The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar da s. BACKGROUND The applicant, Shoji Nagayama, representing the property owner, Vardy Shtein, is proposing minor building and site changes for a si ngle-tenant building occupied by Sushi Kuni Restaurant in the existing shopping center, to comply with current American Disabilities Act (ADA) standards. 'The shopping center consists of two commercial buildings which were approved through a prior Use Permit (U-1974-23): the single-tenant building located on the north side and a larger multi-tenant building located south of the single-tenant building. The multi-tenant building currently has an ADA compliant pathway. DISCUSSION The project proposes to: • Relocate the front entrance from the east elevation to the south elevation; • Construct a new ADA ramp to extend and align with the relocated front entrance and the ADA- compliant pathway of the multi-tenant building; and • Convert and expand an existing entrance deck into a 233-square foot outdoor patio area only accessible through the restaurant. In order to maintain and enhance the single-tenant building frontage, the vacated entrance deck will be repurposed as an outdoor eating area. The proposed deck will extend four (4) feet into the existing parking lot for a total depth of ten (10) feet and will run the entire length of the building measured at 23'-6". As a result of the deck modifications, the parking lot at the front and rear of the building will be restriped. The parking lot restriping, drive-aisle dimensions, and total parking supply are in compliance with the City's Parking Ordinance as proposed. �_�Iiti-�.f, z . �.� .�. � ; � � t,kt.� .:�1;. l� s?;.?,'€.�i.. ��,i.-:,?i' :... The proposal will not result in adverse visual impacts to the adjacent public right-of-ways, and neighborhood impacts are minimal as the closest residences are located behind the restaurant, approximately 130 feet west of the proposed deck. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled "Kuni Sushi" prepared by Shoji Nagayama, consisting of four (4) sheets labeled 1-4, received on January 28, 2015, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL All prior conditions of approval through past approvals shall remain in effect unless superseded by or in conflict with subsequent conditions of approval and as specifically amended by this Director's Minor Modification approval. 3. EMPLOYEE PARKING The parking to the rear of the building shall be designated for employee parking. 4. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans. 5. ACCURACY OF THE PROJECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Any misrepresentation of any property data may invalidate this approval and may require additional review. 6. EXTERIOR MATERIAL The final deck color and material shall closely resemble the details shown on the original approved plans and shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. 7. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible for consulting other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 8. PUBLIC WORKS At the time of the next request for a building, planning or land use perxnit on this property, the property owner will be required to build sufficient trash enclosure to comply with Cupertino �_�?�i:i.'�.l.s.,3��r:d._<.e.., �� ¥ i :`.'"�.�t','"1%t.lxi 13',S.'f..�d.. ��<�;.�i..'�? Municipal Code as prescribed in "Sushi Kuni Plan Comments" or as deemed appropriate by the Public Works Department. Additional site changes may be required and will be subject to further review and approval by the Director of Community Development. 9. INDEMNIFICATION To the extent permitted by law, the applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The applicant and City shall use best efforts to select mutually agreeable legal counsel to defend such action, and the applicant shall pay all compensation for such legal counsel, following the applicant's receipt of invoices from City, together with reasonable supporting documentation. Such compensation shall include reasonable compensation paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. If the applicant and the City cannot in good faith agree on joint counsel, the City shall have the right to retain counsel of its own choosing, separate from the applicant's litigation counsel. 10. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective February 17, 2015. The fourteen calendar day appeal period will expire on March 3, 2015. City ordinance 9.18.210.4.H, requires food businesses such as Sushi Kuni to build a covered trash/recycling enclosure as a result of any changes or modifications subject to City review and approval. The minor modifications that are proposed by Sushi Kuni are driven by upgrades being done to meet ADA access requirements. After meeting with the property owner, the owner of Sushi Kuni, the architect and representatives from Recology (the City's garbage and recycling service provider), City staff agreed to postpone the trash enclosure requirement for Sushi Kuni until the time of the next request for a building, planning or land use permit on this property. The property owner has agreed, at that future time, to work with the business tenant(s) in coordination with City staff and Recology staff to build sufficient trash enclosure space to comply with Cupertino municipal code. To memorialize this postponement and agreement, page 4 of the plans revised on 1- 28-2015, shows a "future trash enclosure area" on the property. T'his future trash enclosure area will be designed for cost effectiveness and efficiency at the time of the next City review and approval of modifications or changes to the property.
