Design Review Committee decision final unless appealed
Staff Presentation: Peter Gilli, Associate Planner, stated that staff recommends adding
two conditions requiring the applicant to install an 8-foot fence along the property line if
the neighbor at Newcastle signs a statement agreeing to that. Regarding privacy
protection, the ordinance also allows two neighbors to agree on the matter in which
privacy protection is worked out. If the same neighbor provides a waiver of privacy
protection with a diagram or statement as to what the modified privacy protection is
going to be, the applicant can waive the code and can install the secondary screening if
agreed upon.
Gary Albright, applicant, read a statement addressing concerns from the neighbors from
the previous Design Review Committee.
Lawrence Kahle, architect, presented an expanded side section showing the windows and
the line of sight.
Robert Davis, friend of Sharon Heinz, stated that he drew the drawings of the cone of
vision and the proposed landscape. He feels that the amount that Mr. Albright is offering
to Ms. Heinz for the additional screening is not adequate and is concerned about the cost
of substantial plants. Chairperson Corr and Mr. Gilli discussed the privacy protection
ordinance in brief. It was a mutual understanding that the building permit couldn't be
issued until the applicant provided either plans that conformed to the privacy ordinance
or a waiver from the affected neighbor.
Dan Green, 7630 Waterford Drive, feels that although the proposed house will be very
large, it will fit into the neighborhood very well. The only concern that Mr. Green has is
in regard to the exterior paint color and hopes that it will be similar to the existing homes.
Commissioner Chen moved to approve 06-R-01 with the added conditions.

Staff Presentation: Ciddy Wordell, City Planner, gave a brief overview of the project.
Staff has reviewed the landscape plan and feels that the screening is adequate. The only
concern was the phasing issue regarding the foundation. Staff recommends approval
with the condition stating that the building permit shall be issued for the entire second
unit, not for phased construction.
Minh Lc, applicant, explained that it would be cost effective to construct the guesthouse
in phases. He is currently building on his property and the people who install the
foundation are already there. If the foundation was already installed, he could begin
putting in some of the landscaping. The two-year approval could be adequate. However
Mr. Le will re-apply if necessary.
