SUBJECT: SIGN PROGRAM ACTION LETTER- Application S-2012-01:
This letter confirms the decision of the Director of Community Development, given on April 11,
2012, approving a new sign program, which replaces an existing sign program, for the property
located at 7335-7337 Bollinger Rd, with the following conditions:
1. APPROVED PROIECT
This approval is based on documents consisting of two (2) pages entitled, "Exhibit C,Tenant
Sign Criteria, Sign Program for Bollinger Plaza, 7335-7337 Bollinger Road" and six (6)
additional pages, which include: Site Plan, Allowable Tenant Sign Dimensions, Sign
Placement,Sign Section, Bollinger Plaza Ground Sign, and 7337 Ground Sign, except as may
be amended by conditions in this resolution.
2. BUILDING PERMIT REQUIRED
This Sign Program approval does not constitute building permit approval. A building
permit is required for each separate sign indicated on the sign program unless the Building
Department determines that it is not necessary to obtain one. The current tenant located at
7335-A Bollinger Road ('Huntington Learning Center') will be allowed to keep their existing
signage only if a building permit is obtained for that sign.
3. CHANGES TO SIGN PROGRAM
A new Sign Program application, for review and approval of the Planning Department, is
required prior to making any changes to the approved Sign Program.
4. ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easements and/or construction records. Any misrepresentation
of any property data may invalidate this approval and require additional review.

5. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Staff has made all the findings that are required for approval of a Sign Program as required by
the of Cupertino's Municipal Code, Section 19.104.130(C). Please be aware that if this permit is
not used within one year, it shall expire on Apri111, 2013.
Please note that an appeal of this decision can be made within 14 calendar days from the date of
this letter. If this happens, you will be notified of a public hearing, which will be scheduled
before the Planning Coininission.

TENANT SIGN CRITERIA

Tenant Si�n Criteria
1. All tenant signage to be internally illuminated individual pan channel letters. Trim color to match
color of returns. Letters shall have S"deep returns. Faces shall be manufactured of 3/16-inch plex. Face
color and copy style shall be tenant's choice with landlord approval.
2. Tenants shall be allowed one sign per tenant frontage to a maximum of one square foot of sign
area per lineal foot of leased frontage. Sign length shall not exceed 70%of leased frontage,and height
shall not exceed 18". Tenant shall be allowed signage on each leased frontage;however,in no case shall
the total sign area of all signage exceed the total allowable sign square footage allowed by the City of
Cupertino. (Section 19.104.140 of city sign ordinance)
3. Two lines of copy shall be allowed with landlord's approval. Not to exceed the total allowable
sign area.
4. Logos and logo modules shall be allowed with Landlord and City approval, and will not be
calculated as part of the overall allowable sign area if provisions for logos in the City's Sign Ordinance
are met. The maximum height of logos shall not exceed 24" and are limited to 9 square feet in area.
5. All tenant signage shall be illuminated with 13mm to 15mm neon tubing and 30ma transformer.
LED is also acceptable.
6. All signs shall be U.L. labeled and shall be manufactured and installed in accordance with NEC
Section 600 and local building and electrical codes.
7. To ensure architectural integrity to the building fa�ade,the use of all sign colors,materials,and
other details shall be subject to landlord approval. Therefore the tenants' sign contractor is required to
submit to the landlord three (3) sets of detailed drawings with a minimum of 1/8-inch scale,showing
design,method of attachment and installation, and size of all proposed signs,included without limitation
should be style,location, size,color,materials,etc.
8. Landlord's approval of sign drawings shall constitute approval for these sign criteria only and
shall not be deemed as approval for compliance with any applicable City ordinances or for any other
purpose whatsoever (see Number 9 below.) Landlord reserves the right to modify this criteria,with City
approval,for any tenant of the center without affecting tenant's obligations hereunder.
9. It shall be the responsibiliry of the tenant and/or tenant's sign contractor to obtain all necessary
City Planning approvals and building and electrical permits prior to installation of tenant signage.
10. Any company doing work in Bollinger Plaza shall submit upon request, evidence that the sign
contractor has all the required licenses,city permits,workman's compensation and liability insurance as
required by the law and the City of Cupertino.
11. Two ground signs allowed on property, (one office tenant ground sign for 7337 and one
monument sign for the plaza.) All ground signs must meet the ground sign regulations stipulated in
the City's Sign Ordinance.
12. Miscellaneous:
A. Flashing,moving, or audible signs will not be permitted.
B. No exposed neon lighting shall be used on signs,symbols,or decorative elements.
C. All signs must be installed onto exposed metal raceways which shall be no larger than 6
inches in width and 8 inches in height. Raceway must be painted to match wall surface
behind sign. All bolts,clips,and fasteners shall also be painted to match.

