Subject: Director's Minor Modification, DIR-2014-15, to replace and modify an existing church
steeple, located at 10270 South Stelling Road.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar da s.
DISCUSSION
The applicant, Ron Christensen, is proposing to replace and modify the design of an existing steeple at
the Church of Jesus Christ of Latter Day Saints located at 10270 South Stelling Road. The church and
steeple were originally developed in 1967(Use Permit no. U-1967-02). The City approved a 2,430 square
foot addition to the church in 1985 (Revision to Use Permit no.U-1967-02).
The spire atop the steeple was recently damaged in a wind storm and subsequently removed. Further
inspection of the steeple structure revealed structural and seismic defects that warrant complete
removal and replacement above the church building roofline for safety reasons.
The applicant proposes a new steeple configuration that retains the height of the existing steeple (64
feet), but includes a modified, more ornate and articulated design that is consistent with the overall
theme of the church building. The proposed steeple would have a matte aluminum finish with a
minimal reflectivity value in the same color scheme as the church building. The revised design fits
within the footprint of the existing steeple structure, as the lower portion with brick veneer would

The project also involves the reroof of the church building and removal and replacement of gutters and
certain rooftop equipment.
The elevation plans were circulated to the adjacent property owners for a two-week review period. No
comments were received by the City. Staff supports the steeple replacement and other ancillary exterior
improvements since they are consistent with the architectural theme of the church, and will not create
adverse visual impacts.
ACTION
The Director of Community Development deems the modification minor and approves the project with
the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based on exhibits entitled: "Stelling Meetinghouse, Saratoga CA Stake, Reroof, Steeple
Replacement, and Voluntary Structural Improvements, 10270 South Stelling Road, Cupertino, CA
95014," prepared by Apex Design Group, received Apri13, 2014, and consisting of 11 sheets labeled
G001, AD201, AD202, A001, A121, A122, A201, A202, A203, untitled comparison sheet, A204, and
A205 except as may be amended by the conditions contained in this resolution.
2. PREVIOUS CONDITIONS OF APPROVAL

• All conditions, except that the originally approved steeple shall be superseded by the design
approved under this modification.
3. BUILDING PERMITS AND FINAL EXTERIOR DETAILS
The applicant shall consult with the City Building Division to obtain the necessary building permits
for this project. The final exterior treatment plans shall be reviewed and approved by the Director
of Community Development prior to issuance of building permits. The Director of Community
Development may approve additional designs or make minor variations as deemed appropriate.
The final building exterior plan shall closely resemble the details shown on the original approved
plans. Any exteriar changes determined to be substantial by the Director of Community
Development shall require a modification approval.
4. CONSTRUCTION PLAN SET REVISIONS
The notes/clarifications are required on the construction plan sets prior to building permit issuance:
a. Steeple height: It is understood that the existing and proposed height of the steeple is 64 feet
above existing grade. Please make this clear on the existing and proposed elevations.
b. Large rooftop unit screening: Given that the project proposes to replace this unit in kind, and that
it is not visible from the main public view, it is acceptable to not install a screening structure for
this unit near the east elevation. However, this unit will need to be painted a matte grey color to
match the sky.
c. Rooftop vent visibility: Note that the new low-profile rooftop vents shall be verified by the City
prior to final occu�anc�. Additional screening measures may be required if City staff
determines that their visibility is significant.
5. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to
the proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
6. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City
Council, its officers, employees and agents (the "indemnified parties") from and against any claim,
action, or proceeding brought by a third party against the indemnified parties and the applicant to
attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project,
including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in
defense of the litigation. The City may, in its sole discretion, elect to defend any such action with
attorneys of its choice.
7. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions. You are hereby further

notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020,you will be legally barred from later challenging such exactions.
This approval of the modification is effective May 13, 2014. The fourteen calendar day appeal period
will expire on May 27, 2014.
