2" push thru copy. Cabinet£t base to be aluminum. See Exhibit A

3.1 Anchor Tenant- Defined as 2809 to 3500 sq.ft.
Anchor Tenants are allowed one (1) sign per every exterior store elevation with a maximum of three (3)signs. Anchor
Tenants will be allowed 1.5 square foot of signage area per lineal foot of frontage, not to exceed 70%of building frontage
(horizontally)where signage is installed. See Exhibit B
The type of fabricated letters allowed shall be Halo-lit letters constructed with a minimum of 3"and maximum 5"aluminum
returns. Anchor Tenants are required to have LED internally illuminated or halo illuminated letters only.
All secondary tenant signage (i.e. open 24 hours or any additional services� is subject to landlord and city approval.
Anchor tenants will be allowed identification signage on the monument sign in addition to signage specified above.
3.2 In-line Tenant- 10057, 10073, and 10079 Saich Way
In-line shop tenants are allowed one (1) sign per every store frontage with a maxirnum of two (2) signs. They are allowed
to occupy 70%of the storefront(horizontally) and are allowed 1.5 square foot of signage per linear foot of shop frontage.

In-line tenants illumination source required to have LED halo illuminated letters or external gooseneck illumination only.
3.3 End-Cap Tenant- 10095 Saich Way
The End-Cap Tenant is allowed one(1) sign per every store frontage with a rnaxirnum of three (3) signs.They are allowed
to occupy 70%of the storefront(horizontally�.The End-Cap Tenant shall be allowed 1.5 square foot of signage area per
lineal foot of frontage. See Exhibit B �r B1
End-Cap tenants illumination source may have LED illuminated (halo or face lit) letters or external gooseneck illumination
only.
3.4 Permanent Window Graphics
Permanent Window Graphics are those signs affixed to a storefront window.A standard font format shall be used for the
Permanent Window Graphics that indicates hours of operation, suite or street address, open/closed and relevant
information. Signage is applied to the surface of door or window glass using vinyl graphics in first surface 3M high
performance white vinyl.
All tenants shall affix suite or street address on at least one business storefront window.
Maximum cap height for permanent identification letters shall be 2"with the exception for open/closed sign and
suite/address identification which shall not exceed a 6" cap height.
The aggregate square footage of all window signs shall not exceed twenty five (25} percent of the surface area of the
window on which it is placed.
Window signs shall not be illuminated. All window signs shall be approved in writing by the Landlord. See Exhibit C
Note: City sign ordinance allows a 4 sq.ft. maximurn neon"open"sign. Perimeter neon window signage is not allowed.

3.5 Blade Sigs
Tenants are allowed one (1) blade sign per storefront and may attach the sign off the storefront.
Blade signs are required to be a minimum of 7'-6"above finish floor. Maximum blade sign size is 6 square feet.
Blade signs will be non-illuminated with dimensional or vinyl copy on a finished/painted background.Tenants may use
their standard logos and colors. See Exhibit E
3.6 Building Address
Both address number 20803 £t 10033-10095 will be 12"tall with 2"stroke.Address numbers are halo-lit. See Exhibit D
3.7 General Notes
a. Future Revisions: Please provide provisions to accommodate future revisions that may be required because of change
in use or tenants. Note that any proposals for new permanent sign locations not shown on the program or modifications
to existing sign program standards shall require City review through a sign program modification and, at the discretion
of the Director of Community Development, an additional discretionary permit if necessary.
b. Changes of Face: Please note that, "Requests for changes of face to signs shown on the sign program, including, but
limitetl to, letter style, letter size, color, background, or message shall be consistent with the approval sign program.
c.Temporary Signs: Please note that all temporary signs shall receive temporary sign permits with the City of Cupertino
Planning Division, 408-777-3308.
d. Restriction on Additional Signs: Please note that no additional permanent signs or variations from this sign program
or Cupertino Sign Ordinance will be allowed unless a future sign program modification is approved.
e. Sign Ordinance Reference: Please refer to Chapter 19.104 (Signs) of the City of Cupertino Municipal Code for other
provisions not specified in this sign program.Where there is a conflict between this document and Chapter 19.104,
unless specifically appoved in this Sign Program, the regulations in Chapter 19.104 shall apply.

4.0 Submittals and Review
No signs shall be fabricated or installed unless the following approvals have been obtained.
4.1 Landlord/City Approval
Submit three (3)sets of plans,to scale, showing the sign elevation.This drawing must have all materials and colors
specified. At least one drawing of the sign must be in color. Also provide material and color samples if requested by the
landlord.The plans must also include the building elevation and the location�s) of the signs on the building, and a site plan
indicating the location of the store in the shopping center.
Once these plans are stamped and approved, one set shall be retained by the landlord, one (1) set shall be the tenant's
copy, and four(4) sets shall be submitted to the City of Cupertino. If the plans submitted to the landlortl are not acceptable
or require revisions, they must be resubmitted unless they are approved "with conditions".
4.2 Prohibited Signs/Banner
No Flashing, moving or scintillating light bulbs or effects are permitted.
Window signs, other than the Permanent Window Graphics,will not be allowed.These signs inclutle neon signs,fiber
optic/neon simulated plastic signs and border neon. Neon signs are allowed only if the are"open"signs and no greater
than 4 square feet.
The Landlord reserves the right to determine the acceptability of signs. Noncompliant signs are to be removed immediately
upon request.
Promotional and temporary signs will not be permitted without written landlord approval and must be in accordance with
City of Cupertino ordinances.

