Sign exception to have additional walls and to have projecting signs rather than signs parallel to the wall. Postponed from the May 16, 2001 meeting. Design Review Committee decision final unless appealed Staff Presentation: Peter Gilli, Associate Planner, gave a brief summary of the project. There was a concern regarding the south elevation, where the underground parking was to be located. At the time this area looked blank and the applicant has added the base material throughout the interior and will be adding latticework up on the walls as stated in the conditions, addressing the elevation concern. The trash facility has been amended to include a trash compactor. Both public works and staff have reviewed this and believe that it is adequate to serve the development. The Commission asked that the color of the building be lightened a bit and that has been reflected in the rendering. There was a concern with the garage air vents, which have subsequently been removed because they didn't need to be included anymore. Mr. Gilli explained the issues with the special paving materials as stated in the report: the driveways will have special paving but will not be pervious and the parking stalls and all of the walkways will be a pervious material. There will be a double row of trees on Stevens Creek. The Heart of the City allows for developers to only have a single row; however staff feels very strongly about framing the street with landscaping and feels that the double row on Stevens Creek is very important. There is also a double row along Blaney that was conditioned by the Planning Commission. Mr. Gilli discussed the lighting for the project and the sign exception. Chairperson Corr stated that the Planning Commission was concerned about the breezeway looking blank. Mr. Gilli explained that at that time this project went to the Planning Commission, the renderings appeared to be blank. However, the applicant always intended to have details. At the City Council meeting, the applicant showed an updated rendering showing the columns to be the end of the breezeway. There will be storefronts with doors, base material finish and one side will have the elevator and the other will have a directory board. Commissioner Chen moved to approve 12-ASA-01, 04-EXC-01. Stelling Road Architectural and site approval for an approximately 2,300 square foot addition to an existing church building. Design Review Committee June 6, 2001 Design Review Committee decision final unless appealed Staff Presentation: Ciddy Wordell, City Planner, briefly summarized the project. Staff asked to have additional landscaping along the side. Since the report was completed, staff and the applicant agree that there should be additional landscaping in the front, amending the condition to say additional landscaping in front. This would include a double row of trees in the front and additional trees in the parking space area. Staff recommends approval with the amended condition. Jack Ross, NAI Architects, agreed. Commissioner Chen moved to approve 13-ASA-01 with the additional landscaping as recommended by the staff. Variance to reduce the side setback of a second story deck from 15 feet to 10 feet for a new two-story residence on a comer lot. (Sherman Tuan) Southside of Kirwin Lane, opposite Lonna Way Design review of a new, two-story single-family residence with a floor area ratio of 45% and a second story deck exception. Design Review Committee decision final unless appealed Staff Presentation: Mr. Gilli gave a little background regarding the two Kirwin Lane properties. This project is being built between two two-story homes and staff recommends approval with no changes. Larry Cannon, Architectural Consultant, had a chance to review the two applications, and had no suggestions on improving the house. He felt they were both designed to be very sensitive to the neighborhood. The house in 09-R-01 meets all the ordinance requirements and because it is going to be between two two-story houses, there is not as much ora need for transition. The second story deck that is being proposed is facing to the rear, that being Regnart Creek. Beyond Regnart Creek are more single-family homes. There will be privacy protection on the rear property line and also along the side where a current project is under construction. The new owners of the homes would be responsible for putting landscaping in between the two homes. Staff recommends approval with no modifications. Commissioner Chen asked about the lot line adjustment, the size of the new lots and the how it compares to the neighborhood. Mr. Gilli stated that the new lots are about 7,500 square feet and that matches the properties to the west. The lots to the east are about 10,000 square feet. Chairperson Corr had a concern about the decks on the side of the houses being deck to deck and the impending privacy issue. Mr. Corr would like to see some privacy screening installed from the beginning rather than leave to the future owners. Mr. Gilli suggested that the committee can condition that privacy protection be provided on one or both sites to screen the balcony regardless ifa waiver is provided