Wolfe Road, Tantau Avenue and I-280. Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The decision is reported to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION Background The City Council approved a 3.4 million square foot office, research and development campus in October 2013 for Apple Inc. The project site is located in the area bound by Homestead Road on the north, N.Tantau Avenue on the east, I-280 to the south and N.Wolfe Road to the west. Since obtaining entitlements, Apple has been preparing plans to obtain building permits. During this process, Apple has already identified and obtained a Director's Minor Modification (DIR-2014-11) in April 2014 for certain refinements and changes to the Main Building, Valet Reception Center, Fitness Center, Tunnel at the Main Entrance and Main Parking Garage. Due to the size and complexity of the project, in addition and, in response to some of the changes previously made, the following minor refinements/changes are being proposed: Corporate Auditorium (Theater) ■ Building relocated approximately 14 feet 6 inches to the north and 13 feet 4 inches to the east ■ Increase the size of the structure to 124,250 sq. ft.The changes are due to: o Increase in width of the loading bay area by 13 feet; o Reduction in the back of house area by six (6) feet; o Addition of an approximately 200 s.f. Fire Control Center (FCC) adjacent to an egress staircase at the request of the Fire Department; and ❑ Refinements to the Floor Area Calculations for the structure since project approval. DIR-2014-29 Apple Campus 2—Theater,Fitness Center&Central Plant Yard August 25,2014 The increase in square footage of the structure does not change the overall development allocation for amenity or office space for the campus. The 4,250 sq. ft. increase in the size of the structure is offset by a previous reduction in the size of a Transit Center (DIR-2014-11) of 1,190 sq. ft. and a proposal to reduce the size of the Outdoor Food Stations and the Security Buildings for the campus by 3,060 sq.ft. ■ Modification to the configuration of three existing egress stairs and elimination of a fourth egress staircase; ■ Addition of two VIl'parking spaces adjacent to tunnel entrance to Auditorium (not counted toward total parking requirement of 10,980 spaces for project); and ■ Modifications to the reflectivity value of the glass consistent with the mitigation monitoring requirements of the Final EIR for the project. Central Plant Equi�pment Yard ■ Increase in the length of the equipment yard by 111 feet to 693 feet and in the width of the yard by up to 10 feet, so that it is 39 feet at its widest; ■ Relocation of: o Energy storage equipment from inside the Central Plan building to the yard; ❑ Two above ground diesel storage tanks, previously located outside and to the east of the equipment yard,400 feet to the west and inside the equipment yard; and ❑ Two diesel operated generators from the eastern end of the equipment yard approximately 500 feet to the west within the equipment yard. Fftness Center ■ Increase in parking count to 28 spaces — an increase of 3 spaces (counts toward the total parking requirement of 10,980 spaces for project); ■ Reduction in the size and quantity of the windows on site ■ Addition of one accessible and four standard parking spaces on the south side of the Central Plant for service use; ■ Adjustments to the office square footage within the building to conform to the previous reduction to the office square footage approved at the Fitness Center due to changes to the Main Building with the addition of a Security Operations Center (See DIR-2014-11); This change in the office sq. ft. is consistent with the definition of amenity space in the approved Development Agreement and, therefore,not considered to be permanent office sq. ft. ■ Allow dentistry as an approved use within the Fitness Center and limit it to preventative maintenance checkups and cleanings in conformance with the original intent of the "wellness uses" allowed at the Fitness Center; ■ Minor storm water and landscaping refinements; and ■ Modifications to the reflectivity value of the glass consistent with the mitigation monitoring requirements of the Final EIR for the project. 2 DIR-2014-29 Apple Campus 2—Theater,Fitness Center&Central Plant Yard August 25,2014 Environmental Review The modifications discussed above have been evaluated by LSA Associates, Inc. in their memo dated September 18, 2014 and the analysis indicates that the minor modifications that the applicant is seeking would not require major revisions to the Final EIR certified on October 15, 2013, due to new or substantially increased significant environmental effects. Furthermore, there have been no substantial changes with respect to the circumstances under which these minor modifications would be undertaken that would require major revisions of the Final EIR due to new or substantially increased significant environmental effects, and there has been no discovery of new information of substantial importance that would trigger or require major revisions to the Final EIR due to new or substantially increased significant environmental effects. 