Subject: Director's Temporary Use Permit, TUP-2014-02, to allow the installation of a trailer
during the construction of an addition at an existing service station located at 21530
Stevens Creek Boulevard.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative
approval of a temporary use permit, authorizing the use of a site in any zoning
district for a temporary use. The Director reports the decision to the City Council
& Planning Commission in time to allow an appeal of the decision within
fourteen calendar days of approval.
DISCUSSION
On May 22, 2012, the Planning Commission approved a Use Permit (U-2011-09) and
Architectural and Site Approval (ASA-2011-10) to remodel an existing service station, add 527
square feet, and convert the service bays to a convenience market located at 21530 Stevens
Creek Boulevard. The applicant, David Elliot, representing BSP Cupertino Union LLC, is
requesting the installation of a temporary trailer for the continued sale of gasoline during the
construction of project.
The following information applies to the temporary trailer operation:
• 'I'he trailer will be located in front of the existing service station and will not displace any
parking stalls nor obstruct drive aisles and fire access
• The trailer will only be used by employees and patrons for restroom needs
• The trailer will be ADA accessible
• The trailer is approximately 10' x 30' and 10' high
• The trailer is tentatively scheduled to operate for a period of 120 days.
• No food will be sold onsite during construction
The Director of Community Development approves the temporary use permit with the
following conditions of approval:

1. APPROVED EXHIBITS
This approval is based on the plan set received on March 17, 2014 entitled "Temporary
Office, 21530 Stevens Creek Blvd., Cupertino, CA 95014," prepared by David J. Elliot &
Associates, except as may be amended by the Conditions contained in tliis Resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building
permits for the trailer.
4. EXPIRATION DATE
This approval shall expire on Apri125, 2015. The applicant may apply for a Temporary Use
Permit before or at the expiration date for a time extension.
5. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
6. NOTICE OF FEES,DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This approval of the temporary use permit is effective Apri125, 2014. The fourteen calendar day
appeal period will expire on May 9, 2014.
