Attn: Greg Vasquez 1610 Dell Avenue, Unit Q Campbell, CA 95008 SUBJECT: SIGN PROGRAM ACTION LETTER - Application Number SP-2019-01 This letter confirms the decision of the Director of Community Development, given on February 26, 2019 approving a revision to an existing sign program (SP-2014-06) for the Allario Shopping Center, located at 10251-10297 S. De Anza Boulevard (APN: 359-07-001). FINDINGS Prior to approval, the Community Development Director must make the following findings as outlined in Section 19.104.130 of the City of Cupertino Municipal Code. Staff analysis is shown below the required findings. A. The Sign Program complies with the purpose of this chapter. The proposed sign program complies with the purpose of the Sign Ordinance by establishing a comprehensive set of design standards serving to identify and enhance the signage. The proposed plan maintains the aesthetic appearance of the City by establishing a high quality and consistent set of guidelines for all tenants on the subject site that includes direction as to the number, placement, size, color, and material of future signs. B. Proposed signs are creative, and are in harmony with the structures they identify, other signage on the site, and the surrounding development. The Sign Program establishes a set of design standards, which are in harmony with the structures they identify in that they are appropriate in scale, incorporate colors and tones approved for the site, and provide continuity throughout the development. C. The Sign Program contains provisions to accommodate future revisions that may be required because of changes in use or tenants. SP-2019-01 Action Letter Allario Shopping Center February 26, 2019 CONDITIONS OF APPROVAL 1. APPROVED PROJECT Approval is based on the Master Sign Program consisting of seventeen (17) pages prepared by Window Graphics Sign Company entitled, “Allario Shopping Center Master Sign Program” except as may be amended by conditions in this resolution. Refer to the City of Cupertino Sign Ordinance for provisions not specified in this sign program. Any non-conforming wall or ground signs must comply with the regulations listed in the sign program or where there is a conflict between the sign program and the Sign Ordinance, unless specifically approved in the sign program, the regulations in the Sign Ordinance shall apply. 2. ACCURACY OF THE PROJECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and require additional review. 3. BUILDING PERMIT REQUIRED This Sign Program approval does not constitute building permit approval. A building permit is required for each separate sign indicated on the sign program unless the Building Department determines that it is not necessary to obtain one. 4. FUTURE MODIFICATIONS TO THE SIGN PROGRAM Any proposals for new permanent sign locations not shown on the sign program or modifications to existing sign program standards shall require City review through a sign program modification and additional discretionary permit if determined necessary by the Director of Community Development. 5. TEMPORARY SIGNS This Sign Program approval does not constitute approval of any existing temporary signs, including temporary banners or flags currently onsite. Any existing or proposed temporary signs are subject to the regulations in the Sign Ordinance and require a Temporary Sign Permit, unless otherwise exempt. 6. VEHICLE SIGNS This Sign Program approval does not constitute approval of any existing vehicle signs currently onsite. Vehicle signs are prohibited under the Sign Ordinance. All prohibited signs shall be removed from the property prior to final building inspection for the Radhe Chaat sign building permit. 7. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. SP-2019-01 Action Letter Allario Shopping Center February 26, 2019 8. INDEMNIFICATION Except as otherwise prohibited by law, the applicant shall indemnify and hold harmless the City, its City Council, and its officers, employees and agents (collectively, the “indemnified parties”) from and against any claim, action, or proceeding brought by a third party against one or more of the indemnified parties or one or more of the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys’ fees and costs incurred in defense of the litigation. The applicant shall pay such attorneys’ fees and costs within 30 days following receipt of invoices from City. Such attorneys’ fees and costs shall include amounts paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. 9. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made all of the findings that are required for approval of a Sign Program as required by the City of Cupertino Municipal Code, Section 19.104.130(C). Please be aware that if this permit is not used within one (1) year, it shall expire on February 26, 2020. Please note that an appeal of this decision can be made within 14 calendar days from the date of decision (Tuesday, March 12, 2019 at 5:00pm). Page 17 Introduction All sign devices at Allario Shopping Center are controlled by these Signage Guidelines and by the City of Cupertino’s Sign Ordinance, Chapter 19.104 of the Municipal Code. In cases not covered by this Sign Program, the Sign Ordinance will be enforced. The Guidelines will contribute to the vitality and thematic nature of Allario Shopping Center, and have been carefully planned to enhance the marketing opportunities for users, and to respond to the Image Objectives of Allario Shopping Center and the spirit of the City of Cupertino sign code. The Sign standard section