'The certified Final EIR adequately identifies all environmental effects and adequate mitigation measures for the proposed modifications to the previously approved project. Therefore, no subsequent or supplemental EIR is required prior to approval of the minor modifications to the Apple Campus 2 Project described above. ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modifications minor and approves the modifications with the following conditions: 1. APPROVED EXHIBITS This approval is based on the plan set prepared by Foster + Partners, Watry Design Inc., consisting of thirty (30) sheets comprising twenty six (26) sheets labeled "Summary of Changes, Corporate Auditorium," "Building Movement," P-17.00, A-TH-1751, P-17.01, A- TH-1748, "Summary of Changes, Outdoor Equipment Yard," P-14.00, A-CP-1261, "Summary of Changes, Corporate Fitness Center," P-20.01, A-FC-1749, P20.00, A-FC-1752, P-22.00, A-FC-2104 and 8 sheets labeled "Planned Area Calculation, Apple Campus 2 Specific Features, December 2013," "Planned Area Calculation, Apple Campus 2 Specific Features, August 2014," "Corporate Fitness Center, August 2014 — Update," "AC2-Theater Total Area," "B01 Total Area," "B02 Total Area," "B03 Total Area," and "B04 Total Area," except as may be modified by the conditions enumerated below. 2. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans in addition to all previous conditions of approval. 3. ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Minor errors may be corrected if in compliance with the assumptions and supporting data for this approval, subject to the review and approval of the Director of Community Development. However, misrepresentation of property data that is considered major by the Director of Community Development may require additional review by the Planning Commission and/or City Council. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 5. CONCURRENT APPROVAL CONDITIONS The conditions of approval contained in file nos. ASA-2011-14, DP-2011-04, TR-2011-39, TM-2011-03, U-2011-11, DIR-2014-11 shall be applicable to this approval except as amended. 6. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. Applicant and City shall use best efforts to select mutually agreeable legal counsel to defend such action, and Applicant shall pay all compensation for such legal counsel, following Applicant's receipt of invoices from City, together with reasonable supporting documentation. Such compensation shall include reasonable compensation paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. If Applicant and the City cannot in good faith agree on joint counsel, the City shall have the right to retain counsel of its own choosing, separate from Apple's litigation counsel. 10. NOTICE OF FEES,DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval is effective September 23, 2014. The fourteen calendar day appeal period will expire on October 7, 2014. Second Addendum to the Apple Campus 2 Project Final Environmental Impact Report(EIR), State Clearinghouse#2011082055 This memorandum,prepared pursuant to the California Environmental Quality Act(CEQA),is a Second Addendum to the certified Apple Campus 2 Project Final EIR(Final EIR).A previous,first Addendum to the Final EIIZ was adopted by the City on April 9,2014 in connection with the City's approval of minor modifications to the dimensions,geometry and footprint of several site buildings,a reduction in parking spaces, and the addition of a Security Operations Center.l This Second Addendum evaluates proposed minor modifications to the Corporate Auditorium,Corporate Fitness Center,and Central Plant Equipment Yard that are included in the Director's Minor Modification Application submitted to the City of Cupertino(City)by Apple Inc. (project sponsor)on September 10,2014.As discussed in this Second Addendum,the proposed minor modifications to the project would not result in significant environmental effects beyond those identified in the Final EIR. The Final EIR,2 which was certified on October 15,2013,evaluates the environmental impacts of development of a new campus for Apple on a 176-acre site bordered generally by East Homestead Road on the north,North Tantau Avenue on the east,Interstate 280(I-280)and The Hamptons apartments on the south,and North Wolfe Road on the west.The project would result in the demolition of all existing structures within the project site and the construction of 3,420,000 square feet of office,research,and development uses; 245,000 square feet of auditorium, fitness center,and valet parking reception uses; 92,000 square feet of utility plants; and parking and ancillary buildings. Significant envirorunental impacts would result in the following topical areas: Planning Policy;Land Use; Biological Resources;Cultural Resources; Geology, Soils,and Seismicity; Hydrology and Water Quality; Hazards and Hazardous Materials;Transportation and Circulation;Noise; Air Quality; and Public Services and Utilities. Substantial changes are proposed in the project which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; 2. Substantial changes occur with respect to the circumstances under which the project is under- taken which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects;or 3. New information of substantial importance,which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete was adopted,shows any of the following: (A) The project will have one or more significant effects not discussed in the previous EIR; (B) Significant