D. All conductors,transformers,and other equipment shall be concealed.
E. Location of all openings (if any)for conduit and sleeves in fascia panels and/or building
walls shall be indicated by the sign contractor on drawings submitted to the Landlord's
architect. All penetrations of the builcling structure required for sign installation shall be
neatly sealed in watertight conditions.
F. Sign contractor shall repair any damage caused by his work and Tenant shall be fully
responsible for the operations of his sign contractor(s).
G. No sign maker's label or other identification will be permitted on the exposed surface of
signs.
H. Wording of sign shall not include the product sold except as a part of Tenant's trade name.
I. If the fascia sign is ever removed for replacement or because of expiration or termination of
Lease,Tenant shall leave the fascia panel in good condition,normal wear and tear
expected. Without limitation,Tenant shall specifically be required to fill in a workman
like manner any holes left in the fascia panel by removal of the sign and conduit.
J. Tenant shall pay for the cost of all signage. Tenant shall not be allowed to open for
business prior to the installation of exterior illuminated signing. In the event that Tenant
is not able to install said signing prior to opening for business,Tenant shall provide
Landlord with a signed contract from the sign contractor. Said contract shall provide for
installation of Tenant's sign within thirty days after Tenant's opening for business. In such
event,Tenant may open for business with Landlord's consent and City approval.
K. Tenant shall not have the right to place,construct,or maintain any other sign,
advertisement,awning,banner,or other exterior decoration without Landlord's consent
and City approval.
L. Tenant shall not have the right to place,construct,or maintain on the glass panes and
supports of the show windows of the Premises,the doors,and the exterior walls or roof of
the building in which the Premises are located or any interior portion of the Premises that
may be visible from the exterior of the premises,any signs,advertisements,names,insignia,
trademarks,descriptive material,or any other similar item without Landlord's consent.
Landlord at Tenant's cost can remove any item placed,constructed,or maintained that
does not comply with the provisions of this Exhibit"C".
M. Tenant shall not,without Landlord's consent,place,construct,or maintain on the
Premises, any advertisement media,including,without limitation, searchlights,flashing
lights,loudspeakers,phonographs,or other similar visual or audio media. Tenant shall not
solicit business,in,on,or about the common areas,or distribute handbills or other
advertising or promotional media,in,on, or about the common area.
NOTE: The following tenants shall be allowed to maintain their current signage:
7335 A Huntington Learning Center (current and transitionary ownership upon payment of approved
permit fees)
7335 B New Fashion Hair Design
7335 C The Red Crane
7335 D Grand Interiors
All tenants (including the exceptions noted above)must comply with the requirements set forth in this
Sign Program and Exhibit C when there is a new owner/tenan�,new business,change of use,or any other

Re: Ground Signs for 7335=7337 Bollinger Rd
The approved sign program for 7335-7337 Bollinger Rd (S-2012-01) will include the allowance of two
ground signs for the following reasons:
• Both ground signs are existin and conform to the ground sign regulations set forth in the City's
Sign Ordinance.
• The property has approximately 420 ft of linear street frontage, close to the required 500 ft for two
ground signs. The intent is to allow properties with wider frontages more opportunities for
signage.
• One of the current ground signs (resembles a directory sign) for the office building located at 7337
Bollinger Rd does not have anv wall signs•nor does the landlord allow any. This ground sign will
help support the identification of the office spaces which otherwise would not have any opportunity
for signage.