reviews the types of signs allowed and their form, materials, colors and placements. Signage at Allario Shopping Center must be developed within the Allario Shopping Center Signage Guidelines and submitted by the tenant to the Management of Allario Shopping Center for architectural review and approval PRIOR to city submittal. The Owner, Management and The City of Cupertino are responsible for final interpretations of the Guidelines, and at their collective discretion, may modify them to accommodate unforeseen circumstances. The purpose of this review will be to maintain quality and consistency of signage with building design and compatibility with submittal requirements. Submittal requirements Three (3) sets of plans that show the following: A. Site Plan, drawn to scale, depicting all structures, streets, driveways, sidewalks, parking areas, and landscaping; and also showing: (i) For proposed freestanding sign(s): Sign location(s) on property and dimensioned relation to property line, nearest curb, adjacent driveway, or other objects to clarify exact location. (ii) For proposed wall sign(s): Dimensioned tenant frontage(s) and sign location(s). B. Elevations showing design, dimensions, colors, and materials proposed; the location of the wall signs on the building; type of illumination, section(s), and colors and materials proposed (sample colors and materials may also be required); installation details and illumination restrictions. It is to everyone’s advantage to have appropriate and complementary signage. Therefore, conformance to the intent as well as the wording of the Guidelines is critical to the success of the program. Page 3 Allario Shopping Center Image Objectives The purpose of the signage program is to ensure that the integrity of the signage for Allario Shopping Center is presented with diversity and creativity while maintaining standards that achieve consistency throughout the project. These Guidelines are established for Owner, City and Users at Allario Shopping Center to provide a coordinated graphic system that communicates information in a distinctive and aesthetically pleasing manner. The visual consistency created by the criteria minimizes confusion and promotes an image of quality, which unites all of the individual establishments within Allario Shopping Center. The Guidelines establish minimum standards that are reasonable and equitable while providing sufficient flexibility to accommodate the User’s need to be recognized and marketable, to reflect each retail chain User’s graphic prototypes, and to encourage tasteful innovation. It is the responsibility of each Owner and/or User to submit design drawings of the proposed signage to the Allario Shopping Center Management and to the City of Cupertino for approval prior to the installation of any signage. The use of professional environmental graphic designers and professional signage companies to determine design detailing and sign placement is highly encouraged. Deviation from these Guidelines will only be considered if the overall purpose is to exceed the quality standards set forth herein. A. Portray a Unique Visual Business Retail Atmosphere. B. Provide Effective and Safe Vehicular Circulation. C. Provide Strong Identity to Vehicular and Pedestrian Traffic. D. Identify Allario Shopping Center as a Single Unit by the Use of Consistent Color and Material Palettes. E. Enhance Property through Quality Fabrication and Installation of All Sign Devices. Page 4 Sign Types and Allowances Tenant Building Sign. Each tenant will be allowed one main identification sign to be placed on their primary frontage over the main entrance. Allowable Ratio for the Primary Frontage is one square foot of sign area for each lineal foot of primary building frontage up to 150 linear feet.. The sign design format is specific to the construction of Allario Shopping Center. Each tenant will design a sign as specified in the construction details on pages 10-15. The main copy to be face lit internally-illuminated white channel letters. The overall length of each tenant sign will be determined by the tenant’s lineal frontage. The overall height of each sign is not to exceed 24”. The individual channel letter height is to be 18”. Logos are not to exceed 9 square feet. Window Vinyl Graphics. All tenants are allowed one set of vinyl graphics at their storefront. These graphics are considered part of the wall sign area, and no more than 25% of the window surface of each storefront bay may be covered. Tenants are allowed to display name and/or logo, store hours, and emergency contact information only. Tenants are allowed corporate colors; white or light colors are recommended. Page 5 Community Sign Types Main Monument Identification. One 9’2¼“ tall x 13‘0¾” wide, double-face monument sign is at the property’s frontage. Sign cabinets are fabricated from aluminum; sign faces are polycarbonate; sign is double faced with internal illumination. Tenant name panels (no logos) are available to those tenants approved by the Allario Shopping Center Management. Page 6 Prohibited Signage 1. No exposed raceways allowed. 2. No exposed conduit. 3. All conductors, transformers and fasteners shall be concealed. 4. All penetrations shall be neatly sealed. 5. Sign contractor will be held responsible for any damage done to the building during installation. 6. No manufacturer’s labels will be allowed on any visible surface of the sign, except where the City of Cupertino requires. 7. No exposed neon within the letterset or mounted on the fascia. 