Wolfe Road, Tantau Avenue and I-280. Background The City Council approved a 3.4 million square foot office, research and development campus in October 2013 for Apple Inc. The project site is located in the area bound by Homestead Road on the north, N. Tantau Avenue on the east, I-280 to the south and N. Wolfe Road to the west. Since obtaining entitlements, Apple has been preparing plans to obtain building permits. Due to the size and complexity of the project, necessary minor refinements/changes have been made with DIR-2014-11 and DIR-2014-29. Discussion During subsequent review, it has been discovered that the plans submitted for review of application DIR-2014-11 mistakenly identified the number of parking spaces in the basement parking area of the Main Building as having increased. A total 2,385 parking spaces was approved for basement parking in the Main Building in October 2013. In April 2014, 2,342 parking spaces were proposed for the Main Building. Therefore, a decrease of 43 spaces was proposed and approved for the Main Building. Apple, however, remains committed to providing the total number of parking spaces approved for the project 10,980 of which 9,240 spaces are to be provided on the Phase 1 portion of the project and 1,740 spaces are to be provided on the Phase 2 portion of the project (see attached email from Peter Sokoloff dated 9/24/2014.) The original condition of approval requiring 10,980 parking spaces for the project remains unchanged and applicable to the project. In the event that Apple wishes to pursue a reduced parking requirement, additional CEQA review and City Council review would be necessary. . � � � � P�v� G �S�f� ��o� �r�N�i . Wolfe Road,Tantau Avenue and I-280. Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The decision is reported to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION Back�round The City Council approved a 3.4 million square foot office, research and development campus in October 2013 for Apple Inc. The project site is located in the area bound by Homestead Road on the north, N. Tantau Avenue on the east, I-280 to the south and N. Wolfe Road to the west. Since obtaining entitlements, Apple has been preparing plans to obtain building permits. Due to the size and complexity of the project, the following necessary minor refinements/changes are being proposed: Main Building, Valet Reception Center �Fitness Center: ■ Increase in basement parking count in Main Building to 2,342 spaces-increase of 42 spaces ■ Adjustments to the gross floor area of the Main Building,Valet Reception Center and Fitness Center. These adjustments will not increase the overall allocation for the Apple Campus 2 project. No changes to allocations for any of the other components of the project. � Other minor modifications around the Entrance portal and Transit Center including: - Landscaping and jogging path removed above entrance portal at Transit Center - Single staircase modified to double staircase - Open-air Transit Center as opposed to an enclosed one DIR-2014-11 Apple Campus 2 Apri18,2014 - Minor changes to bus pick up/drop off layout - Exterior security gate at Transit Center removed - Seating alcoves located at main retaining wall of Transit Center for employees - Exterior material changes Tunnel at Main Entrance: ■ Minor change in the location of the tunnel resulting in less grading; and ■ Cladding material changed from concrete to white tile. Parking Gar�e F� Central Plant: ■ Increase in parking count to 5,886 spaces-an increase of 16 spaces; ■ Moved 10 feet west and 8 feet north. This does not impact the setback requirements at the closest property line (with the Hampton Apartments); ■ Reduction in the overall size of the Parking Structure to 1,974,575 square feet -reduction of 25,425 square feet; ■ Adjustment in the width of the Parking Structure to 458 feet-increase of 3 feet 10 inches; ■ Minor changes to the profile of the photovoltaic panels; ■ The canopy formed by photovoltaic panels has been increased by 51 feet 6 inches and now overhangs the north and south parking structures; ■ Louvers have been added on the west elevation of the north parking structure to prevent light and glare into the Hamptons Apartments; ■ Relocation of the Energy Storage Yard out of the Parking Garage. This will be located in the outdoor equipment yard. The layout of the outdoor equipment yard has not been finalized yet and will be submitted later; ■ Addition of one accessible and four standard parking spaces on the south side of the Central Plant for service use; and ■ Minor storm water and landscaping refinements. Environmental Review The modifications discussed above have been evaluated by LSA Associates, Inc. in their memo dated Apri14, 2014 and the analysis indicates that the minor modifications that the applicant is seeking would not require major revisions to the Final EIR certified on October 15, 2013, due to new or substantially increased significant environmental effects. Furthermore, there have been no substantial changes with respect to the circumstances under which these minor modifications would be undertaken that would require major revisions of the Final EIR due to new or substantially increased significant environmental effects, and there has been no discovery of new information of substantial importance that would trigger or require major 2 DIR-2014-11 Apple Campus 2 Apri18,2014 revisions to the Final EIR due to new or substantially increased significant environmental effects. The certified Final EIR adequately identifies all environmental effects and adequate mitigation measures for the proposed modifications to the previously approved project. Therefore, no subsequent or supplemental EIR is required prior to approval of the minor modifications to the Apple Campus 2 Project described above. ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modifications minor and approves the modifications with the following conditions: 1. APPROVED EXHIBITS This approval is based on the plan set prepared by Foster + Partners, Watry Design Inc., consisting of thirty (30) sheets comprising four sheets with matrices labeled "Planning Directors Minor Modification Application - Apple Campus 2 Project - Main Building - Cupertino, CA," "Planning Directors Minor Modification Application-Tunnel," "Planning Directors Minor Modification Application - Central Plant," and "Planning Directors Minor Modification Application - Parking Structure," and twenty six (26) sheets labeled "Transit Center/SOC Floor Area Calculation," A-TC-1749, A-TC-1751, A-TC-1846, A-TC-1848, A-TC- 2000, Rendering labeled "Transit Center, Main Staircase/Entrance," A-1770, A-1771, P-11.10, Al.l, A1.1A, A1.2A, A1.3A, A3.1, A5.1, T0.5, A-CP-1751, A-CP-1864, A-CP-1865, A-CP-2051, A-CP-2101, A-CP-0001, A-1760, A-1761, Rendering labeled "Tunnel Lighting, Independent Light Fixtures," except as may be modified by the conditions enumerated below. 2. ANNOTATION OF THE CONDITIONS OF APPROVAL The conditions of approval set forth shall be incorporated into and annotated on the building plans in addition to all previous conditions of approval. 3. BUILDING PEftMIT RE(?UIRED This approval does not constitute building permit approval; a separate building permit is required. 4. ACCURACY OF THE PRO]ECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or construction records. Minor errors may be corrected if in compliance with the assumptions and supporting data for this approval, subject to the review and approval of the Director of Community Development. However, misrepresentation of property data that is considered major by the Director of Community Development may require additional review by the Planning 3 DIR-2014-11 Apple Campus 2 Apri18,2014 Commission and/or City Council. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 5. CONCURRENT APPROVAL CONDITIONS The conditions of approval contained in file nos. ASA-2011-14, DP-2011-04, TR-2011-39, TM-2011-03,U-2011-11 shall be applicable to this approval except as amended. 6. CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 9. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this Resolution or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. Applicant and City shall use best efforts to select mutually agreeable legal counsel to defend such action, and Applicant shall pay all compensation for such legal counsel, following Applicant's 4 DIR-2014-11 Apple Campus 2 Apri18,2014 receipt of invoices from City, together with reasonable supporting documentation. Such compensation shall include reasonable compensation paid to counsel not otherwise employed as City staff and shall include City Attorney time and overhead costs and other City staff overhead costs and any costs directly related to the litigation reasonably incurred by City. If Applicant and the City cannot in good faith agree on joint counsel, the City shall have the right to retain counsel of its own choosing, separate from Apple's litigation counsel. 10. NOTICE OF FEES DEDICATIONS,RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 'This approval is effective April 8, 2014. The fourteen calendar day appeal period will expire on April 22, 2014. Ellen Garber, Shute,Mihaly and Weinberger,LLP s�cr, Addendum to the Apple Campus 2 Project Final Environmental Impact Report(EIR), State Clearinghouse#2011082055 This memorandum,prepared pursuant to the California Environmental Quality Act(CEQA),is an Addendum to the certified Apple Campus 2 Project Final EIR.This Addendum evaluates proposed minor modifications to the Apple Campus 2 Project(project)that were included in a Planning Directors Minor Modification Application submitted to the City of Cupertino (City)by Apple Inc. (project sponsor) on March 21,2014.As discussed in this Addendum,the proposed minor modifications to the project would not result in significant environmental effects beyond those identified in the Final EIR. The Final EIR,' which was certified on October 15,2013,evaluates the environmental impacts of development of a new campus for Apple on a 176-acre site bordered generally by East Homestead Road on the north,North Tantau Avenue on the east,Interstate 280 (I-280)and The Hamptons apartments on the south,and North Wolfe Road on the west. The project would result in the demolition of all existing structures within the project site and the construction of 3,420,000 square feet of office,research,and development uses; 245,000 square feet of auditorium, fitness center,and valet parking reception uses; 92,000 square feet of utility