Subject: Director's Minor Modi_fication, DIR-2014-19, to allow mulor site modifications including
parking lot restriping, new landscaping features, ADA compliant pathways and a new EV
charging station; and
Chapter 19.164 of the Cupertino Municipal Code allows for admuzistrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Plarining Commission in time to allow an appeal of the decision within fourteen
calendar days.
DISCUSSION
The applicant, Nektarios Matheou, representing Apple (tenant) and Home of Christ Church (property
Owner), is requesting approval to conduct site modifications to the parking lot with associated
landscaping and site improvements at a Light Industrial zoned property with two existing buildings
located at 10420 Bubb Road.
Pa��king Lot Improvements
The applicant proposes to reconfigure and upgrade a portion of the existing parking lot in order to do
the following:
• New landscape planter islands with many drought-tolerant and native plantings
• Replacement of existing irrigation system with water efficient system
• Soil amendments to increase the viability of new plantulgs
• ADA accessibility upgrades
• Four new electric vehicle charguzg stations
• The project also proposes more bicycle parking than what is required by the Parkuzg Ordinaiue.
The proposed landscaping features, as well as the parkuzg stall, parkulg supply, and drive aisle
dimensions, are u1 compliance with the City's Parkulg Ordinance. No reduction in parking stalls is
proposed.

Site Improvements
The applicant also proposes to enhance the site to create a more pleasurable working and pedestrian
experience. The site improvements include:
• New courtyard area along the west side of the building with added site furnishings
• Replacement of existing irrigation system with water efficient system
• New wallcway connection from the public sidewalk to the building
• New bicycle racks and lockers
• ADA accessibility upgrades
ACTION
The Director of Community Development deems the modification minor and approves the Director's
Mu1or Modification and Tree Removal Permit with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on the plan set consisting of 17 sheets received on May 16, 2014 labeled title
sheet, C-001, C-102, C-003, C-100, C-101, C-200, C-300, L-001, L-100, L-101, L-102, L-200, L-201, L-
202, L-500, L-501, and L-502, entitled, "Apple Bubb 14 Sitework, 10420 Bubb Road," drawn by Kier
&Wright;except as may be amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
3. PREVIOUS CONDITIONS OF APPROVAL
All prior conditions of approval through past approvals shall remain in effect unless superseded by
or in conflict with subsequent conditions of approval, including conditions of approval for DIR-
2013-16.
4. UTILIT'Y SCREENING
All new or relocated utility structures, including, but not limited to backflow preventers, fire
department connections, and post-inlet vales, shall be screened to the satisfaction of the Director of
Community Development.
5. LIGHTING COMPLIANCE
All new lighting must conform to the standards in the General Commercial (CG) and Parking
Ordinance, and the final lighting plan (including a detailed photometric plan) shall be reviewed
and approved by the CommLUlity Development Director prior to building permit issuance.
Prior to final occupancy of site permits, a report from a licensed lighting engineer s11all be provided
to confirm that all exterior building-mounted and site lighting comply with the lighting standards
contained in the City's General Commercial and Parking Ordinances.

6. TREE REMOVAL
Prior to removal and replacement of trees as part of the parking lot and site improvements,
applicant shall receive approval and exhaust t�1e appeal period for tree removal permit TR-2014-25.
7. LANDSCAPE PROTECT SUBMITTAL
Prior to issuance of building permits, the applicant shall submit a fuil landscape project submittal
per sections 14.15.040 A, B, C, and D of the Landscaping Ordinance. The Water-Efficient Design
Checklist (Appendix A of Chapter 14.15), Landscape and Irrigation Design Plans, and Water
Budget Calculations shall be reviewed and approved to the satisfaction of the Director of
Community Development prior to issuance of building permits.
8. LANDSCAPE INSTALLATION REPORT
Prior to issuance of final occupancy, a landscape installation audit shall be conducted by a certified
landscape professional after the landscaping and irrigation system have been installed. The
findings of the assessment shall be consolidated 'uzto a landscape installation report.
The landscape installation report shall include, but is not limited to: inspection to confirm that the
landscaping and irrigation system are installed as specified in the landscape and irrigation design
plan, system tune-up, system test with distribution uniformity, reporting overspray or run-off that
causes overland flow, and preparation of an irrigation schedule.
The landscape installation report shall include the following statement: "The landscape and
irrigation system have been installed as specified in the landscape and irrigation design plan and
complies with the criteria of the ordinance and the permit."
9. LANDSCAPE AND IRRIGATION MAINTENANCE
Prior to issuance of final occupancy, a maintenance schedule shall be established and submitted to
the Director of Community Development or his/her designee, either with the landscape application
package, with the landscape installation report, or any time before the landscape installation report
is submitted.
a) Schedules should take into account water requirements for the plant establishment period and
water requirements for established landscapes.
b) Maultenance shall ulclude, but not be limited to the following: routine inspection; pressure
testing, adjustment and repair of the irrigation system; aerating and de-thatchulg turf areas;
replenislling mulch; fertilizing; prunulg; replanting of failed plants; weeding; pest control; and
removing obstructions to emission devices.
c) Failed plants shall be replaced with the saine or functionally equivalent plants that may be size-
adjusted as appropriate for tlle stage of growth of the overall ulstallation. Failing plants shall
either be replaced or be revived through appropriate adjushnents in water, nutrients, pest
control or other factors as recommended by a Iandscapulg professional.
10. INDEMNIFICATION
To the extent permitted by Iaw, the Applicant shall uldemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to

attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without lunitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
11. NOTICE OF FEES DEDICATIONS RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute �vritten notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further
notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.
This approval of the Director's Minor Modification is effective June 6, 2014. The fourteen calendar day
appeal period will expire on June 20, 2014.
