Subject: Director's Minor Modification (DIR-2014-12) to allow the installation of a new
wireless communications facility consisting of 12 flush mounted panel antennas and
associated base equipment at 10123 N. Wolfe Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND
Pamela Nobel, NSA Wireless, is proposing to install twelve flush mounted panel
antennas and associated base equipment for Verizon Wireless at the rooftop of the AMC
Movie Theater at the Vallco Shopping Mall at 10123 N. Wolfe Road.
The twelve panel antennas are proposed to be flush mounted and painted to match to
the building's parapet wall. Three antennas are proposed on the north (parking garage-
facing) elevation; three are proposed on the west (parking garage-facing) elevation;
three are proposed on the east (N. Wolfe Rd.-facing) elevation; and three are proposed
on the south (Stevens Creek Blvd.-facing) elevation.

All panel antennas will be painted to match the parapet wall. One equipment cabinet
will be mounted on a new 14'x15' equipment area in the center of the rooftop, screened
by a parapet wall.
DISCUSSION
The proposed wireless facility complies with the City's Wireless Communications
Facilities Ordinance (CMC chapter 19.136). The antennas are proposed to be vertically
mounted to the building, which exempts them from the 55 foot height restriction. The
proposed wireless facility is located at least 75 feet from the nearest residentially zoned
property, being approximately 560 feet from the single-family residential neighborhood
on Denison Avenue; approximately 400 feet from a single-family residential property
on Amherst Drive; approximately 220 feet from a multi-family mixed use development
(Rose Bowl) at 10088 N. Wolfe Road; and approximately 700 feet from a multi-family
development (Metropolitan) at 10505 Stevens Creek Boulevard.
The proposed wireless facility is also consistent with the relevant policies contained in
the City's Wireless Facilities Master Plan. The plan prefers that wireless facilities be
located on existing non-residential buildings, one of which was identified as the AMC
Theater/Vallco Shopping Center building on the candidate locations map. All antennas

will be painted to match the existing building as depicted in the photo simulations
(Attachment B). The proposed equipment area will be located behind the parapet wall
and will not be visible from the public right of way.
ACTION
In accordance with Cupertino Municipal Code Section 19.164, the Director of
Community Development deems the modification minor and approves the
modification described in the plan set titled: "Verizon Wireless Vallco Shopping Center
181396" prepared by Delta Groups Engineering, Inc., and consisting of eleven (11)
sheets labeled T1, C-1 through C-3, and A1 through A7 last revised 07/15/14 and
stamped as received 7/16/2014, except as may be modified by the conditions
enumerated below.
1) BUILDING PERMIT REQUIRED
This approval does not constitute building permit approval; a separate building
permit is required.
2) ACCURACY OF THE PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data
including but not limited to property boundary locations, building setbacks,
property size, building square footage, any relevant easements and/or
construction records. Any misrepresentation of any property data may invalidate
this approval and require additional review.
3) CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies
with regard to the proposed project for additional conditions and requirements.
Any misrepresentation of any submitted data may invalidate an approval by the
Community Development Department.
4) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.

5) RADIO FREQUENCY ENERGY EXPOSURE
The independent and cumulative emissions for the proposed facilities shall meet
Federal Communications Commission regulations and guidelines to prevent
public exposures to radio frequency energy emissions that are in excess of
federal safety standards. Any cautionary signage should be in multiple
languages, including English and Spanish.
6) ABANDONMENT
In the event the antennas, associated equipment, or any portion of the facility
thereof, are left unused for a period of 18 months the property owner or
applicant shall bear the entire cost to remove the subject equipment and to
restore the site to its previous condition.
7) PERMIT EXPIRATION
In accordance with Government Code Section 65964, this permit is granted for a
period of ten (10) years, expiring on July 28, 2024. Prior to the permit expiration,
the applicant may apply for a renewal of the permit, at which time the
Community Development Director may review the state of wireless
communication technologies to determine if the facility can be reduced in height,
size, or utilize better camouflage techniques.
This approval is effective July 28, 2014. The fourteen calendar day appeal period will
expire on August 11, 2014.