plants; and parking and ancillary buildings. Significant environmental impacts would result in the following topical areas: Planning Policy; Land Use; Biological Resources; Cultural Resources; Geology, Soils,and Seismicity; Hydrology and Water Quality;Hazards and Hazardous Materials;Transportation and Circulation;Noise; Air Quality; and Public Services and Utilities. This Addendum is prepared pursuant to CEQA Guidelines Section 15164 which states: "The lead agency or a responsible agency shall prepare an addendum to a previously certified EIR if some changes or additions are necessary,but none of the conditions described in Section 15162 calling for preparation of a subsequent EIR have occurred." Section 15162 specifies that"no subsequent EIR shall be prepared for that project unless the lead agency determines . . . one or more of the following": 1. Substantial changes occur with respect to the circumstances under which the project is under- taken which will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; or 3. New information of substantial importance,which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete was adopted, shows any of the following: (A) The project will have one or more significant effects not discussed in the previous EIR; (B) Significant effects previously examined will be substantially more severe than shown in the previous EIR; (C) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or (D) Mitigation measures or alternatives which are considerably different from those ana- lyzed in the previous EIR would substantially reduce one or more significant effects on the environment,but the project proponents decline to adopt the mitigation measure or alternative. Pursuant to CEQA Guidelines Section 15164(e),the following discussion summarizes the minor modifications proposed as part of the Planning Directors Minor Modification Application submitted on March 21,2014,the less-than-significant iinpacts associated with these minor modifications,and the reasons for the City's conclusion that changes to the proposed project(and associated environ- mental effects) do not meet the conditions described in Section 15162 calling for preparation of a SubsequentEIR. MINOR MODIFICATIONS TO THE PROJECT The Planning Directors Minor Modification Application identifies changes to four of the structures that would be developed as part of the project: (1)the tunnel, extending from the main project driveway along North Wolfe Road to the below-grade parking garage under the Main Building; (2) the Main Parking Structure, located near the southern boundary of the project site; (3)the Central Plant,located adjacent to the Main Parking Structure; and(4) the Main Building,the ring-shaped office and research and development facility in the north-central portion of the site. The proposed minor modifications to each of the structures are summarized below, followed by a short discussion of associated less-than-significant environmental impacts. The plans and diagrams submitted by the project sponsor that illustrate these changes are attached to this Addendum. 1. Tunnel.The dimensions and geometry of the interior tunnel would be adjusted slightly,resulting in a reduction of 25,000 cubic yards of cut from the tunnel area. In addition,the interior of the tunnel would be covered with white tile instead of concrete.No changes would be made to the configuration or dimensions of the at-grade road entering the tunnel. These design modifications to the tunnel would not result in environmental impacts beyond those already identified in the Final EIR. The minor modifications to the tunnel interior would not affect 2 L9A ASSOCIATES. INC. traffic flows or queuing because they could not substantially change the vehicle capacity of the tunnel or the ease of access into the project parking facilities. The reduction in excavation would diminish previously-anticipated environmental impacts related to off-haul of soil,because fewer truck trips would be needed to transport soil off-site or to other portions of the site.Taking into account 3,000 cubic yards of additional excavation that would result from minor adjustments to the Transit Center adjacent to the Main Building, as described below,all of the currently-proposed changes to the project,combined,would reduce excavation by approximately 22,000 cubic yards compared to the excavation volumes assumed in the Final EIR.Thus the maximum amount of excavation/fill and soil import and export identified in the Final EIR would not be exceeded with the currently-proposed minor modifications to the project.Z Z. Main Parking Structure. Several minor modifications are proposed to the Main Parking Structure,most notably a reduction in the building's square footage of 25,425 square feet, from 2,000,000 square feet to 1,974,575 square feet. In addition,the location of the building would move approximately 8 feet to the north and 10 feet to the west(see Figure 1) and the dimensions of the building and specific building elements would change as follows: a)The height of the photovoltaic panels on the roof of the building would be increased by 9 inches(from 48 feet to 48 feet 9 inches); b) the width of the building would be increased by 3 feet 10 inches(from 454 feet 2 inches to 