Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar da s. DISCUSSION The applicant, Paul Fick, representing the property owner, Ken Frangadakis of the Cupertino Dental Group, is requesting to renew an expired Director's Minor Modification (DIR-2010-25) to allow the conversion of an existing 105 square foot outdoor patio to an enclosed office space, located at 10383 Torre Avenue. The Director of Community Development originally approved the project on July 27, 2010,but the building permit expired due to lack of activity. The project remains substantially the same since the 2010 approval. The applicant proposes to enclose an existing covered 105 square foot outdoor patio and convert it to office space currently serving the Cupertino Dental Group. T'he proposed addition will provide the existing administrative employees more functional work space and it will not intensify the existing dental operation. According to the Parking Ordinance, medical clinics are parked at 1 space per every 175 square feet and part of this ratio factors in the administrative support functions that are customarily to medical clinics. Given that the project is not increasing any of the medical operation (operation rooms) or intensifying the number of employees, the parking demand for the operation will not be changed. The proposed addition would increase the floor area ratio from 23.68% to 24.04%, which is less than the center maximum of 33%. The proposed enclosure will match the existing building color and material. The project is considered minor and will not be visible to the public views. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: DIR-2014-38 10383 Torre Avenue Page 2 1. APPROVED EXHIBITS Approval is based on exhibits titled: "Cupertino Dental Group, 10383 Torre Ave Suite 1, Cupertino, CA 95014," prepared by Paul H. Fick, received November 25, 2014, and consisting of seven sheets labeled 1-7, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL The following previous architectural and use-related conditions of approval for the project site shall remain in effect,unless superseded by subsequent approvals: U-1998-08,U-1989-14,U-1985-09,U-1984-27,U-1972-03,DIR-2002-21 • All conditions 3. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitaHon) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 4. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS T'he Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Govemment Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective January 6, 2015. The fourteen calendar day appeal period will expire on January 20, 2015.
