The project site also has moderately steep natural hillside topography where the neighboring property to the southwest (11206 Mount Crest Drive) is approximately 20 feet higher in elevation than the project site. The only flat portions onsite are the driveway, patio/deck, and building pad areas. DISCUSSION: Application Requests The applicant, Diony T. Bugay, representing the property owners, Sandeep and Toral Chopra, is proposing to construct a 1,564-square foot first floor and 311-square foot second floor addition to an existing 4,080-square foot, two-story single-family residence with two, new second floor balconies on the front side of the residence. The project also entails a complete remodel of the interior of the existing residence and a new 160-square foot covered porch and 1,345-square foot covered deck on the first floor. The project requires an R1 Exception for the portion of the first floor addition proposed to have a 17- foot, six-inch front yard setback. The project also requires a Two-Story Permit for the second floor addition and a Minor Residential Permit for the new second floor balconies. Typically, the Director of Community Development approves Two-Story Permit and Minor Residential Permit projects without a public hearing. The Design Review Committee is reviewing all applications concurrently since an R1 Exception is requested. Front Yard Setback Exception The project is located in the R1-20 zone, which requires a 20-foot first floor front yard setback [Section 19.28.070 (E)(1)(a) of the R1 Ordinance]. The intent of this requirement is to ensure harmonious building alignment of homes along the street, maintain separation/privacy between residential properties, accommodate adequate parking onsite, and minimize the visual impact of front-entering (or front-loading) garages from the street. Section 19.28.070 (E)(1)(b) of the R1 Ordinance allows a 15-foot front yard setback for side-loading garages. Side-loading garages are allowed a reduced setback since EXC-2014-08,R-2014-23, 11204 Mount Crest Drive August 7,2014 RM-2014-17 Page 4 the driveway design allows sufficient space for vehicles to park entirely onsite, and the side-facing orientation reduces the visibility of the garage door from the street. The project site is a flag lot, and the existing home is located approximately 180 feet from Mount Crest Drive. In accordance with the City's Zoning Code, the west lot line behind 11206 Mount Crest Drive is considered the front lot line for the purposes of ineasuring the front yard setback since that is the lot line most parallel to and nearest the street. The applicant is requesting a first floor front yard setback of 17 feet, six inches in order to accommodate a new two-car garage on the west side of the home (See Attachment 1 for the applicant's justification letter). Approximately 15 square feet of the 488-square foot garage encroaches up to two feet, six inches into the required front yard setback. The rest of the proposed additions are set back the required distances. The project site is unique as compared to other flag lots in that the front lot line slants at an approximate 40-degree angle into the main buildable area of the property. As shown on the plans, the orientation of the existing residence is not parallel with the front lot line. The existing residence is less than 38 feet from the front lot line as measured from the nearest point. Therefore, a standard garage (20' x 20') could not be accommodated parallel to the front lot line without encroaching into the required 20-foot setback requirement. As noted above, the Zoning Code allows a reduced front yard setback for side-loading garages. While access to the proposed garage would be from the front, the garage would visually function as a side- loading garage in that the garage door would not be visible from the street or the adjacent neighbor to the front, and there would be sufficient space to park vehicles onsite. Also, given the home is on a flag lot and located more than 150 feet from the street, the garage door would not be visible from the public right-of-way and the reduced setback would not create any building alignment issues along the street. 'The proposed garage would be located behind the property to the southwest (11206 Mount Crest Drive), which is approximately 20 feet in elevation above the project site and is screened from the project site by several existing mature trees. While the proposed addition would encroach into the required front yard setback, the intent of the setback requirement is addressed since visual separation and privacy would still be afforded to the neighboring property given the significant grade difference and existing mature trees. Staff supports the exception request because of the unique shape of the flag lot and configuration/location of the existing residence. The proposed garage would not be visible from the street and would not infringe on the privacy of the neighboring property. Privac�Protection Five, single-family residential properties would be affected by views from new/expanded second floor windows and balconies. To mitigate potential impacts and the visual mass and bulk of new two-story homes and additions, the R1 Ordinance requires trees and/ar shrubs to be planted in an area bounded by a thirty-degree angle on each side of a second story window and balcony. Given there are many existing mature trees on the property, the City's Consulting Arborist visited the site to confirm whether EXC-2014-08, R-2014-23, 11204 Mount Crest Drive August 7,2014 RM-2014-17 Page 5 they provide adequate screening (See Attachment 2 for the report). The arborist found that the existing trees within the view cone areas range from dense to sparse, providing only a partial screen. Subsequently, the arborist recommends several additional screening trees to be planted in order to address the privacy screening requirements of the R1 Ordinance. The applicant's privacy planting plan fully implements the arboris�s recommendations, and an ISA-certified arborist will be required to verify that the new trees have been planted