The application to remove the trees is approved with the following conditions: 1. APPROVED PROTECT This approval is based on the tree removal exhibits submitted and the arborist report prepared by Sam Oakley (#WE-9474A), dated January 14, 2014 consisting of 15 pages, except as may be amended by conditions in this resolution. 2. TREE REPLACEMENTS The applicant is replacing the removed trees by planting ten (10) 24-inch box trees, twelve (12) 36-inch box trees, one (1) 48-inch box tree, and one (1) 60-inch box tree in accordance with the approved tree replacement plan. The proposed numbers of replacement trees exceed the Replacement Tree Guidelines under Section 14.18.190 of the Protected Tree Ordinance. Modifications to the tree species and location may be made to the approved replacement plan pending staff approval. The replacement trees shall be planted within 30 days of the effective approval date of this tree removal permit. 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. The tree assessment consisted of thirty-eight(38) trees. All 38 trees are considered protected trees pursuant to Section 14.18.035 of the City of Cupertino's Municipal Code. Twenty-four (24) trees are not suitable for preservation and are recommended for removal. Fourteen(14) individuals are suitable for preservation. Introduction Arborwell was retained to inventory and assess all trees on the property of 10420 Bubb Road in Cupertino, CA(see Figure 1 of Exhibit 1). The inventory of all trees on the property was performed on January 3, 2014 and updated on January 14, 2014. The inventory is in preparation for proposed capital improvements. Included in this report are figures and tables referenced in the report(Exhibit 1), the inventory spreadsheet with tree numbering(Exhibit 2), and site map (Exhibit 3). Assignment & Scope This report intends to describe the state of the trees on the Bubb 14 properiy as observed on the date of the inventory. Data collected per individual tree for the inventory are as follows: tree number,scientific name,common name,diameter at fifty-four inches(54")above grade, crown height, crown spread, condition percentage, action, and any observational notes (see Exhibit 2). Each of the identified trees was mapped by using a combination of differential global position systems and geographic information systems. Of the data collected in the field, health and structure were combined to give each tree a condition rating, expressed as a percentage. The health of the tree is determined by its current size versus approximate install date, canopy density, coloration, the appearance of any abnormalities or deficiencies and the overall health of the trunk,crown,and visible roots. The structure of the tree was evaluated based on the tree's natural,expected growth habit and form versus current growth habit, as well as the tree's inherent and exhibited structural integrity and deficiencies. Health and condition are subjective and species-dependent. Note that the recommendations in this report are based on visual inspection on the above- ground parts of the tree at the time of the site visit. No soil was removed for below-grade inspection and no aerial inspection was performed. Tree Count & Composition During the site visits, a total of thirty-eight (38) trees were quantified on-site. Of the 38 individuals observed on the property, there were ten (10) species (see Tables 1 and 2 of Exhibit 1). Pursuant to Section 14.18.035 of the City of Cupertino's Municipal Code, all individuals are considered protected. Twenty-four(24) trees are recommended for removal based on poor suitability for preservation. Fourteen(14) trees are suitable for preservation. Prior to my January 15, 2014 site inspection for the survey update, Tree #33, a dead coast live oak, had been removed and subsequently, I removed it from this report. Condition rating percentages are combined with other criteria and considerations (see below) to identify the overall value of an existing tree on- site and it's suitability for preservation. See Table 3 for a list of suitable candidates for preservation. Preservation Criteria & Considerations The following criteria and considerations were used to determine suitability for preservation: • size/vigor • functional value (shading, screening, etc.) • condition rating • location appropriate • climate adapted • water demand • aesthetic value • long term maintenance • hazard pre-disposition, signs, and symptoms • infrastructure damage observed and/or anticipated • competition and overcrowding with other desired shrubs and trees to be preserved • anticipated length of lifespan Condition Rating Categories Excellent: Exemplary health and structure for species. No individuals were identified as in excellent condition. Good: Some minor deficiencies noted in health and/or structure,with potential for corrective measures to be performed to improve upon condition(including but not limited to fertilizer, pruning, and chemical applications). Though there is evidence of recent pruning and tree maintenance, the on-site trees, in general, are declining due to deferred maintenance. Heavy compaction during the initial tree installation is likely the culprit for much of the decline exhibited in the onsite trees. Many of the trees on site have been topped and exhibit poor structure. Several individuals are planted in shallow planter beds directly below the building's eve, a poor planting location due to the potential for the tree to outgrow its space. Many of the redwood individuals are exhibiting external stress, likely caused by insufficient irrigation or using reclaimed water as irrigation. Human activity is often the cause of most problems that trees experience. For example, improper planting and pruning of trees, as well as poor care, will often lead to exhibited stress. Applying too much or too little water, especially after planting, may injure roots. Over application of fertilizer can also lead to root injury, or rapid but weak growth, that makes the tree prone to certain insect pests and plant diseases. Mechanical injuries from lawn mowers and weed trimmers can damage tree bark and create the opportunity for invasion by certain disease organisms. Excessive foot or vehicular traffic around trees can destroy the structure of soil leading to compaction of that soil. Compaction reduces the level of oxygen in soil, slows the penetration of water, and hinders the development of roots. Other consequences of human activity, especially air pollution, are a little more difficult to assess and to prevent. From our observations, we have recommended several trees for removal. Along with the removals, we recommended a full soil renovation throughout the entirety of the perimeter and building planters, including rototilling all soil to a depth of eighteen inches (18") and the addition of soil amendments into the root zone. This will encourage deeper rooting, vigorous growth, better performance, and, as a result, less potential for tree mortality. Mulch should be applied and irrigation upgrades should be installed. All recommendations are to be performed to the American National Standards Institute (ANSI)A300 Standards for Tree Care Operations. In addition,ANSI Z133.1 Standards and Safety Requirements for Arboriculture Operations are to be explicitly followed. ANSI A300 and Z 133.1 standards are the generally accepted industry standards for tree care practices and safety procedures.