TENANT SIGNAGE NOTES:
4.3 Tenant Responsibilities
Tenants shall be responsible for the fulfillment of all requirements of this Signage Guidelines and all applicable codes and
ordinances. Each Tenant is responsible for the cost of design,fabrication, installation, maintenance and electricity for their
own sign�s).Tenants shall be responsible for the immediate repair of neon,which is damaged or not illuminating properly
and the proper maintenance of all tenant signs. All permits required by the City of Cupertino and associated fees, shall be
obtained and paid for by the tenant or tenant's representative.Tenants shall be required to perform or cause to have
performed such necessary action to correct or repair signage within 10 days of written notice from Landlord.
All sign contractors employed or retained by tenant must carry Workmen's Compensation in the amount of$1,000,000 and
Public Liability insurance per the lease, providing coverage against damage suffered or done to any and all persons and/or
property while engaged in the construction or erection of signs, in an amount deemed appropriate by lesser. Tenants shall
indemnify and hold harmless the City of Cupertino and the Landlord from any damages that arise from the installation,
maintenance or use of Tenant's signage.
Upon the termination or conclusion of Tenant's lease,the tenant is responsible at their sole cost for the removal of all
signs. All signs must be removed and their electrical connections capped within 30 days of the lease's termination. The
storefront fascia shall be patched,touch-up painted to match the surrounding fascia areas and otherwise repaired as
detailed in previous section of these guidelines.

The formal application will not be accepted unless all the above are provided. Planning Division may
ask for additional information or revisions once you respond to these comments.
General Comments:
1. Application and Fees: This project will need a Sign Program application, which is approvable at
staff level without a public hearing or noticing. Please refer to the application form
(www.cu�ertino.or�/�lanforms) for the formal submittal requirements. The estimated planning fees
for this project are:
• Sign Program-$700
� Categorical Exemption from CEQA-$243
• County filing fee-$50
• Total-$993
2. Ground Sign on Stevens Creek Blvd: After further review, a ground sign in the currently proposed
location on Stevens Creek will be acceptable provided the following criteria are met:
a. The total sign height is reduced to a maximum of 6 feet high from the sidewalk grade to the
tallest point of the sign.
b. The proportions shall generally remain the same as currently proposed.
c. Sign materials shall be high quality.

3. Sign Program Matrix: In order to streamline the approval process for future sign permits, we
recommend that a matrix be included in the sign program,which lists the allowable signage for each
tenant.Please see the enclosed example.
4. Blade Signs:
Consider making allowances for pedestrian-oriented blade signs,which are mounted
perpendicularly from the wall face. Typically, the bottom of blade signs should have an 8 foot
clearance from the walkway surface and should not exceed 6 square feet.
5. General Notes:
Please ensure the following is addressed in the sign program:
a. Additional Sign Area allowed:Information only-this site is located in the Heart of the City Specific
Plan area, and wall signs are allowed to be 1.5 square feet for every 1 linear foot.
b. City approval:Where landlord approvals are required,City approval should also be required.
c. Sign Return Depth:The City typically sees 5" returns for wall signs. Please clarify why the
proposed returns are less.
d. Future Revisions:Please provide provisions to accommodate future revisions that may be required
because of change in use or tenants. Note that any proposals for new permanent sign locations
not shown on the sign program or modifications to existing sign program standards shall require
City review through a sign program modification and, at the discretion of the Director of
Community Development, an additional discretionary permit if necessary.
e. Changes of Face:Please note that, "Requests for changes of face to signs shown on the sign
program,including,but limited to,letter style,letter size, color,background, or message shall be
consistent with the approved sign program."
f. Temporary Signs:Please note that all temporary signs shall receive temporary sign permits with
the City of Cupertino Planning Division,408-777-3308.
g. Restriction on Additional Signs:Please note that no additional permanent signs or variations from
this sign program or Cupertino Sign Ordinance will be allowed unless a future sign program
modification is approved.
h. Sign Ordinance Reference:Please refer to Chapter 19.104 (Signs) of the City of Cupertino Municipal
Code for other provisions not specified in this sign program. Where there is a conflict between
this document and Chapter 19.104, unless specifically approved in this Sign Program, the
regulations in Chapter 19.104 shall apply."
6. Design Criteria:
Please include the following design criteria:
a. All signs shall be of a high material and design quality. The signs shall be durable, and resistant
to weather and wear.
b. All signs shall be architecturally compatible and in harmony with the building with which it is
principally associated,by incorporating its colors, materials, shape and design.

c. Internally illuminated signs shall not have a directly visible light source. �
d. The sign's color and illumination shall not produce distraction to motorists or nearby residents.
e. Background colors shall be opaque/dense/matte to minimize glare.
f. Letters shall project from the face of ground signs.
g. Sign copy shall be simple and concise,without excessive description of services or products.
h. Wall signs shall be consistently mounted with consistent illumination and projection.

c. Illuminated signs which are not a necessary part of the security lighting system for a business
shall be turned off at 11:00 pm or within two hours after the business is closed, whichever is the
