Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar da s. DISCUSSION The applicant, Jeff Oparowski, representing the Sobrato Organization, is proposing to modify a previously approved building facade on the Major Tenant 1 space (20580 Homestead Road) at the Homestead Square Shopping Center. Previous City Approvals The City Council originally approved the Use Permit (U-2009-08) and Architectural and Site Approval (ASA-2009-08) in May 2010 for the shopping center's expansion. Following this, an Architectural and Site Approval (ASA-2011-17) was approved by the Planning Commission in October 2011 to allow changes to the overall architecture of the project. A subsequent Architectural and Site Approval (ASA-2012-07) was approved by the Director of Community Development in October 2012 to allow minor changes to the site improvements, which included the deletion of a previously-approved building pad (Pad #2). In April 2013, the Director of Community Development approved an Architectural and Site Approval (ASA-2013-02) specifically for Major Tenant 2. In February 2014, the Director of Community Development approved a Director's Minor Modification (DIR-2014-05) to supercede the fa�ade modifications for Major Tenant 2 approved under ASA-2013-02. Fa�ade Modifications The fa�ade modifications for Major Tenant 1 are requested in order to accommodate the future tenant, Ulta Beauty. The City's Architectural Consultant has reviewed the modifications and supports the DIR-2014-14 20580 Homestead Road Page 2 design. The applicant has worked with staff to incorporate all of the comments from the architectural consultant. The currently proposed modifications consist of the following: • Replace the tile roof tower at the corner with a higher parapet wall with flat roof • Increase the height of the entry tower by 10 inches to a total height of 32 feet, 6 inches • Increase the stone veneer area on the front fa�ade • Replace the tile roof arcade with a flat roof and taller parapet wall • Add color metal awnings to the corner element • Add scoring lines in the upper wall plaster finish See below for a comparison of the previously approved Major Tenant 1 north and east elevations in 2011 (ASA-2011-17) and the currently proposed design: Previously approved under ASA-2011-17 r � � � � � �..r i ' t� � - --- . ...._. _ SiGNAGE_._._. . ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled: "New Major 1 and 2 Retail Cold Shell Buildings at Homestead Square, 20580 & 20590 Homestead Road, Cupertino, CA 95014," prepared by ArcTec, received Apri124, 2014 and March 26, 2014, and consisting of four sheets labeled A1.01, A3, A3R (previously approved), and A3.01, except as may be amended by the conditions contained in this resolution. 2. PREVIOUS CONDITIONS OF APPROVAL The following previous conditions of approval for the project site shall remain in effect: U-2009-08,ASA-2009-08,ASA-2012-07 • All conditions ASA-2011-17 • All conditions, except that the approved elevations for Major Tenant 1 shall be superseded by this approval. 3. BUILDING PERMITS AND FINAL EXTERIOR DETAILS The applicant shall consult with the City Building Division to obtain the necessary building permits for this project. The final exterior treatment plans shall be reviewed and approved by the Director of Community Development prior to issuance of building permits. The Director of Community Development may approve additional designs or make minor variations as deemed appropriate. The final building exterior plan shall closely resemble the details shown on the original approved plans. Any exterior changes determined to be substantial by the Director of Community Development shall require a modification approval. 4. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 5. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in DIR-2014-14 20580 Homestead Road Page 4 defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 6. NOTICE OF FEES DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. This approval of the modification is effective Apri125, 2014. The fourteen calendar day appeal period will expire on May 9, 2014.
