Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports their decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant, Gary Allen, on behalf of Apple Inc., is requesting approval to allow the installation of temporary mechanical equipment for six months in the parking lot of the subject property. The temporary location of the typically rooftop equipment units are needed as a means of maintaining temperature control of the building at this location during the tenant improvements. The proposed equipment will be located in the parking lot adjacent to the east of the office building and will be approximately 630 feet north from any residential property. Additionally, it is not visible to public view from Stevens Creek Boulevard and North Tantau Avenue. Equipment The proposed equipment includes one 12,5001b. dehumidifier, one 1,600 lb.blend condensing unit, and one 1,900 lb. make up condensing unit. A temporary pipe route will run over the drive aisle and temporary mechanical ducting will pass along the building elevation, over the parapet, to the existing connection on the roof level. As proposed, five temporary water filled vehicular barriers and a 10' tall security fence shall be provided around the equipment. Parking The temporary system is proposed in the east parking lot, and will temporarily reduce the site's on-site parking by seven spaces, from 703 parking spaces to 696. The remaining parking spaces will remain unaffected and available for use. The office complex currently functions as a research and testing facility and is lightly staffed during working hours. The required parking is 678 stalls. Therefore, no TL7P-2014-04 10100 North Tantau Avenue Page 2 significant impact on parking availability is anticipated. Additionally,no drive aisles will be obstructed and adequate ADA and fire access will be maintained. Noise No significant noise impacts are anticipated, the temporary system and current system will function identically and no additional noise will be generated from the temporary system. The maximum db at the fence lines between Apple and the neighboring parcels will be at or below 60 db while operating. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits entitled: "Equipment Temporary Location at Apple, inc. 10100 Tantau Avenue" prepared by Whitney Polcyn Architects, dated April 25, 2014, and consisting of seven sheets;except as may be amended by the conditions contained in this resolution. 2. BUILDING PERMITS The applicant shall consult with the City Building Division to obtain the necessary building permits for the trailer if applicable. 3. CONSULTATION WITH OTHER DEPARTMENTS � The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 4. DURATION The temporary location of the mechanical equipment shall be removed from the site no later than six months from the date the equipment is installed and the impacted parking and landscaped area shall be restored to its original condition. 5. NOISE Noise shall not exceed the maximum Daytime and Nighttime exposure limits prescribed in Chapter 10.48 of the City of Cupertino Municipal Code. 6. SCREENING The privacy slats for the security fence surrounding the mechanical equipment shall closely match the color of the existing office building. 7. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its acival attorneys' fees and costs incurred in TLTP-2014-04 10100 North Tantau Avenue Page 3 defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 8. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective May 14, 2014. The fourteen calendar day appeal period will expire on May 28, 2014.