effects previously examined will be substantially more severe than shown in the previous EIIZ; (C) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project,but the project proponents decline to adopt the mitigation measure or alternative; or (D) Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environ- ment,but the project proponents decline to adopt the mitigation measure or alternative. Pursuant to CEQA Guidelines Section 15164(e),the following discussion summarizes the minor modifications proposed as part of the Director's Minor Modification Application submitted on July 18, 2014,the less-than-significant impacts associated with these minor modifications, and the reasons for the City's conclusion that changes to the proposed project(and associated environmental effects) do not meet the conditions described in Section 15162 and 15163 calling for preparation of a Subsequent EIR or a Supplement to an EIR. A. MINOR MODIFICATIONS TO THE PROJECT The Director's Minor Modification Application identifies changes to the Corporate Auditorium involving the shifting of the building approximately 14 feet northwest,expansion of below-grade square footage by 4,250 gross square feet,the addition of a Fire Command Center,the subtraction of the northwestern egress staircase,and the addition of two parking stalls. Changes to the Corporate Fitness Center identified in the application include a reduction in office space use,a change from the proposed optometric consultation use to a dentistry use,the addition of three parking spaces,and the reduction in fenestration on the north side of the building. Changes to the Central Plant Equipment Yard identified in the application include an increase in the dimensions of the Equipment Yard,the relocation of back-up diesel generators and storage tanks from outside the yard enclosure to a location inside the Equipinent Yard,and the relocation of fuel cells from inside the Central Plant building to a location inside the Equipment Yard. Parking.Two parking stalls would be added near the entry to the access tunnel that leads to the exhibit space in the building.The below-grade stalls would be accessible from the ramp that leads to the loading bay of the Corporate Auditorium building(see Figure 3). This design modification to the building would not result in environmental impacts beyond those identified in the Final EIR.The Final EIR approved 10,980 parking spaces,and the first Addendum reduced the total number of parking spaces to be provided on the west side of the project to 10,958. However,the City understands that the applicant would ultimately provide a total of 10,980 parking spaces throughout the project site.The two additional spaces being added near the access tunnel are being provided in addition to the approved 10,980 parking spaces for the site. Therefore,the addition of two parking spaces at the Corporate Auditorium would not result in new or more severe impacts than were previously identified.The addition of two parking spaces near the entrance of the tunnel would not affect traffic flows or queuing because the new spaces are adjacent to the tunnel which would be only used to load exhibits into the building, and is not designated for through traffic.The slight increase in parking spaces to allow for parking for invited guests near the entrance to the auditorium would not incentivize driving such that traffic volumes generated by the project would increase substantially.The parking stalls would be below-grade,and would not compromise the visual character of the general area. d. Fire Command Center/Egress Stairs.In response to the Santa Clara County Fire Department's (SCCFD)request, a below-grade Fire Command Center(FCC)would be added adjacent to the egress stairs at the southeast corner of the building.The Auditorium's egress stair configuration has been modified and the northernmost egress stair has been eliminated(see Figure 4). These design modifications to the building would not result in environmental impacts beyond those identified in the Final EIR.The FCC would be an addition to the already-planned Corporate Audito- rium building, and thus would not introduce new construction activities or substantial areas of disturbance to the project site. The dimensions of the FCC would be approximately 14 feet 6 inches square, or 200 square feet.The construction of the FCC would result in 260 cubic yards less fill required for the site,however as described above the project sponsor would achieve a balanced site by adjusting cut and fill areas on the entire site and adding cut material to the berms of the site.The introduction of this new use would not increase the energy used by the project,and the increase in interior building space associated with the FCC would be offset by a reduction in another part of the project to maintain the total square footage approved for the site. Total site employment and traffic volumes would not change as a result the inclusion of the FCC. While project energy use could increase slightly,because energy on the site would be derived from on-site photovoltaics and fuel cells,in addition to renewable sources purchased froin third party providers, these minor modifications to the project would not be expected to significantly increase the greenhouse gas emissions generated by the project. The