Subject: Director's Minor Modification to modify performance timelines specified in a
previous approval (DIR-2012-20) for an ozone injection and soil vapor extraction
treatment system at an existing gasoline station.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. Chapter 19.12 of the Cupertino
Municipal Code requires the Director to report his/her decision to the City
Council and Planning Commission in time to allow an appeal of the decision
within fourteen calendar days of approval.
DISCUSSION:
The applicant, Frey Environmental Inc., proposes to modify the performance timelines
specified in the previous Director's approval (DIR-2012-20) for an ozone injection and soil
vapor extraction treatment system at an existing gasoline station.
The equipment is located in the south parking lot of the business. In order to facilitate access to
the remaining parking stalls and the property, the parking area located along the east side of
the property has been restriped to allow two way travel and 90-degree parking stalls.
An eight-foot tall chain link fence (with slats) encloses the equipment. Shrubs have been
planted to the west to help screen the equipment. In addition, the applicant has increased the
height of the sound wall to attenuate sound from the pumps and other equipment in order to
be compliant with the City's Community Noise Control Ordinance.
The Director of Community Development previously approved the project on May 8, 2012. The
project was conditioned so that the treatment system was to be removed by May 22, 2014 with
a valid demolition permit. However, the timeline specified did not allot the necessary amount
of time for the cleanup to be completed to the satisfaction of Santa Clara Valley Water District
(SCVWD). Once the remediation process is complete, the SCVWD will certify that the site has
been cleaned and the equipment will be removed permanently.

ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Proposed Temporary Soil Vapor Extraction System,
Cupertino Beacon Service Station, 22510 Stevens Creek Boulevard, Cupertino, CA"
consisting of seven (7) sheets stamped "Received December 5, 2014" unless as amended by
the conditions of approval of this project.
2. PREVIOUS CONDITIONS OF APPROVAL
The following previous conditions of approval for the project site shall remain in effect:

• All conditions, with the exception that the removal date specified in Condition #2 shall
be determined by the SCVWD in conjunction with the Director of Community
Development
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with
regard to the proposed project for additional conditions and requirements. Any
misrepresentation of any submitted data may invalidate an approval by the Community
Development Department.
4. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
