Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar da s. DISCUSSION The applicant, Jared Taylor, representing Lazy Dog Restaurant and Bar, is requesting minor height increases at the entry tower, roof parapets, and roof deck beyond what the City Council originally approved at the Lazy Dog Restaurant and Bar building (originally known as Shops 2), located at 19359 Stevens Creek Blvd within the Main Street Cupertino project. Previous City Approval The City Council originally approved the Architectural and Site application (ASA-2013-08) for the restaurant building on July 15, 2014. The Council also approved on the same day the restaurant's Use Permit(U-2014-05) for an interior bar and late night hours. Height Increase According to the applicant's project description letter(Attachment A), the reason for the modification is to allow for increased interior heights within the restaurant. Specifically, the increases include: • Increasing the height of the tower from 37 to 38 feet • Increasing top of parapet height for the majority of the building from 24 to 27 feet • Increasing the top of the stone corner parapets from 26 to 28.5 feet The revised plans also include minor changes to the locations of the exterior stone and wood finishes. Per Condition #9 of ASA-2013-08, the front building setback along Stevens Creek Boulevard has been revised to at least 35 feet. DIR-2014-36 19359 Stevens Creek Boulevard Page 2 The City's Architectural Consultant has reviewed the revised plans and supports the modification request. T'he design and appearance of the building fa�ade remains substantially the same as the original approval, and given the building's distance from existing residential areas, the increase is visually negligible. There are also no changes to the approved color and material palette. Moreover, the height increases are within the General Plan's height allowance and exceed the minimum setback to height slope lines. Staff received an inquiry about the specifics and justification behind the proposal,but did not receive any other comments. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled: "Lazy Dog Restaurant and Bar, 19359 Stevens Creek Blvd., Cupertino, CA 95014," prepared by Architects Design Consortium and Bitton Design Group, received October 17, 2014 (Sheet A1.0 only) and December 3, 2014, and consisting of six sheets labeled A1.0, A2.0, A4.0, A5.0, A5.1, and A6.0, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL The following previous Main Street Cupertino and Lazy Dog Restaurant and Bar (Shops 2) development/use permit and architectural and site approval permit conditions of approval for the project site shall remain in effect: M-2012-03 (Resolution 12-098) and ASA-2012-10 (Resolution 12-099) • All conditions, with the clarification for M-2012-03 (Resolution 12-098), Condition no. 2 (regarding past conditions of approval that apply), that Resolution 12-098, Resolution 12-099, and Resolution 12-100 superseded M-2011-09 (Resolution 12-054), ASA-2011-24 (Resolution 12- 055), and TM-2011-04(Resolution 12-056). ASA-2012-15 (Resolution 14-122) • Condition nos. 3-7, 9-10, 18-19, 21-25 U-2014-05 (Resolution 14-181) • All conditions ASA-2013-08 (Resolution 14-180) DIR-2014-36 19359 Stevens Creek Boulevard Page 5 • All conditions, except that the approved elevations, site plan, floor plan, roof plan, and cross sections shall be superseded by this approval. 3. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 4. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 5. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective January 8, 2015. 'The fourteen calendar day appeal period will expire on January 22, 2015. The top of the tower is proposed at 38 feet, an increase of 1 foot. The top of the parapets are proposed at 27 feet for the majority of the building, an increase of 3 feet. The top of the stone, corner parapets are proposed at 28.5 feet, an increase of 2.5 feet. The increase in building or parapet height is requested to allow the roof deck to rise correspondingly in height allowing for the interior ceiling height to raise which will resolves conflicts between ductwork and soffits and dining room experience.