Introduction
Verizon Wireless is the largest wireless communications provider in the U.S. with more
than 27 million wireless voice and data customers. The coast-to-coast wireless provider
was formed by the combination of the U.S. wireless businesses of Bell Atlantic Corp. and
GTE Corp - now Verizon Communications (NYSE:VZ) - and Vodafone (NYSE and
LSE: VOD). The new company includes the assets of Bell Atlantic Mobile, AirTouch
Cellular, GTE Wireless and PrimeCo Personal Communications.
Verizon and its affiliates have acquired licenses from the Federal Communication
Commission ("FCC") and the CPUC. These licenses include Napa County, California.
The regional system operates under the name GTE Mobilnet of California Limited
Partnership, a California limited partnership, d/b/a Verizon Wireless, by Cellco
Partnership, its general partner.
A�plicant's Request
GTE Mobilnet of California Limited Partnership, a California limited partnership, d/b/a
Verizon Wireless formally requests pursuant to the City of Cupertino Wireless
Telecommunication Facilities Development Standard, approval of a Use Permit for the
installation a new unmanned telecommunications facility located at 10123 North Wolfe
Road in Cupertino CA.
Project Description �'
Pursuant to City of Cupertino Wireless Telecommunication Facilities Development
Standard, GTE Mobilnet of California Limited Partnership, a California limited
partnership, dba Verizon Wireless proposes to install an unmanned telecommunication
facility consisting of twelve new panel antennas flush mounted to the side walls of the
building and painted to match the rooftop fa�ade of the AMC building,with
equipment cabinets mounted to a new steel platform on the center of the roof behind
a new screen.
In accordance with the City of Cupertino's Municipal Code Section 19.136.060 that
allows for well designed flush mounted antennas integrated on an existing building
fa�ade, Verizon has worked with city planner to evaluate, investigate and determine the
least obtrusive and aesthetically designed installation. Verizon initially proposed for the
antennas to be mounted behind screens to match the previous City of Cupertino approved
installation by Clearwire/Sprint, however, upon review of Verizon's application, planner
requested alternative design options. City Planner, property owner representative, and

Verizon's construction team met at the site to evaluate possible alternative design
options. The following options were evaluated and investigated:
1) Locate Verizon antennas within Clearwire's screened boxes —Evaluation
Response: No room for Verizon antennas within existing carriers lease space
2) Place new screen boxes over Verizon's flush mounted antennas —Evaluation
Response: Original application design request that matched a previous approved
carrier design was rejected by planner and Verizon was asked to explore
additional options.
3) Extend Existing Walls to accommodate Verizon placement of antennas
behind newly constructed walls —Evaluation Result: Verizon would need to
penetrate the roof and expose the beams below to tie into the existing beams to
support a new screen wall that would need to be structurally substantial to support
Verizon's antenna array and to be able to sustain wind load factor safety. This
design would require the theatre space below to shut down operations for a
minimum of two weeks for retrofit of existing structure. In contrast, Verizon was
able to strategically locate the equipment cabinets on the new steel platform, to be
set back from the edge of the building walis that is located over the Theatre
projection room areas that allow for opening this area with minimal interference
with the operations below due to the location. The equipment area will be fully
screened from public view.
4) Fiush Mounted, painted to match —Evaluation Response: This design is
consistent and complies with City of Cupertino Wireless Facilities Master 2003
Plan, Chapter 3, Policy 4-1 that sta.tes designs shall use the best available
camouflage technique to reduce intrusive and obtrusive visual impacts to the
"extent possible". Additionally, Verizon's proposed flush mounted design is
consistent with the Policy Section "Siting and Design Guidelines section 1.

Additionally, the proposed project conforms to the policy's preference for
locating on existing more than two story buildings located in non-residential
zones, Chapter 5, and is on the Map of potential existing facilities available.
Verizon's antennas will be flush mounted as close as possible to the existing
walls, with the RRU's placed behind the walls, and painted to blend and match
existing fa�ade. (Photos sims attached)
*Verizon will include a new stand-by 30KW diesel generator with a 132-gallon diesel
fuel tank on ground level parking lot. This generator will supply power in emergency
situations only. This is part of Verizon's homeland security initiative. Verizon wants the
entire network to be able to sustain itself in the event of blackout situations. The
generator shall meet all noise standards of the City of Cupertino.
1Vlaintenance
The facility will be unmanned and will be visited only monthly for routine maintenance.
The facility will emit no glare, odor or noise above acceptable levels, and will not have
any signage other than those required for identification as mandated by the FCC and
FAA, which are designed to protect public safety. To ensure structural integri�ty�4f the��

facility, the facility will be constructed and maintained in compliance with all federal,
state and local building codes and standards. In addition, each facility is monitored 24
hours a day, electronically for intrusion and environmental disruption. The facility will
also contain a sign identifying a 1-800 number to call in case of an emergency (manned
24 hours a day by Verizon employees) and identifying it as a Verizon facility. Verizon
will be in compliance with all FCC regulations regarding signage at the facility.
Need for Site and Location Justification
Wireless phone systems operate on a"grid" system, whereby overlapping "cells" mesh to
form a seamless wireless network. The technical criteria for establishing cell sites are
very exacting as to both the height and location of the telecommunication facility. Based
on a computerized engineering study, which takes into account, among other things, local
population density, traffic patterns, and topography, Verizon Wireless's RF engineers
have identified this location as being a necessary and appropriate location for a cell site in
order to provide improved coverage and capaciiy along Stevens Creek Blvd, No. Wolfe
Road and the surrounding retail and new residential/office complexes in Cupertino.
Types of Services provided by applicant will include wireless, voice, and data to its
customers.

