SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2014-24
This letter confirms the decision of the Director of Community Development, given on July 1, 2014,
approving a tree removal permit to allow the removal and replacement of one 6" Paltanus
Acerifolia tree located at an office complex, located at 19333 Vallco Parkway. The application to
remove the trees is approved with the following conditions:
1. APPROVED PROTECT
This approval is based on the arborist report prepared by Sam Oakley (#WE-9474A), dated
May 13, 2014 consisting of 2 pages including site photos and a removal and replacement plan,
except as may be amended by conditions in this resolution.
2. TREE REPLACEMENTS
The applicant is required to plant one (1) 36-inch box tree in accordance with the Replacement
Tree Guidelines under Section 14.18.190 of the Protected Tree Ordinance and approved tree
replacement plan. Modifications to the tree species and location may be made to the approved
replacement plan pending staff approval. The replacement trees shall be planted within 30
days of the effective approval date of this tree removal permit.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all of the
requirements of Section 66020, you will be legally barred from later challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.180 of the Protected Trees Ordinance.

To whom it may concern,
This letter intends to address one (1) tree located on the 19333 Vallco Parkway property. The
tree is located in a planter close to the building in the back parking lot (see Exhibit 1.1) on the
north-side of the property. The tree is marked with caution tape.
The following table contains the metrics for the proposed removal:

The subject tree is considered a Protected Tree pursuant to Section 14.18.035 of the City of
Cupertino's Municipal Code. The tree is considered to be in fair condition, having moderate
health and structure. The tree is exhibiting declining health defects, possibly due to heat-island
effect and the acute drought stress.
Currently,there are proposed ADA improvements for the property and a sidewalk is to be built
at the growing location of the subject tree; the current location of the subject tree is in direct
conflict with the plan. Due to the trees declining health, I recommend that the tree be removed
and replaced rather than relocate the proposed sidewalk. Please see Exhibit 1.03 for an image
of the tree, taken on May 9, 2014, and Exhibit 1.4 for the design plan showing the proposed
sidewalk relative to the tree's current location.
The property owner understands that the removal of a protected tree is subject to a tree removal
permit and any fees and mitigation associated pursuant to Section 14.18 of the City of
Cupertino's Municipal Code. The tree will require replacement, selected to ensure optimal
structure,health, and no girdling roots, and then trained from an early age as needed to optimize
branching structure, extending the aesthetically and structurally sound lifespan of the tree.
The proposed replacement will be located at the building's front entrance in the unoccupied
landscaped area, shown in Exhibit 1.02. The sizing and species will be one (1) 36-inch box
Quercus virginiana (southern live oak).
Along with the removal, we recommended a soil renovation at the replanting location,
including rototilling all soil to a depth of eighteen (18) inches and the addition of soil
amendments into the root zone. This will encourage deeper rooting,vigorous growth,better
performance, and, as a result, less potential for tree mortality. Mulch should be applied and
irrigation upgrades will be installed.
