TR-2014-23b OFFICE OF COMMUNITY DEVELOPMENT CITY HALL 10300 TORRE AVENUE•CUPERTINO, CA 95014-3255 C U P E RT 1 N O (408)777-3308• FAX(408)777-3333•planninq(c�cupertino.org July 21, 2014 Brent Wahlberg Valley Crest Tree Care 530 Aldo Avenue Santa Clara, CA 95054 SUBJECT: TREE REMOVAL PERMIT ACTION LETTER-Application TR-2014-23 This letter confirms the decision of the Director of Community Development, given on july 18, 2014, approving a tree removal permit to allow the removal and replacement of a 15" Modesto Ash tree (near 22821 Longdown Road), a 15" Shamel Ash tree (near 22946 Longdown Road), and a 36" multi-trunk River Birch tree in the common areas of a planned residential cluster complex (De Anza Oaks Homeowners Association) located on the south side of Stevens Creek Boulevard, west of Lebanon Drive. The application is approved with the following conditions: 1. APPROVED PROTECT This approval is based on arborist reports prepared by Brent D. Wahlberg (#WE3276A), dated April 30, 2014, consisting of 2 pages, and a tree removal and tree replacement site plan, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is required to plant six (6) 24-inch box replacement trees in accordance with the Protected Tree Ordinance and approved tree replacement plan. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff received a comment from a resident on the justification for removal of the 36" diameter River Birch tree. There is significant decay in the tree and the project arborist reports that it will cause the tree to fall. The resident acknowledged the reason for removal. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Location: 22946 Longdown— Shamel ash (Fraxinus uhdei) The Shamel ash is in good condition showing good color and growth. Tree structure is fair as there are several large branches with poor connections. It was planted in a small area for that size of tree. There are a number of undergrond utilities in the same area and run through the root zone of the tree as well as concrete sidewalk and driveway on 3 sides. There has already been driveway repairs because of root damage from this tree. The walkway and curb are showing signs of cracking and being raised by tree roots as well. In addition a sewer line repair is needed. The line runs directly under the tree. Because of the small space for this size of tree there is considerable damage to the hardscape and utilities. Locations: 22821 Longdown— Modesto ash (Fraxinus velutina `Modesto') 23028 Cricket Hill—River birch (Betula nigra) The Modesto ash is in good condition showing good color and growth. It was planted in an area that also has a number of utilities that are in the ground and run through the root zone of the tree. A sewer line repair was needed and was excavated hydraulically. The line runs within 3 feet of the trunk. 7 feet of pipe needed to be exposed. The trees root system criss - crossed through the exposed trench making it impossible to get to the pipe without cutting the roots. Approximately 40% of the root system was cut. The sidewalk that is fairly close to the tree was damaged by the roots several years ago and needed to be replaced as well. There is evidence that the trees roots are raising the sidewalk again. The root loss is significant and will cause the tree to decline. With the decline of the tree and the invasive root system damaging utilities and hardscape I recommend removing the tree. A more suitable tree for this area should be planted. The River birch is a triple trunk tree in fair condition. The 3 trunks originate at ground level. There is a large area of decay in each of the 3 trunks. Birch trees do not compartmentalize decay very well. The decay is going to continue in the trunk and into the root system. The decay will cause the trunks to fail. 2 of the stems will hit the house nearby and the third will land in a grass area that children play in. I recommend removing this tree before it fails.
