SUBJECT: TREE REMOVAL PERMIT ACTION LETTER—Application TR-2014-53
This letter confirms the decision of the Director of Community Development, given on October 17,
2014, approving a Tree Removal Permit to allow the removal and replacement of a 23-inch Deodar
Cedar tree,located at 7608 Erin Way. The application is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Kathy Hughes Anderson (ISA WC
#1048A), dated September 5, 2014, consisting of twelve pages, and a tree removal plan, except as
may be amended by conditions in this resolution.
2. IN-LIEU TREE REPLACEMENT FEES
The Director of Community Development has determined that accommodating the two required
24-inch box replacement trees on the property would not be feasible and therefore a tree in-lieu fee
would be required. The cost to procure and install the replacement trees is approximately $900, of
which the applicant has paid on September 24, 2014, in accordance with the City's Protected Tree
Ordinance.
3. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with Section
14.18.180 (A1) of the Protected Trees Ordinance.

Dear Ms. Davis,
On September 3, 2014, I visited the above referenced site for the purpose of evaluating the
condition of one Deodar Cedar, Cedrus deodara. In determining suitability for retention, I
considered factors such as species, age, condition, structure, diseases and insects. In assesing
condition I also consider the trees overall vigor, canopy density, history of failure and extent of
decay. The tree in question is being considered for removal due to the damage being caused to
the driveway and gara�e foundation slab from tree roots, and the potential to cause even more
serious dama.ge to the residence.
The tree has a diameter of 23.4" when measured at four and a half feet from natural grade, and is
considered a Protected Tree as defined by the City of Cupertino's Municipal Code Chapter 14.18.
The Deodar Cedar is in Good condition, with foliage typical of the species and indicates normal
vitality. The structure is sound with no visible signs of decay. It does have a slight lean towards
the residence, most likely a phototropic lean due to competition from the Cvnphor tree in the
parking strip in front of the residence. I also observed that the tree is in a heavily irri�ated area
with more water and vegetation at the base of the tree that this species will normally tolerate. It is
my understanding that the tree was planted by you twenty five years ago as a memory tree and
that you thought it to be a Pine species all these years.
Vt�hile I strongly believe that trees are a valuable asset to a community and add value and other
benefits, there are times when the wrong species gets planted in the wrong location. Deodar
Cedar is a very large, fast grawing species that can grow to 80' with a 40' spread. Planted in a
small space it can quickly overpower the area. Male catkins produce prodigious amounts of
pollen that many that can be a real problem for a11ery sufferers.
The roots from this tree have caused major cracking in the driveway creating a tripping hazard.
Unfortunately, the tree was planted right on top of the sewer line running from the residence to
the street. I understand there is a history of major blockages due to roots in the sewer line. A
sewer clean out had to be installed at the street side,just a few feet from the trunk of the tree.
You indicated that the City has to come every year to clean out the sewer line. There is atso a
crack in the garage foundation slab caused by the tree roots.
Due to the damage being caused by the tree's roots to the existing infrastruture, the sewer utility
and the potential to cause damage to the foundation of the existing residence, I recommend that
the tree be removed. It is definitrely the wrong tree in the wrong place. The vigorus root system
of this species will only continue to cause more extensive damage as the tree matures.
Should the tree be removed, grinding the stump and replanting in the same location is not feasible
due to the sewer line being under the trunk. The City of Cupertino rec�uires tree replacement as a
condition of approval for removing a Protected Tree. Chapter 14.18.220, Tree Replacement, has
a provision that if a replacement tree can not reasonably be planted on the subject property, an
in-lieu tree replacement fee can be paid to the City's tree fund to "Add or replace trees on public
property in the vicinity of the subject property". There is an empty planting strip in front of the
property adjacent to the subject property. I propose that the replacement tree(s}be planted in this
location. There is not a good planting site on the subject property to plant another large crowning
tree. I feel there would be added benefit to the neighborhood if the bare planting strip could he
considered for the replacement planting site. There are a number of Camphor, Pistache and Crepe
Myrtles planted along Erin Way. I propose that the replacement trees be one 24" box Camphor,
Cinr7amomrcm camphora, and one 24" box Chinese Pistache,PISlQC1CX Cj11)1811S1S.

DISCLOSURE STATEMENT
Arborists are tree specialists who use their education, knowledge, training and experience to
examine trees. They recommend measures to enhance the beauty and health of trees and attempt
to reduce the risk of living near trees. Clients ma.y choose to accept or disregard the
recommendarions of the arborist or seek additional advice.

Trees are living organisms that fail in ways we do not fully understand. Conditions aze often
hidden within:trees and below grouncl. Arborists cannot guarantee that a tree will be healthy or
safe under all circumstances or for a specified period of time. Likewise, remedial treatments
cannot be guaranteed.
Treatment, pruning, a,nd removal of trees may involve considerations beyond the scope of the
arbonst's services such as property boundaries, property ownership, site lines, disputes between
neighbors, and other issues. Arborists cannot take such considerations into accaunt unless
complete and accurate information is disclosed to the arborist. An arborist should then be
expected to reasonably rely upon the completeness and accuracy of the information provided.