City's General Plan requires design approval from the SCCFD in the early stages of project design in order to ensure user safety during the operation of the project.Removal of the northern egress staircase has been approved by the SCCFD,and therefore the project design meets the requirements of the City.This minor modification to a portion of the site with very limited visibility from public viewpoints would not impact the visual character of the area as viewed from the public right of way but would improve the appearance of the building to users of the structure.Therefore, impacts associated with these changes in development would not result in environmental impacts beyond those identified in the Final EIR. 2. Corporate Fitness Center Several minor modifications to the Corporate Fitness Center are proposed.The proposed modifica- tions involve decreasing the allocation of office space use within the building,a change in an auxiliary use from optometry to dentistry,an increase in parking spaces from 25 to 28 stalls,and a reduction in windows on the north side of the building.The proposed modifications and the antici- pated less-than-significant impacts are described in detail below(see Figure 5). a. Decreased Office Space/Change in Use.The allocation of space to office uses has been modified to reflect a decrease from the previously proposed 11,000 square feet to 7,290 square feet. This reduction in the amount of office space reflects previous changes made to the project to add a security operations center to the Main Building(previously analyzed in the First Addendum to the Final EIR dated Apri14,2014).Additionally, one of the auxiliary uses previously proposed for optometric consulting would be changed,and would be used for dentistry instead. These design modifications to the building would not result in environmental impacts beyond those identified in the Final EIR. The change in use would not result in any environmental impacts,because the gross square footage of the Fitness Center building has been reduced to address previous design changes to the project.The design impacts would only affect Fitness Center users,and would therefore not result in any changes with regard to the Final EIR. b. Increased Parking.Three parking stalls have been added to the southern side of the parking lot which is adjacent to the Fitness Center thereby increasing the available parking at the Fitness Center from 25 spaces to 28 spaces.This design modification to the building would not result in environmental impacts beyond those identified in the Final EIR.As previously described, the Final EIR evaluated and approved 10,980 parking spaces; in the plans analyzed with the first Addendum to the Final EIR,this number was reduced to 10,958 spaces on the western portion of the project site.As stated previously,the City understands that the project proponent does not intend to reduce the total number of parking spaces in the project below 10,980 spaces. Additional design work is under way to ensure that the project provides the total number of spaces previously approved with the project. Taking into account the changes in parking spaces associated with the Corporate Auditoriuin, the total number of parking spaces on the site west of North Tantau Avenue would be increased by 5 spaces. The addition of three parking spaces would not result in traffic flow or queuing impacts that are more severe than those analyzed in the Final EIR.The slight increase in parking spaces would not incentivize driving such that traffic volumes generated by the project would increase substantially. The traffic stalls would be incorporated into a project area that is already disturbed by construction, and as such would not create additional construction impacts. Central Plant Equipment Yard Minor modifications would be made to the Central Plant Equipment Yard including the relocation of back-up diesel generators and storage tanks from outside the yard enclosure to inside the yard(the new location is approximately 380 feet to the west of the previous location),and the relocation of fuel cells to the Equipment Yard from the previously proposed location inside the Central Plant building. Additionally,the dimensions of the Equipment Yard have increased by approximately 10,000 square feet,from approximately 17,000 square feet to 27,000 square feet. Specifically,the yard dimensions would be modified from 582 feet long along the Fire Access Road to 693 feet in length, and from 29 feet wide to 39 feet wide,at its widest point(see Figure 6). As shown in Figure 6,fuel cells,energy storage equipment,were previously designed to be located inside the Central Plant building and are now proposed to be located inside the walled-in Equipment Yard, southeast of the proposed location for the diesel generators and adjacent to the southern boundary(along the I-280 right-of-way)of the project site,as shown on Figure 7.Two diesel storage tanks were previously designated to be located outside the yard enclosure,and are now proposed to be located inside the enlarged walled-in Equipment Yard. Three back-up diesel generators are proposed to be located approximately 380 feet to the west of the previously approved location,shown in Figure 6,and the proposed location of the generators,shown in Figure 7,is approximately 500 feet away