Subject: Director's Minor Modification, DIR-2014-28, to a previously approved Architectural and Site
application (ASA-2011-17) to clarify the as-built height for a major tenant (Safeway) within a
shopping center (Homestead Square), located at 20620 Homestead Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar da s.
DISCUSSION
The applicant, Jeff Oparowski, representing the Sobrato Organization, is requesting that the record
reflect the as-built height of the previously approved New Major 3 tenant space (20620 Homestead
Road) at the Homestead Square Shopping Center.
Previous City Approvals
The City Council originally approved the Use Permit (U-2009-08) and Architectural and Site Approval
(ASA-2009-08) in May 2010 for the shopping center's expansion. Following this, an Architectural and
Site Approval (ASA-2011-17) was approved by the Planning Commission in October 2011 to allow
changes to the overall architecture of the project. In December 2012, the Planning Commission
approved a Use Permit (U-2012-05) to allow 24-operations for a grocery store (Safeway) in the New
Major 3 tenant space.
Height Increase
The previously approved Architectural and Site Approval (ASA-2011-17) specified a 37 foot-10 inch
maximum height (measured to top of building towers) for the tenant space. However, subsequent
structural framing requirements increased the height of the building tower roof peaks to 40 feet
(increase of two feet, two inches over original approval).
The design and appearance of the building fa�ade remains the same as the original approval, and given
the building towers' distance from the adjoining residential area, the increase is visually negligible.
Moreover, the General Plan allows a maximum height of 45 feet.

ACTION
The Director of Community Development deems the modification minor and approves the project with
the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits titled: "Planning Submittal, Homestead Road & North De Anza Blvd,
Cupertino, CA 95014," prepared by ArcTec, received July 30, 2014, and consisting of three sheets
labeled A2R, A3R, and A4.01, except as may be amended by the conditions contained in this
resolution.
2. PREVIOUS CONDITIONS OF APPROVAL
The following previous conditions of approval for the project site shall remain in effect:
U-2009-08,ASA-2009-08,U-2012-05
• All conditions
ASA-2011-17
• All conditions, except that the approved elevations for "New Major 3" or Safeway shall be
superseded by this approval.
3. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to
the proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
4. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certaul fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.

This approval of the modification is effective August 7, 2014. The fourteen calendar day appeal period
will expire on August 21, 2014.