properly and according to the approved plan prior to final occupancy. Geologic/Geotechnical Review The project site is located in a Fault Rupture Geologic Hazard Zone as identified in the General Plan. The City's Geologic Consultant has peer-reviewed the geologic and geotechnical reports prepared by the applicant's consultants, and concluded that the project is feasible and has no objections to the proposed additions based on the manner of construction proposed by the applicant's consultants (See Attachment 3 for the peer review letter). The City's Geologic Consultant recommends that the applicant's consultant recommendations be incorparated into the construction plans. Additionally, the applicant's consultant shall review and approve all geotechnical aspects of the project construction to ensure that the recommendations have been properly incorporated. The City Geologic Consultant's recommendations are incorporated as conditions of approval in the draft resolutions. Approval Findings Staff recommends that the Design Review Committee approve the project based on the following R1 Exception, Two-Story Permit, and Minor Residential Permit findings (Section 19.28.140 E, B and A, respectively): R1 Exce�tion: The literal enforcement of the R1 Ordinance will result in restrictions inconsistent with the spirit and intent of this chapter. The project is consistent with the intent of the R1 Ordinance in that it minimizes visual impacts to adjacent residential properties and is compatible with other homes in the neighborhood. T'he intent of the front yard setback requirement is addressed as the proposed garage would visually function as a side-loading garage which is allowed to be set back 15 feet from the front lot line. Also, the garage and garage door would not be visible from the street, required parking would be accommodated onsite, and visual separation and privacy would still be afforded to the neighboring property given the significant grade difference and existing mature trees. The proposed development will not be injurious to property or improvements in the area, nor be detrimental to the public safety, health, and welfare. The project would not be detrimental or injurious to property or improvements in the vicinity, and would not be detrimental to the public health, safety, or welfare because the project is consistent with the intent of the R1 Ordinance, has been designed with respect to the site's geologic conditions and EXC-2014-08,R-2014-23, 11204 Mount Crest Drive August 7,2014 RM-2014-17 Page 6 topography, provides plantings to minimize privacy impacts, and has been situated to minimize disturbance to existing hillside areas. The exception to be granted is one that will require the least modification of the prescribed design regulations and the minimum variance that will accomplish the purpose. Due to the orientation of the front lot line and the location of the existing residence, the strict application of the prescribed front yard setback requirement would preclude a standard garage to be constructed where the driveway is currently located. The setback exception request is only for 15 square feet of the proposed 488-square foot garage. The remainder of the proposed additions are set back in accordance with the required distances. The intent of the ordinance is met since the exception would still allow visual separation and privacy for neighboring properties and would not create any building alignment issues along the street since the garage would not be visible from the public right-of-way. Also, the proposed garage visually functions as a side-loading garage which is allowed to be 15-feet from the front lot line. The proposed exception will not result in significant visual impact as viewed from abutting properties. The granting of a front yard setback exception is not anticipated to create adverse visual impacts since it is only for a 15-square foot portion of the garage, while the rest of the proposed additions are set back at the distances required by the Zoning Code. The project will include privacy plantings in order to screen potential views from the proposed second floor windows and balconies. Two-Stor�Permit and Minor Residential Permit: The project is consistent with the Cupertino General Plan, any applicable specific plans, zoning ordinance and the purposes of this title. The project is consistent with the General Plan and zoning ordinance, except far the R1 Exception requested. The project is not located in a specific plan area. As noted above, strict application of the R1 front yard setback requirement would preclude a standard garage to be constructed where the driveway is currently located due to the orientation of the front lot line and the location of the existing residence. The granting of the permit will not result in a condition that is detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety or welfare. See the same R1 Exception finding above. The project is harmonious in scale and design with the general neighborhood. The proposed project is harmonious in scale and design with the general neighborhood. The project's building form, height, roof pitches, materials, and setbacks are consistent with the predominant neighborhood pattern of homes in the neighborhood. Adverse visual impacts on adjoining properties have been reasonably mitigated. The project design is consistent with the City's Single-Family Residential Design Guidelines, which are intended to minimize adverse visual impacts to neighboring properties. Potential privacy impacts are addressed by providing a combination of new privacy plantings and protecting existing mature trees. Both the new and existing trees used for privacy screening will be required to be recorded on the property, unless waived by the affected neighboring property owners. CONCLUSION Staff recommends approval of the project since the project and conditions of approval address all concerns related to the proposed project and all of the findings for approval of the proposed project, consistent with Chapter 19.28 of the Cupertino Municipal Code, may be made.
