SUBJECT: RETROACTIVE TREE REMOVAL PERMIT ACTION LETTER—Application TR-2014-44
This letter confums the decision of the Director of Community Development, given on November 18'�,
2014, approving a Retroactive Tree Removal Permit for the removal and replacement of a 20" diameter
dead Canary Island Pine tree located at 20800 Stevens Creek Blvd. with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Sam Oakley (#WE-9474A), dated May
13�, 2014, consisting of 3 pages and a replacement plan except as may be amended by conditions in
this resolution.
2. TREE REPLACEMENTS
The applicant is required to plan two (2) 24-inch box replacement trees in accordance with the
Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species
and location may be made to the approved replacement plan pending staff approval. The
replacement trees shall be planted within 30 days of the effective approval date of this tree removal
permit.
3. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.120 of the Protected Trees Ordinance.

"I'his memorandum intends to assess one (1) tree that was damaged on the Biltmore
Adjacency property at Stevens Creek Boulevard and S. Blaney Avenue in Cupertino, CA,
recommended for removal. Tree #64, Pinus canariensis (Canary Island pine) was
located neighboring Blaney Avenue on the southest corner of the property. Please see
Exhibit l for images of the subject tree.
The tree was originally surveyed by Arborwell in October 201 1. The tree had a 20 inch
diameter at 54 inches above natural grade, and a 25 foot wide codominant canopy. The
tree was in fair health and poor structure during my initial inspection. The poor structure
was due to the codominant top, and the resulting included bark tissue, a condition on a tree
that is prone to failure.
I was asked on May 8, 2014, to revisit the tree due to damage caused to the tree's root
system during the installation of utilities within the tree's canopy footprint. The property
was currently under development. Upon inspection, it was very clear that the damage
caused was extensive. A large proportion (> 40%) of the tree's root system had been
severed. The severance had occurred too close to the trunk of the tree (< 2'). The tree is
now unstable and will need to be removed immediately. The situation is aggravate due
to the fact that there is a structure being built in the target zone of the destabilized tree.
The tree is considered Protected Trees pursuant to Section 14.18 of the City of Cupertino's
Municipal Code. Removal of a protected tree is subject to a tree removal permit and any
fees/mitigatio assoc�a d. The tree will require replacement. The proposed replacement
should be on (l) 36-i h box tree installed close to the trees current growing location, but
spaced so th ot interfere with the installed utilities.
Recommendatio - Remove Tree#64 immediately and replace with one (1) 36-inch
box tree when d velopment is complete.