Here are some of my comments:
• On Exhibit C, Number 4, add 'for logos' after'provisions'.
• Please move ground sign references on the Allowable Tenant Sign Dimensions to Exhibit C (sign program). You
can include it as a separate number after 10.
• Under Allowable Tenant Sign Dimensions, for the City of Cupertino's purposes, please rename 'directory' to
'ground sign'.
• The current ground sign elevations also need to be included, with signage, tenants, and dimensions added.
• The elevations need to be much larger for readability. Please also include the length of the tenant frontage,
length of the sign frontage, and maximum sign height on the elevation. All of this information is already readily
available, it just needs to be included on the elevation.
• The elevations need to have sample tenant signs for each tenant space and not just blacked-out placeholders.
Be sure to illustrate that they are channel letters with an appropriately sized and scaled raceway.

Per our earlier conversation, our City Planner has indicated that we can allow the second ground sign (directory sign) on
7335 Bollinger Rd to remain, considering that you have close to 500 ft of linear street frontage and the fact that 7337
Bollinger Rd (office building) does not have any wall signs. The ground signs, however, must meet all of the ground sign
regulations stipulated in the City's Sign Ordinance. Please make references to this in the sign program.
It would also be much clearer in the sign program if we were to explicitly prohibit wall signs for 7337 Bollinger Rd. In
that case,you do not need to include any elevations for 7337 Bollinger Rd.
To expedite the process, please email me a copy of the revised plan set and attachments, so I may review it to see if all
of my comments have been addressed before you physically resubmit. Thanks lason, let me know if you have any other

Thank you for the application received on February 23, 2012 for a Sign Program application on the
property located at 7335-7337 Bollinger Rd. After reviewing the materials, Planning Departrnent staff
has determined that your application is incomplete in accordance with the Permit Streamlining Act
(California Government Code section 65920).
Please find below the remaining items and revisions that you will need to address and provide prior to
your application being deemed complete. Resubmit relevant plans once the revisions have been made.
Your timely response to this will help expedite your project's review.
Building Elevations:
1. Please include building elevations for both buildings depicting each tenant space, illustrating
approximate sign size and location. If no signs are proposed for 7337 Bollinger Rd,elevations
are not required for that building.
Site Plan:
2. The included site plan does not depict the approximate location of the existing/proposed signs.
Please include.
3. Label all tenant suite numbers for 7335 Bollinger Rd.
4. Please re-label'Office-Multi-Tenant' as'Office Space- Multi-Tenant(one exterior entrance)'

5. All existing ground signs shall be included within the Sign Program. Please indicate location on
site plan and submit ground sign elevations. The following are select provisions from the City's
Sign Ordinance. For a comprehensive list,please refer to the standards listed in Section
19.104.160 for Ground Signs (Ordinance attached):
a. Only one ground sign is permitted for street frontages >100 ft and< 500 ft
b. The maximum allowed area is 1 sq ft per 4 ft of linear street frontage,or 100 square feet,
whichever is less
c. Height is limited to 8 ft in height
d. For signs located on interior lots with more than 200 ft linear frontage,the ground sign
shall not be located closer than 50 ft from a side property line
e. The ground sign shall be located outside of the sidewalk site triangle
f. The ground sign shall be no closer than 1 ft from the public right-of-way
Any Directory Signs located on site shall not be oriented to the public right-of-way. If they are,
they may be considered ground signs. Only one ground sign is allowed for Bollinger Plaza,and
one already exists. Provide permits for each ground sign to indicate that they have been legally
permitted, or remove one of the existing ground signs.
Allowable Tenant Sign Dimensions:
6. Please indicate the length of each tenant frontage dimensions,as included on the site plan.
Multiply that by 70% to calculate the length of the sign.
Exhibit C:
7. Header: Rename'Bollinger Plaza' 'Sign Program for Bollinger Plaza'
8. Number 1: Add the sentence'Letters shall have 5" deep returns' after the second sentence