or not. Staff also needs to add to this approval that the deck must have a side setback of 15 feet. Currently, the side setback is 10 feet and this will apply for both properties. Staff would like to request this additional condition. Fred Fallah, representing the architects, stated that these issues could be revised. Fred, Lonna Lane, was interested to find out if there were any variances on this project, especially regarding chimneys and the five-foot setback. Mr. Gilli explained that the chimney is considered an architectural feature and not part of the house. Therefore, the chimney is allowed to encroach into the setback no more than two feet. The fire department requires a three-foot clearance. There was further discussion regarding chimneys in general. ]~es~gn ]~ev'~ew ~omm'~ee June 6, 2001 Chairperson Corr stated that the suggested additional conditions be: 1. addressing the balcony and the privacy screening and 2. that the deck have a side setback of 15 feet. Commissioner Chen agreed with these two additional conditions. They further agreed to add condition #2 on both properties. Commissioner Chen moved to approve 09-R-01 as amended for the deck privacy and the deck setback of 15 feet. (Sherman Tuan) Southside of Kirwin Lane, opposite Lonna Way Design review of a new, two-story single-family residence with a floor area ratio of 45% and a second story deck exception. Design Review Committee decision final unless appealed Staff Presentation: Mr. Gilli explained that this application is much like the project before. The floor plan is almost identical, however, the architect has worked considerably to make the appearance from the street look like two distinct houses. This is something that architectural consultant applauded. The entry way was designed much the neighboring single story house. This house meets all of the ordinance requirements except the side setback on the deck. Staff recommends that a condition be added to the plan be amended before building permit is issued to have a side setback of 15 feet for the second story deck on the side. Issues with the privacy protection as discussed should be added as a condition. Staff has additional concerns with this residence because the neighbor to the west is a single-story house and not a two-story. On the right elevation, the second story section, there are three windows. The larger window being in a walk-in closet, the second over the toilet in a bathroom and the third over a bathtub. These windows are not essential or required for egress. Staff recommends that they be adjusted either to have a sill height of 5 feet or be obscured and non-openable. In condition #2, the second item is to modify the second story windows on the right the elevation by making them obscure and non-openable or removing them and the sill height at least 5 feet. This would make a window for ventilation only. The other concern staff has is that the right elevation has a taller single-story wall height. The wall height should be lowered and if high ceilings are desired, then the applicant should have a vaulted ceiling. This can trim off about 2 feet of the vertical wall visible to the neighbor. Condition #2, part 1, asks the applicant to lower the eve line to match the porch. Staffrecommends approval based on the amended and additional conditions. Deslgn Revlew Commlttee June 6, 2001 Sherman Tuan, applicant, agrees with staff's recommendation or using obscure glass. However, Mr. Tuan would like to see the window next to the water closet remain operable and he will reduce the size of the window to have a sill height of 5 feet. Staff finds this to be acceptable. Sheila Hayhurst, 7508 Kirwin Lane, is concerned about privacy issues with the windows being opposite of her master bedroom window and son's bedroom window. Another privacy issue is with the second story deck overlooking her backyard. Mr. Gilli asked Mr. Tuan if it would be agreeable to add a condition that the trees along the westerly property line be installed prior to construction. Mr. Tuan is concerned that the trees would be destroyed during construction, but would agree to plant larger trees after construction. Discussion continued regarding the trees and the obscure window glass. Fred, Lonna Lane, questioned if there were any variances on this application. Mr. Gilli stated that this application was basically identical to the previous application, including the chimney. Discussion continued regarding trees for privacy protection. Mr. Gilli encouraged neighbors to review some of the books that the planning staffhad to get more information about how the trees grow and their root structure. The ordinance allows the applicant to choose whatever trees that are on the list for privacy protection. Mr. Gilli suggested adding to the condition to state that affected neighbor may choose the privacy screening materials from the approved privacy-screening list. If the affected neighbor does not select the screening prior to building permit issuance, then the applicant may use the privacy screening materials on the approved plan set. Commissioner Chen moved to approve 10-R-01 with the amended conditions.
