(McClellan Square) ORAL COMMUNICATION: None CONSENT CALENDAR: None OLD BUSINESS: None NEW BUSINESS: PUBLIC HEARING: Application No. (s): Applicant: Location: 08-ASA-01 Cupertino Community Services Vista Drive Architectural and site review for design details of an approved housing development, related to railings, eaves and entries. Design Review Committee decision final unless appealed. Staff Presentation: Vera Gil, Senior Planner, gave a brief history of the project. Larry Cannon, Architectural Consultant, reviewed the details and feels that the project is an appropriate design for the current building. Staff recommends approval of the project. This project will also be placed on the April 9, 2001 Planning Commission consent calendar. Rick Williams, Van Meter Williams Pollack, stated that he brought in some additional color photos to help explain the project. Commissioner Chen moved to approve 08-ASA-01. MOTION: SECOND: ABSENT: ABSTAIN: VOTE: Commissioner Chen moved for postponement Chairperson Corr none none Passed 2 - 0 Application No. (s): Applicant: Location: 04-R-01 Brad O'Donnell 10255 Hillcrest Avenue Design review for a new 4,949 square foot residence for an exception where the second floor exceeds 35 % of the first floor. Design Review Committee decision final unless appealed Staff Presentation: Peter Gilli, Associate Planner, explained that this house could easily be classified as a single story house with a below grade garage. However, the basement is exposed but the ordinance is not flexible enough to make that distinction. He described that from three sides of the property this will look like a single story house. From one side of the property line you can see a sub-surface garage and that makes a two-story wall plane. Because of that, this is considered a two-story house and meets the exception. Due to the special circumstances, staffbelieves that the findings on the exception can be easily made. Mr. Gilli went on to say that are other issues that may impact neighbors regarding drainage and the improvements to the end of Hillcrest Avenue. However, these issues can not be addressed by the Design Review Committee and should be forwarded to the Public Works Department at the building permit stage. The applicant is in negotiations to get an easement over a neighboring property for the drainage issue. For fire access, an improvement needs to be made at the end of Hillcrest so the Fire Department can get in and out. This all must be addressed before obtaining a building permit. The Public Works Department is working with the applicant to address these issues in addition to the cedar tree that could be located in the middle of the proposed turn around. Chairperson Corr summed up the staff presentation and reiterated that the heating was only for the design of the house. All other requests need to be addressed to the Public Works Department. Commissioner Chen asked Mr. Gilli to explain the standard deck exception in relation to this project and also the second story offsets. Tony Jeans, T.H.I.S. Design & Development, explained how his company arrived at the design of this project. He also touched on the subject of drainage and feels that they have come up with a very good proposal. Drainage will not be an issue, but an improvement to the existing situation. Mr. Jeans is very appreciative with all of the neighbors' cooperation, and will continue to work together with staff, Central Fire and the neighbors. They are prepared to do any reasonable improvements at the end of the street. Chairperson Corr and Mr. Jeans talked about visibility from the valley floor and other angles. Lourdes Smith, 10221 Hillcrest, stated her concerns regarding the turnaround at the end of the street and the cedar tree on the their property. She and her husband, Steve Smith, have not reached an acceptable compromise that meets the needs of all parties and since they own the property in question, they do not currently give permission or agree with any of the proposed options for the turnaround. They would like to continue working towards a solution. Heidi Lipp, 10201 Hillcrest, is in favor of keeping the cedar tree. She was concerned that the project was not referred to the architectural consultant and asked the committee if that was normal. Chairperson Corr responded that it is not unusual, however, referring a project to the architectural consultant is something the city often does, but is not required. Zorka King, 10181 Hillcrest, stated that her mother gave the cedar seedling to the Gasich family. She would like to see the tree saved. Linda Wegner, 10200 Hillcrest, is not impacted by the changes but like to see the cedar tree saved. She stated that the entire neighborhood likes the darkness of the street and asked if the streetlight at the stated property was going to be removed. Mr. Gilli recommended that this question should be directed to the Public Works Department. Gordon Westwood, 10297 Vista Knoll Boulevard, had concerns about water drainage coming off Hillcrest onto Vista Knoll. Jason Bentley, 10210 Alpine Drive #3, stated that he would like to know more about the property line screening for privacy issues. Tony Jeans responded that they have not come to a decision regarding the property line screening, however they will replace the fence. They are waiting for all neighbor input and are very flexible. Mr. Gilli spoke briefly about the privacy issues regarding this project. Mr. Jeans would like to save the cedar tree and will be working with the fire department to come up with an acceptable plan. Anything further would need to be directed to the Public Works Department, who would also like to see the cedar tree saved. Commissioner Chen moved to approve 04-R-01.
