Variance to reduce the side setback of a second story deck from 15 feet to 10 feet for a new two-story residence on a comer lot. Design Review Committee decision final unless appealed Postponed from the June 6, 2001 meeting. Staff Presentation: Peter Gilli, Associate Planner, gave a brief overview regarding the project. Staff recommends the approval of the variance, pending the approval of the whole project. Staffbelieves that the exception for the second story deck should be approved because there are not any views into neighboring yards and that the deck has been designed to minimize the privacy intrusion. Regarding the exception to reduce the comer side setback for the second story deck, staff recommends that the applicant reduce the overhang by 1 foot in order to not have an exception. If the applicant removed 3 inches from the family room, master bedroom, kitchen and off the deck, it would add up to the foot needed. Any space lost could be relocated without an exception. Because it is so easy to not require the setback exception, staff is not recommending approval of the exception. In the case of the deck variance, moving the deck in in order to meet the side setback would dramatically affect the design, which staffbelieves is positive and recommends approval of the variance for the deck and to deny the setback exception. The overall house design is well designed. There a few minor modifications that staff is recommending in the resolution that being to adjust a section of the roof to reduce the mass. The other recommendation is that on the first floor, near the master bedroom by the bay window, the roof to be modified to provide at least a 1-foot overhang. Commissioner Chen asked Mr. Gilli about the neighbors' setbacks and the applicant's roof overhang. Discussion continued. Max Peyvan, architect, discussed the roof overhang and the project in general. Chairperson Corr asked Mr. Peyvan what the reason was for not being able to set the overhang back one-foot to avoid the exception. 3 Design Review Commlttee June 20, 2001 Phil Boyle, applicant, responded to Chairperson Corr. He would like to have as big of a backyard as possible to accommodate his large family and would like to see the exception approved for that reason. He believes the project is neighbor friendly and would rather not add a fence right along the property line. Many of his neighbors support the project. Paul Murgatroyd, 18750 Tilson Avenue, supports the exception to reduce the comer side setback. Laurie Beckett, 18750 Tilson Avenue, supports the design of the house. Brian Schutz, 10448 Johnson Avenue, as a homeowner, feels that the lots in general are small and he does not like the idea of having the size of the backyard reduced. Agrawal Aditya, 10473 Johnson Avenue, saw the structure being proposed and wanted to have a chance to look at the plans. He believes the house is well designed and will improve the general outlook on the neighborhood. Discussion continued regarding the hip roof on the east side of the second stow and the gable roof on the west side of the second stow. Mr. Gilli discussed the re-occurring issue of encroachment into setbacks on smaller lots. Discussion continued about setbacks regarding this project and properties in general in Rancho Rinconada. Commissioner Chen moved to approve 0S-R-01, 01-V-01 as presented in the Model Resolutions.