Radio Frequency
The proposed facility will be designed and constructed to meet applicable governmental
and industry safety standards. Verizon Wireless continues to comply with all FCC
governing construction requirements, technical standards, interFerence protection, power
limitations, and radio frequency standards. Any and all RF emissions are subject to the
exclusive jurisdiction of the FCC. (See EMF Evaluation dated January 31, 2014)
Standby_Generator for emergenc,y back up power s���
In order for Verizon to maintain the site's operational capability in the event of an
emergency or extended power outage, a 30 kW diesel fired generator will be installed at
time of construction. The generator itself is enclosed in a sound attenuated enclosure,
utilizes a muffler with the exhaust pipe directed vertically approximately 8 feet above
ground level. The generator would run for extended periods of time only in the event of a
natural disaster, other emergency or prolonged power outage. Sound test results are
available for the proposed generator and are attached for review.
Safety
The proposed site will be entirely self-monitored by sophisticated computers which
connect directly to a central office and which alert personnel to equi � , ;

breach of security. Moreover, no smoke, debris or other nuisance will be generated by
the proposed facility.
The proposed facility will not be detrimental to nor will it endanger the public health,
safety, morals, comfort, or general welfare of the community. The proposed facility will
not pose a risk of explosion, fire or other danger to life or property due to proximity to
other materials and the facility will be designed and a State of California qualified
engineer will certify that the proposed facility will be structurally sound.
In Conclusion
Everyday, more than 296,000 "911" calls are made from wireless phones. According to
the National Center for Health Statistics Interview Survey January —June 2010, 26.6°/a of
U.S. Households are Wireless"Only" households. The proposed Verizon Wireless
Telecommunications Facility enhances the general welfare of the community by
providing the infrastructure for these calls, as well as providing vital means of
communication during times of emergency when traditional land lines are not available
or in cases of power failure. The carefully selected and designed facility allows these
calls to occur while remaining a site that meets the needs of the community now and in
the future.

Statement of Hammett � Edison, Inc., Consulting Engineers
The firm of Hammett & Edison, Inc., Consulting Engineers, has been retained on behalf of Verizon
Wireless, a personal wireless telecommunications carrier, to evaluate the base station (Site No. 181396
"Vallco Shopping Center") proposed to be located at 10123 North Wolfe Road in Cupertino,
California, for compliance with appropriate guidelines limiting human exposure to radio frequency
("RF") electromagnetic fields.
Executive Summary
Verizon proposes to install directional panel antennas above the shopping mall located at
10123 North Wolfe Road in Cupertino. The proposed operation will, together with the
existing base station at the site, comply with the FCC guidelines limiting public exposure to
RF energy.
Prevailing Exposure Standards
The U.S. Congess requires that the Federal Communications Commission ("FCC") evaluate its
actions for possible significant impact on the environment. A summary of the FCC's exposure limits
is sbown in Figure 1. These limits apply for continuous exposures and are intended to provide a
prudent margin of safety for all persons, regardless of age, gender, size, or health. The most restrictive
FCC limit for exposures of unlimited duration to radio frequency energy for several personal wireless
services are as follows:

General Facility Requirements
Base stations typically consist of two distinct parts: the electronic transceivers (also called"radios" or
"channels") that are connected to the traditional wired telephone lines, and the passive antennas that
send the wireless signals created by the radios out to be received by individual subscriber units. The
transceivers are often located at ground level and are connected to the antennas by coaxial cables. A
small antenna for reception of GPS signals is also required, mounted with a clear view of the sky.

