Subject: Director's Minor Modification, DIR-2014-13, to a previously approved Use Permit (U-2011-
09) and an Architectural and Site application (ASA-2011-10) to allow an additional 137
square feet to an addition and other site and architectural modifications at an existing auto
service station, located at 21530 Stevens Creek Boulevard.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. T'he Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar da s.
DISCUSSION
The applicant, David Elliot, representing the BSP Cupertino Union, LLC, is requesting architectural and
site modifications to previously approved enhancements at an existing auto service station at 21530
Stevens Creek Boulevard.
Previous City Approvals
On May 22, 2012, the Planning Commission approved a Use Permit (U-2011-09) and Architectural and
Site Approval(ASA-2011-10) for the following:
• Remodel an existing service station, add 527 square feet, and convert the service bays to a
convenience market
• 24-hour operations, seven days a week,with beer and wine sales ceasing at midnight
• Concurrent sale of gasoline and alcohol(beer and wine) within the convenience market
The project approval also included a 2,580 square foot office building on the undeveloped east side
portion of the lot; however, the applicant no longer proposes to construct the second phase and this
entitlement is no longer valid. The undeveloped portion of the lot will be landscaped as part of the
proposed modifications.
Proposed Modifications
The property owner intends to tenant the convenience market with a 7-Eleven store. According to the
property owner, the existing 7-Eleven nearby at 21490 McClellan Road would continue to operate. The
proposed modifications include the following:

Site
• Addition of 137 square feet (for a total addition area of 664 square feet) in order to meet building
code requirements for aisle widths
• Removal of the office component of the project, and landscaping the area where it was previously
proposed
• Removal of previously proposed parking spaces along the office component
• Removal of two previously proposed parking spaces to accommodate an expanded trash and
propane tank enclosure. T'he required parking supply is still being met (10 parking spaces required,
11 proposed).
• Increased trash enclosure setback from the southerly property line to accommodate fire code
clearance
• New screening enclosure for air conditioning units at the rear of the building
• Additional trees along the Bubb Road frontage, in the southerly planter, and on the undeveloped
portion of the site that is to be landscaped
Architectural
• Height increase to north and south elevation entry towers by three feet (not to exceed height of
primary roof ridge)
• Total building height increase of six inches (for a total height of 16 feet, 7 inches)
• Extended projection of the roof eaves and decorative embellishments (rafter tails and roof vents)
provided throughout the design(as required by the conditions of approval of ASA-2011-10)
• Minor changes to window sizes and roof pitches
The architectural modifications are consistent with the Monta Vista Design Guidelines. The City's
Consulting Architect has also reviewed and supports the proposed modifications.
Public Review
The previously approved and proposed site and elevation plans were circulated to adjacent property
owners for a two-week review period. Staff received comments from a nearby property owner
expressing concerns that the project would compound existing traffic conditions, create loitering
problems, and lead to consumption of alcohol on adjoining sites.
The scope of this approval is for minor modifications to the originally approved architectural and site
details. No adverse traffic impacts were identified in the original Use Permit (U-2011-09) for the
expansion and conversion of the existing building to a convenience store. The additional 137 square
feet requested is not anticipated to create additional traffic impacts since it is only to accommodate the
building-code required aisle widths within the store.
Loitering and alcohol consumption were also addressed as part of the original Use Permit. Prior to final
occupancy, the applicant is required to submit a detailed security plan to City staff and the Sheriff's

Office for review and approval in order to ensure security concerns (including loitering or alcohol
consumption on nearby sites) are addressed. The applicant is also required to obtain the Department of
Alcoholic Beverage Control (ABC) approval prior to sales of alcoholic beverages. Alcohol sales are
required by the Use Permit to cease at midnight, and on-site consumption is not permitted. The Use
Permit is subject to review and possible revocation if any security issues persist.
ACTION
The Director of Community Development deems the modification minor and approves the project with
the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on e�ibits titled: "7-Eleven, 21530 Stevens Creek Blvd., Cupertino, CA 95014,"
prepared by David J. Elliot & Associates, received October 2, 2014, and consisting of 20 sheets
labeled A0.1, A1.1, A1.1A, A1.2, A1.2-A, A1.4, A2.0, A2.1, A2.1A, A3.2, A3.3, A3.4, A3.5, A3.6, E1.2,
LI-1, LI-2, LI-3, LP-1, and LP-2, except as may be amended by the conditions contained in this
resolution.
2. PREVIOUS CONDITIONS OF APPROVAL
The following previous conditions of approval for the project pertaining to use and
architectural/site details shall remain in effect:

• All conditions, except that the approval for the 2,580 square foot office building is no longer
valid
ASA-2011-10
• All conditions, except that the approved architectural and site details shall be superseded by
this approval, and that the approval for the 2,580 square foot office building is no longer valid

3. LANDSCAPE PROTECT SUBMITTAL
Prior to issuance of buildin�permits, the applicant shall submit a full landscape project submittal
per section 14.15.040 of the Landscaping Ordinance. The Water-Efficient Design Checklist
(Appendix A of Chapter 14.15), Landscape and Irrigation Design Plans, and Water Budget
Calculations shall be reviewed and approved to the satisfaction of the Director of Community
Development prior to issuance of building permits.

4. LANDSCAPE INSTALLATION REPORT
A landscape installation audit shall be conducted by a certified landscape professional after the
landscaping and irrigation system have been installed and �rior to final occu�anc�. The findings of
the assessment shall be consolidated into a landscape installation report.
The landscape installation report shall include, but is not limited to: inspection to confirm that the
landscaping and irrigation system are installed as specified in the landscape and irrigation design
plan, system tune-up, system test with distribution uniformity, reporting overspray or run-off that
causes overland flow, and preparation of an irrigation schedule.
The landscape installation report shall include the following statement: "The landscape and
irrigation system have been installed as specified in the landscape and irrigation design plan and
complies with the criteria of the ordinance and the permit."
5. LANDSCAPE AND IRRIGATION MAINTENANCE
A maintenance schedule shall be established and submitted to the Director of Community
Development or his/her designee, either with the landscape application package, with the
landscape installation report�rior to issuance of final occu�anc�, or any time before the landscape
installation report is submitted�rior to issuance of buildin��ermits.
a) Schedules should take into account water requirements for the plant establishment period and
water requirements for established landscapes.
b) Maintenance shall include, but not be limited to the following: routine inspection; pressure
testing, adjustment and repair of the irrigation system; aerating and de-thatching turf areas;
replenishing mulch; fertilizing; pruning; replanting of failed plants; weeding; pest control; and
removing obstructions to emission devices.
c) Failed plants shall be replaced with the same or functionally equivalent plants that may be size-
adjusted as appropriate for the stage of growth of the overall installation. Failing plants shall
either be replaced or be revived through appropriate adjustments in water, nutrients, pest
control or other factors as recommended by a landscaping professional.
6. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to
the proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
7. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.

8. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.
This approval of the modification is effective October 28, 2014. The fourteen calendar day appeal
period will expire on November 11, 2014.
