Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar da s. BACKGROUND The applicant, Bruce Chan of Land Planning Concepts, representing the property owner, Robert Aguilar, is requesting to modify the recreational outdoor spaces adjacent to the recreation center at Arioso Luxury Apartments. The existing children's tot lot location,west of the recreation center, will be replaced with an expanded patio and the installation of a BBQ counter and fire pit, and the children's tot lot will be relocated east of the recreation center. The City Council approved a Use Permit (U-1996-15) on February 3, 1997 for the construction of a 201- unit apartment, hotel, and accompanying recreation areas. The original project approval consisted of the following elements: a turf playfield, recreation center, three family picnic areas, game court area, and two children's play apparatuses (one for tots and one for school age children). Additionally the Planning Commission approved an Architectural and Site Approval Permit (ASA-1997-08) on September 8, 1997 for the project's landscape plan. _ DISCUSSION The modification will relocate the family picnic area to the existing children's tot lot and expand the patio from the swimming pool westward to the fence along Linnet Lane, and relocate the children's tot lot to the existing family picnic area east of the recreation center. The proposal retains the total area of existing recreation areas and enhances the surrounding areas of the newly located family BBQ area and children's tot lot. The upgrades will include a water-efficient irrigation system, expanded patio with added family picnic area amenities (fire pit, BBQ counter), and landscape enhancements (evergreen shrubs, and groundcovers) to the site. DIR-2014-40 19608 Pruneridge Avenue Page 2 The previous Architectural and Site Approval Permit(ASA-1997-08) required that the two children's apparatus areas be fenced with 4-feet high wrought iron fencing. The existing play structures are positioned below grade from its surroundings, and since the proposed play structure will be at grade the proposed fence will not exceed 5 feet in height to match the existing fencing of the recreation center. The minor changes in the project will serve as internal enhancements to the apartment complex facilities and will not result in adverse visual impacts to surrounding properties and adjacent public rights-of-way. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled "Arioso Luxury Apartments" prepared by Land Planning Concepts, consisting of four (4) sheets labeled L 1.0, L 1.1, L 2.1, and L3.1 received on December 1, 2014, and one (1) sheet labeled L 4.0 received on January 6, 2015, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL The following previous conditions of approval for the project site shall remain in effect: ASA-1997-08 and U-1996-15 • All conditions, except condition (4) of ASA-1997-08 shall be amended differentiating the height of the children tot lot's fencing from the school-children play area's fencing 3. FENCING T'he children's tot lot is allowed to be fenced with 5 feet high steel fencing, matching the existing fence style of the recreation areas. Any exterior changes determined to be substantial by the Director of Community Development shall be reviewed and approved by the Community Development Department. 4. LANDSCAPE PROJECT SUBMITTAL/CHECKLIST The project is subject to all provisions delineated in the Landscape Ordinance (CMC, Chapter 14.15). Prior to issuance of building permits, the applicant shall submit the Water-Efficient Design Checklist (Appendix A of Chapter 14.15) A full landscape project submittal per sections 14.15.040 A, B, C, and D of the Landscape Ordinance will be required if the total landscape area is more than 2,500 square feet. 5. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. DIR-2014-40 19608 Pruneridge Avenue Page 3 6. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS T'he Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective January 15, 2015. The fourteen calendar day appeal period will expire on January 29, 2014.