from the closest sensitive receptors,The Hamptons apartment complex.The diesel generators and storage tanks would be used for back-up power only during utility outages. The less-than-significant emissions related to the use of fuel cells and diesel generators were evaluated in the Final EIR as part of the Health Risk Assessment(HRA)based upon their location relative to the nearest sensitive receptors.Although the back-up generators would be moved 380 feet closer to the The Hamptons apartment community(i.e., approximately 500 feet from The Hamptons),they are still far enough away that their proposed location would not create new or more significant impacts.This finding is based on revisions to the HRA which evaluated the new location of the generators(data results from the revised HRA is included in Appendix A). The revised HRA indicates the maximum cancer risk associated with the project would be 1.29 in 1 million which is well below the 10 in 1 million threshold,but higher than the 1.15 in 1 million identified in the Final EIR.The Chronic Hazard Index would be 0.386 which is below the threshold of 1,but higher than the Hazard Index of 0.302 that was identified in the Final EIR.The annual average PM2.5 concentration would be 0.019 µg/m3 which is below the threshold of 0.2,but higher than the concentration of 0.002µg/m3 that was identified in the Final EIR.Therefore,the proposed modifications to the Equipment Yard,and relocation of fuel cells,back-up diesel generators, and storage tanks, would not result in a significant increase in environmental impacts related to health risks compared to those identified in the Final EIR. The minor modifications and enlargement of the Equipment Yard would result in minor changes to the aesthetic appearance,but would not result in new significant impacts related to aesthetics as the wall around the yard would increase in size. This portion of the site would have limited visibility from I- 280,as shown in visual simulations in the Final EIR(see Figure V.B-9 in the Final EIR)that demon- strated that the above grade portion of the Central Plant Equipment Yard would not be visible due to the construction of a sound wall along the project's south boundary. 9/18/14(P:\COC1301 Apple MM�Products\Second Addendum\9-18-14 Second Addendum.docx) 1 1 i ;�� .�.;vi���.�,�ir: ��vc As discussed in the Final EIR,the closest sensitive noise receptors are approximately 500 feet away, and the project would retain the noise attenuating features.No new noise impacts are anticipated due to the proposed project modifications. Similarly,the design modifications would be a modification to the already-planned Central Plant Equipment Yard,and thus would not introduce new construction activities or substantial areas of disturbance to the project site. The proposed modifications would not impact transportation or circulation features of the campus,including the Fire Access Road.Therefore, these design modifications would not result in environmental impacts beyond those already identified in the Final EIR. B. COMPARISON TO THE CONDITIONS LISTED IN CEQA GUIDELINES SECTIONS 15162 AND 15163 The following discussion summarizes the reasons that a Subsequent EIR,pursuant to CEQA Guidelines Sections 15162 and 15163,is not required to evaluate the environmental effects of the currently-proposed project. 1. Substantial Changes to the Project For the reasons stated above,the proposed minor modifications to the project would not result in new significant environmental impacts beyond those identified in the Final EIR,would not substantially increase the severity of impacts identified in the Final EIR,and thus would not require major revisions to the Final EIR. Therefore,the proposed changes to the project would be minor refine- ments,not substantial changes,and an Addendum is the appropriate document to address these minor modifications rather than a Subsequent EIR or a Supplement to the Final EIR. 2. Substantial Changes in Circumstances Construction of the project is underway. Environmental conditions in and around the project site have not changed such that implementation of the proposed minor modifications to the project would result in new significant environmental effects or a substantial increase in the severity of environmental effects identified in the Final EIR,and thus would not require major revisions to the Final EIR. 3. New Information No new information of substantial importance,which was not known and could not have been known when the Final EIR was certified,has been identified which shows that the proposed minor modifica- tions to the project would be expected to result in: 1)new significant environmental effects not identified in the Final EIR; 2) substantially more severe environmental effects than shown in the Final EIR; 3)mitigation measures or alternatives previously determined to be infeasible would in fact be feasible and would substantially reduce one or more significant effects of the project,but the project sponsor declines to adopt the mitigation measure or alternative; or 4)mitigation measures or alterna- tives which are considerably different from those identified in the Final EIR would substantially reduce one or more significant effects of the project but the project sponsor declines to adopt the mitigation measure or alternative. C.