Because of the short wavelength of the frequencies assigned by the FCC for wireless services, the
antennas require line-of-sight paths for their signals to propagate well and so are installed at some
height above ground. The antennas are designed to concentrate their energy toward the horizon, with
very little energy wasted toward the sky or the ground. This means that it is generally not possible for
exposure conditions to approach the maximum permissible exposure limits without being physically
very near the antennas.
Computer Modeling Method
The FCC provides direction far determining compliance in its Office of Engineering and Technology
Bulletin No. 65, "Evaluating Compliance with FCC-Specified Guidelines for Human Exposure to
Radio Frequency Radiation," dated August 1997. Figure 2 attached describes the calculation
methodologies, reflecting the facts that a directional antenna's radiation pattern is not fully formed at
locations very close by (the "near-field" effect) and that at greater distances the power level from an
energy source decreases with the square of the distance from it (the "inverse square law"). The
conservative nature of this method for evaluating exposure conditions has been verified by numerous
field tests.
Site and Facility Description
Based upon information provided by Verizon, including zoning drawings by Delta Groups
Engineering, Inc., dated October 28, 2013, it is proposed to install sixteen Andrew directional panel
antennas — eight each Models LNX-4514DS-VTM and HBX-4517DS-AlM — behind four new view
screens to be installed at locations along the edge of the roof of the Vallco Shopping Mall, located at
10123 North Wolfe Road in Cupertino. The antennas would be mounted with up to 4° downtilt at an
effective height of 78-79 feet above ground, 5-6 feet above the roof, and would be oriented in
identical groups of four (two of each) toward 10°T, 90°T, 180°T, and 270°T, away from the building,
in order to provide service in all directions. The maximum effective radiated power in any direction
would be 11,200 watts, representing simultaneous operation at 5,370 watts for AWS, 3,380 watts for
PCS, and 2,450 watts for 700 MHz service; no operation on cellular frequencies is proposed at this
site.
Presently located on the same building are similar antennas for use by Clearwire. For the limited
purpose of this study, the transmitting facilities of that carrier are assumed to be as follows:

Study Results
For a person anywhere at ground, the maximum RF exposure level due to the proposed Verizon
operation by itself is calculated to be 0.0047 mW/cm2, which is 0.94% of the applicable public
exposure limit. The maximum calculated cumulative level at ground, for the simultaneous operation
of both carriers, is also 0.94% of the public exposure limit, as the maximum levels for the carriers do
not coincide. The maximum calculated cumulative level at the second-floor elevation of any nearby
building is 1.3% of the public limit. The maximum calculated cumulative level at the second-floor
elevation of any nearby residence* is 0.74% of the public exposure limit. It should be noted that these
results include several "worst-case" assumptions and therefore are expected to overstate actual power
density levels. Levels are calculated to exceed the applicable public exposure limit on the roof of the
subject building, in front of the antennas.
Recommended Mitigation Measures
Due to their mounting locations, the Verizon antennas would not be accessible to the general public,
and so no mitigation measures are necessary to comply with the FCC public exposure guidelines. To
prevent occupational exposures in excess of the FCC guidelines, it is recommended that appropriate
RF safety training be provided to all authorized personnel who have access to tl�e roof, including
employees and contractors of the wireless carriers as well as roofers, HVAC workers, and building
maintenance staff. No access within 26 feet directly in front of the antennas themselves, such as might
occur during maintenance work on the building, should be allowed while the base station is in
operation, unless other measures can be demonstrated to ensure that occupational protection
requirements are met. Posting explanatory signst at the two roof access hatches and on the screens in
front of the antennas, such that the signs would be readily visible from any angle of approach to
persons who might need to work within that distance, would be sufficient to meet FCC-adopted
guidelines. Similar measures should already be in place for Clearwire; the applicable keep-back
distance for that carrier has not been determined as part of this study.
Conclusion
Based on the information and analysis above, it is the undersigned's professional opinion that
operation of the base station proposed by Verizon Wireless at 10123 North Wolfe Road in Cupertino,
California, will comply with the prevailing standards for limiting public exposure to radio frequency
energy and, therefore, will not for this reason cause a significant impact on the environment. The

highest calculated level in publicly accessible areas is much less than the prevailing standards allow
for exposures of unlimited duration. This fmding is consistent with measurements of actual exposure
conditions taken at other operating base stations. Training of authorized personnel and posting
explanatory signs is recommended to establish compliance with occupational exposure limitations.

The U.S. Congress required (1996 Telecom Act) the Federal Communications Commission ("FCC")
to adopt a nationwide human exposure standard to ensure that its licensees do not, cumulatively,have
a significant impact on the environment. The FCC adopted the limits from Report No. 86, `Biological
Effects and Exposure Criteria for Radiofrequency Electromagnetic Fields," published in 1986 by the
Congressionally chartered National Council on Radiation Protection and Measurements ("NCRP").
Separate limits apply for occupational and public exposure conditions, with the latter limits generally
five times more restrictive. The more recent standard, developed by the Institute of Electrical and
Electronics Engineers and approved as American National Standard ANSI/IEEE C95.1-2006, "Safety
Levels with Respect to Human Exposure to Radio Frequency Electromagnetic Fields, 3 kHz to
300 GHz," includes similar limits. These limits apply for continuous exposures from all sources and
are intended to provide a prudent margin of safety for all persons, regardless of age, gender, size, or
health.