8. Sign wording to be limited to the tenant’s name only. 9. Flashing, moving or audible displays such as inflatable sidewalk displays, rooftop balloons or flashing window displays are prohibited. 10. The following signs are not permitted in the City: A. Advertising Statuary; B. Animated Signs. Animated signs except for banners, flags, pennants and balloons permitted on a temporary basis as regulated in Section 19.104.260, and electronic readerboard signs as permitted in Section 19.104.180; C. Audible Signs. Advertising displays which emit audible sound, odor or visible matter; D. Off-site Signs. Any off-site sign except as may be permitted in Section 19.104.240, 19.104.250 & 19.104.260; E. Portable Signs. Portable signs except as may be permitted in Section 19.104.270; F. Roof Signs. Any permanent roof sign; G. Traffic Conflict Signs. Signs which because of color, wording, design, location or illumination resemble or conflict with any traffic-control device or with the safe and efficient flow of traffic; H. Vehicle Signs. The parking of any vehicle or trailer, on either public or private property which is visible from a public right-of-way, which has affixed to it a sign which is intended to attract or direct customers to a business on or near the property is prohibited. This subsection is not intended to apply to standard advertising or identification practices where such advertising displays are painted on or permanently attached to a business or commercial vehicle which is actively being used by the business unless the vehicle is in violation of the parking ordinance (Chapter 19.124 of the Cupertino Municipal Code). Page 7 Additional Guidelines 1. In order to achieve a degree of uniformity, all building-mounted tenant identification signs shall be illuminated using white neon or LEDs in the reverse channel accent trim only. 2. All building-mounted tenant identification signs shall be centered vertically within the allowed sign band. In the event that a tenant occupies multiple bays, the tenant sign shall be centered on the facade of the tenant bay where the primary entrance is located. 3. Trademarked logos must conform to the maximum height of 18” for building-mounted tenant identification signage. 4. Under no circumstances is illuminated signage allowed on the rear of the building. 5. Aside from the tenant identification and emergency contact information allowed on the primary public entrance door, no signage is allowed to be affixed to or painted onto any of the windows. All temporary signage erected within a tenant space must be located a minimum of 3’ from any store entrance or window. 6. No signage may be installed within the parking lot, any sidewalks within the project site, or the public right-of-way, or within any landscaping areas (except the monument sign allowed through this master sign program). 7. In the event that a business occupying space within Allario Shopping Center is closed for more than 60 days, the related on-building and window signage shall be removed by the Owner. 8. De Anza Boulevard (APN: 359-17-001). This approval supersedes S-2013-04 and is subject to the following findings and conditions of approval. FINDINGS Prior to approval, the Community Development Director must make the following findings as outlined in Section 19.104.130 of the City of Cupertino Municipal Code. B. Proposed signs are creative, and are in harmony with the structures they identify, other signage on the site, and the surrounding development. The Allario Center Sign Program establishes a set of design standards which are in harmony with the structures they identify in that they are appropriate in scale, are not too bright or colorful, and provide continuity throughout the site by drawing on a consistent "Avery" green color utilized in the monument sign. The sign program also requires the monument sign to provide the address of the property on the bottom panel and utilize simple color scheme, such that it is more consistent with monument signs of surrounding properties. SP-2014-06 Action Letter 10297 S.De Anza Boulevard December 8,2014 C. The Sign Program contains provisions to accommodate future revisions that may be required because of changes in use or tenants. The sign program allows for individual tenants to utilize their own letter font for signs over their tenant space, to allow some flexibility for future tenants. Furthermore, the monument sign does not designate a tenant space as the anchor tenant, as such, can be reassigned in the event of future vacancies, or changes in use. CONDITIONS OF APPROVAL 1. As part of the deferred submittal, the applicant shall provide a color sample of the proposed fascia band, such that staff can review its color to ensure the band is harmonious with the project site, to the satisfaction of the Community Development Director. Changes to the color of the fascia band may be required to ensure compliance with this condition of approval. 4. B. Proposed signs are creative, and are in Izarmony with t12e structures tliey identify, other signage on the site, and the surrounding development. Sheet 4 of the sign program allows for individual tenants to utilize their own letter font for signs over their tenant space, to allow some flexibility for future tenants. Deferred Sign Program Rec�uirements The First Republic and Allario Center Monument Signs are to be installed prior to final occupancy ot the bank. A separate building permit shall be required and applied tor no later than December 31St, 2014 for the work shown on Sheet 5 of the plans.
