Subject: Director's Minor Modification, DIR-2015-01, to allow minor design changes to a
previously approved Two-Story Permit (R-2014-24) and Minor Residential Permit
(RM-2014-19) to allow modifications to the second floor massing and window
placement for the proposed single-family residential home at 20984 Alves Drive.
Chapter 19.132 of the Cupertino Municipal Code allows for admulistrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
BACKGROUND
The applicant, Ravi Gampala, obtained approval for a 4,968 square foot two-story, single-family
residence from the Planning Department on August 18, 2014. The applicant is proposing minor
building and site changes to the previously approved residential design. The proposed
revisions are outlined below;
1) First floor shifted approximately 5 feet to the west resulting in an 11' interior side
setback and 13' 2" street side setback.
2) Second floor shifted approximately 8 feet to the west resulting in a 25' 9" interior side
setback and 23' 2' street side setback.
3) First floor area increased by 100 square feet.
4) Second floor area decreased by 98 square feet.
5) Basement addition of 1,453 square feet;not counted in the total building area.
6) Architectural changes including;second story window placement,building massing and
articulation, and a new rear and side porch.
7) Minor first and second floor plan adjustments.
DISCUSSION
The proposed modifications are consistent with the City's Single-Family Residential (R1)
Ordinance. The proposed revisions will result in a net increase of 2 square feet for a total
building area of 4,970 square feet. No other interior or exterior changes are proposed.

The site and elevation plans were circulated to the adjacent property owners for a two-
week review period. No comments were received from the public.
ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
This approval is based on a plan set entitled, "New Residence for Ravi Gampala & Santha
Chittajallu, 20984 Alves Drive., Cupertino, CA. 95014" consisting of thirteen sheets labeled
"A1, A1.B, A2 to A10, and L1.0 to T-1", dated Received February 10, 2015, except as may be
amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. ACCURACY OF THE PROLECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including
but not limited to property boundary locations, building setbacks, property size, building
square footage, any relevant easements and/or construction records. Any misrepresentation
of any property data may invalidate this approval and may require additional review.
4. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the
building plans.
5. CONSTRUCTION PLAN SET REVISIONS/CLARIFICATIONS
Prior to issuance of building permits, the construction plan submittal shall include the
following information:
a. Fences: All proposed fences shall meet the Fence Ordinance. The proposed fence
on the street side property line shall be revised to meet the City's Fence
Ordinance regulations. A 6' high fence must be setback 5' from the street side
property line and any portions of the fence located in the corner triangle must be
3' or lower. No driveway gates are allowed.
b. Wet Bars: The basement and first floor plans currently include second kitchens
which are not allowed in single-family residential homes. Kitchens are defined as
areas that have three or more appliances including counter tops and sinks. Prior
to permit issuance these areas shall be revised to have two or less appliances.
c. Lightwells: The final lightwell design shall be consistent with the building
departxnent's requirements on lightwells. All lightwells shall be minimized to the
greatest extent possible while still meeting the minimum requirements for egress,
light, and ventilation.

d. Privacy Screening: At the time of building permit application the site plan must
be revised to be consistent with the proposed landscape plan. The number of
proposed privacy tress shall be consistent with the number indicated on the
landscape plan.
6. COMPLIANCE WITH PUBLIC WORKS CONFIRMATION FORM
The project shall comply with the requirements indicated on the Public Works Confirmation
form dated 7/15/2014, including, but not limited to, dedications, easements, off-site
improvements, undergrounding of utilities, all necessary agreements, and utility
installations/relocations as deemed necessary by the Director of Public Works and required
for public health and safety. The Public Works Confirmation is a preliminary review, and is
not an exhaustive review of the subject development. Additional requirements may be
established and implemented during the construction permitting process. The project
construction plans shall address these requirements with the construction permit submittal,
and all required improvements shall be completed to the satisfaction of the Director of
Public Works prior to final occupancy.
7. PRIVACY PLANTING
The final privacy-planting plan shall be reviewed and approved by the Planning Division
prior to issuance of building permits. The variety, size, planting distance shall be consistent
with the City's requirements.
8. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements consistent with
the R-1 Ordinance, for all windows with views into neighboring yards and a sill height that
is 5 feet or less from the second story finished floor. The precise language will be subject to
approval by the Director of Community Development. Proof of recordation must be
submitted to the Community Development Department prior to final occupancy of the
residence.
9. LANDSCAPE PROJECT SUBMITTAL:
Prior to issuance of building permits, the applicant shall submit a full landscape project
submittal per sections 14.15.040 A, B, C, and D of the Landscaping Ordinance if more than
2,500 square feet of landscaping area is proposed. The Water-Efficient Design Checklist
(Appendix A of Chapter 14.15), Landscape and Irrigation Design Plans, and Water Budget
Calculations shall be reviewed and approved to the satisfaction of the Director of
Community Development prior to issuance of building permits.
10. EXTERIOR BUILDING MATERIALS/TREATMENTS
Final building exterior treatment plan shall be reviewed and approved by the Director of
Community Development prior to issuance of building permits. The final building exterior
plan shall closely resemble the details shown on the original approved plans. Any exterior
changes determined to be substantial by the Director of Community Development shall
require a minor modification approval with neighborhood input.

11. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals shall remain in effect unless
superseded by or in conflict with subsequent conditions of approval, including conditions of
approval for R-2014-24 and RM-2014-19.
12. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building
permits for the installation of the aerials and associated equipment.
13. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indexnnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
14. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Governrnent Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective March 10, 2015. The fourteen calendar day appeal period
will expire on March 24,2015.
