Subject: Director's Minor Modification, DIR-2014-17, to allow minor site modifications including
parking lot restriping, new landscaping features, ADA compliant pathways and a new EV
charging station, and a Tree Removal Permit (TR-2014-26) to allow the removal and
replacement of nine (9) trees due to conflict with proposed improvements, located at an
existing office center on Bubb Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar days.
DISCUSSION
The applicant, Jessica Henderson, representing Apple, is requesting approval to allow site
modifications to the parking lot with associated landscaping and site improvements at a Light
Industrial zoned property located at 10401 and 10411 Bubb Road.
Site and Fa�ade Improvements
The applicant proposes to reconfigure and upgrade a portion of the existing parking lot in order to
facilitate various site improvements. As part of the project one of the three existing driveways off of
Bubb Road will be removed to accommodate additional parking and landscape area. The site
improvements include:
• ADA accessibility upgrades
• New landscaping and irrigation system
� Six new electric vehicle charging stalls
• New bicycle racks and lockers per city standards
• New walkway connection from the public sidewalk to the building
The proposed landscaping features, as well as the parking stall, parking supply, and drive aisle
dimensions, are in compliance with the City's Parking Ordinance. No reduction in parking stalls is
proposed.

In addition to the parking lot modifications, the applicant is proposing the removal and replacement of
the existing roof screen. The roof screen will be visually the same as the existing screen and is
consistent with the City's requirements on height, setback and location. All colors and materials will
match the existing office complex.
Tree Removals
The applicant also proposes to remove eight (S) trees and transplant one (1) tree as part of the parking
lot and site improvements. It should be noted that none of the trees are specimen trees per the City's
protected tree ordinance. In order to mitigate the trees being removed, the applicant will be required to
plant fifteen (15) 24-inch box trees. The final location and species of the tree replacements will be
reviewed by staff in conjunction with the building permit review.
ACTION
The Director of Community Development deems the modification minor and approves the Director's
Minor Modification and Tree Removal Permit with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on the plan set consisting of nine (9) sheets received on May 27, 20141abeled title
sheet, 0.0, 1.0, 1.1, 2.0, 2.1, 3.0, 3.1, and 3.2, entitled, "Apple Bubb 16, Director's Minor Modificatiori'
drawn by Kier&Wright;except as may be amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
3. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals shall remain in effect unless superseded by
or in conflict with subsequent conditions of approval, including conditions of approval for DIR-
2013-17.
4. UTILIT'Y SCREENING
All new or relocated utility structures, including, but not limited to backflow preventers, fire
department connections, and post-inlet vales, shall be screened to the satisfaction of the Director of
Community Development.
5. LIGHTING COMPLIANCE
All new lighting must conform to the standards in the General Commercial (CG) and Parking
Ordinance, and the final lighting plan (including a detailed photometric plan) shall be reviewed
and approved by the Community Development Director prior to building permit issuance.
Prior to final occupancy of site permits, a report from a licensed lighting engineer shall be provided
to confirm that all exterior building-mounted and site lighting comply with the lighting standards
contained in the City's General Commercial and Parking Ordinances.

6. TREE REMOVAL
Prior to removal and replacement of trees as part of the parking lot and site improvements,
applicant shall receive approval and exhaust the appeal period for tree removal permit TR-2014-26.
7. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
8. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set farth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a sta#ement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
This approval of the Director's Minor Modification is effective june 18, 2014. The fourteen calendar day
appeal period will expire on July 2, 2014.

PROJECT DESCRIPTION
This application is for the planned tenant improvements which include demolition of interior features and modifications to
exterior door locations for accessibility and egress and new interior tenant improvements.In addition the existing roof
screen will be removed and updated to match existing height and configuration.
The project's site work includes only the minimum accessibiliry improvements required for repair and reconstruction of
existing sidewalks and other flatwork.The project also is proposing to reconfigure a portion of the paricing lot and
incorporate the necessary number of accessible stalls along with installation of 3 electrical vehicle charge stations. These
improvements trigger the removal of 8 trees,relocation of 1 tree and minor landscaping repairs and upgrades. Additional
site work includes a new fiber line from the building to an existing manhole in the public street,minor stoRn drain
improvements,and restriping the remainder of the site.