Design and shop drawings for all permanent fienant signs must receive written approval by landlord
before fabrication. Any signs installed without such approval may be removed by landlord at tenant's
expense. Landlord's approval shall be based upon conformity to this Sign Criteria and harmony,both
architecturally and aesthetically, with the design of center. Landlord reserves the right to modify
said criteria for any tenant of the cenber without affecting benant's obligations hereunder.
To secure landlord's approval three shop drawings of all proposed signs shall be submitted to landlord
for approval. A schematic section view of the sign will be required where necessary to show the form,
colors, finishes,and materials. All incomplete drawings will be returned without approval.
Drawings must be drawn at a minimum of 1/8 inch scale.
1. Tenant signs shall be individually illuminated channel type letber. Letbers shall have
5"deep returns.Return and trim color shall be tenant's choice with landlord's approval.
2. Letter style shall be tenant's choice with landlord's approval.Sign faces must be 3/16" Acrylite

Design and shop drawings for all permanent tenant signs must receive written approval by landlord
before fabrication. Any signs installed without such approval may be removed by landlord at tenant's
expense. Landlord's approval shall be based upon conformity to this Sign Criteria and harmony,both
architecturally and aesthetically, with the design of center. Landlord reserves the right to modify
said criteria for any tenant of the center without affecting tenant's obligations hereunder.
To secure landlord's approval three shop drawings of all proposed signs shall be submitted to landlord
for approval. A schematic section view of the sign will be required where necessary to show the form,
colors, finishes, and materials. All incomplete drawings will be returned without approval.
Drawings must be drawn at a minimum of 1/8 inch scale. �

1. Tenant signs shall be individually illuminated channel type letter. Letters shall have
5"deep returns.Return and trim color shall be tenant's choice with landlord's approval.
2. Letter style shall be tenant's choice with landlord's approval.Sign faces must be 3/16" Acrylite
plex. Colors must be selected from the f�llowing list of colors.

3. Tenants shall be allowed a minimum one sign per leased frontage.Tenants with more than one
frontage may have a sign on each elevation,providing they meet section 17.24.050 of city sign ord.*
which reads as follows: �
1.For bu�which do not have a ground sign and the
business is adjaeent to more than one street;or
2.The sign is directed b�the inberior of the project and not
visible from the public right-of-way.
4. Letter height shall not exceed 18".
5. Tenants shall be allowed 1 Squaze foot of sign area for each lineal foot of leased store frontage.
Sign length shall not exceed 70%of leased frontage.
6. Logo modules shall be allowed,but shall not exceed 24"in height and 4 squaze feet in azea.
7. No products to be represented in tenant's signage unless incorporabed in tenant's business logo.These
are subject to landlord approval. .
* This shall be the case unless a special sign exception has been applied for and passed by the city..
8. All signs shall beaz U.L.labels and be manufactured in accordance with Section 600 of the
National Electric Code,and local buildingcodes.
9. All bolts,fasteners,clips, etc. shall be painted.
10. All penetrations of the building structure required for sign installation shall be neady sealed in a
watertight condition.
11.All signs will have 13 mil.to 15 mil.neon tubing and 30 M.A.transformers.
12. All signs must be installect onb�exposed metal raceways.Raceways mustbe painted to match wall
surface behind sign.
13. Tenant shall employ the services of a qualified licensed sign contractor.
14. The entire mst of tenant's sign including,design,fabrication,and installation
shall be at the benant's sole expense.
15. No flashing,flickering,blinking,animated,oi moving light signs shall be permited.Paper '
signs,window stickers,and handmade signs,whether or not of a fiemporary nature,are expressly �
prohibibed.
16. All interior window neon must be approved by landlord prior to fabrication and installation.
Landlord reserves#he right to refuse any window neon deemed unsuitable for leased premises.