458 feet); c)the width of the photovoltaic panels on the roof would be increased by 51 feet 6 inches(from 152 feet to 203 feet 6 inches);and d)the elevator overrun on the top of the building would be reduced by 8 inches. In addition,louvers—or horizontal slats—would be added on the west elevation of the northernmost part of the Main Parking Structure to block glare generated by headlights on residents of The Hamptons. T'he total number of parking spaces accommodated in the Main Parking Structure would increase by 16 (from 5,870 to 5,886).Taking into account the changes in parking spaces associated with these minor modifications to the Main Parking Structure, and the Central Plant and Main Building(described below),the total number of parking spaces on the site would be reduced by 22 spaces,approximately 0.2 percent of the total number of parking spaces evaluated in the Final EIR.The total number of parking spaces on the site would be reduced from 10,980 spaces to 10,958 spaces. These proposed minor modifications to the Main Parking Structure would not result in environmental impacts beyond those already identified in the Final EIR. The shift in the location of the building would increase the setback of the structure from Calabazas Creek,which would result in marginal environmental benefits.Although the building would be approximately 10 feet closer to buildings housing sensitive receptors at The Hamptons(see Figure 1),noise levels would continue to be acceptable due to the provision of adequate separation distances between The Hamptons and Main Parking Structure, and incorporation into the design of noise-insulating design features,such as walls and louvers. The proposed louvers would also reduce glare spillover from the Main Parking Stntcture, which would improve environmental conditions at The Hamptons compared to the approved project. Central Plant.Minor modifications that would be made to the Central Plant include the relocation of the Energy Storage Yard from the second floor of the structure to the Central Plant Equipment Yard,located adjacent to the southern border of the project site,near Interstate I-280. In addition,four parking spaces would be added adjacent to the southern edge of the Central Plant,for use by persons servicing the facility. In addition, one van parking space would be added immediately west of the Central Plant Equipment Yard,along with a crosswalk extending across the fire/emergency access route to the Central Plant. Other changes would be primarily aesthetic/design-related and include: reduction in the coverage of the rooftop parapet structure such that it would be set back from the western edge of the upper level;minor modifications in the layout of the rooftop photovoltaic system; and minor modifications to and additions to the planters extending along the western side of the building. No new or substantially more severe significant environmental impacts,beyond those identified in the Final EIR,would result from these minor modifications.The Energy Storage Yard would be an addition to the already-planned Central Plant Equipment Yard, and thus would not introduce new construction activities or substantial areas of disturbance to the project site. In addition,this facility— along with the new parking spaces—would be located near I-280 in a part of the site that is already relatively noisy,and associated operations would not substantially contribute to the community noise environment,or otherwise adversely affect sensitive receptors at The Hamptons.Noise levels would also be reduced by a wall surrounding the Central Plant Equipment Yard.The minor modifications to the parapet,photovoltaic system,and planters would result in minor changes to the aesthetic appearance of the Central Plant,but would not compromise the visual character of the area. This portion of the site has limited visibility from public viewpoints and does not contain sensitive environmental resources. Therefore,impacts associated with changes in development would be minimized. 4. Main Building.The most substantial or the minor modifications to the Main Building would be the addition of a Security Operations Center adjacent to the Transit Center. The approved Transit Center would contain 5,000 square feet of gross floor area.As part of the proposed minor modifications to the project,the Transit Center would be reduced to 3,310 square feet of building space and the Security Operations Center would comprise 6,710 square feet,for a total of 10,020 square feet of building space. Thus this modification to the project would result in a net increase of 5,020 square feet of building space(some or all of which may be offset elsewhere on the site, including through adjustments to the square footage of the Corporate Fitness Center and/or the North Tantau Avenue Security Reception). The Security Operations Center would consist of transport operations,global security, development lab,briefing room,and ancillary facilities. Because the Security Operations Center would be primarily below-grade,excavation in this part of the site would increase by approximately 3,000 cubic yards,but as explained above under Section l. Tunnel,above, net project excavation volumes would be below those evaluated in the Final EIR due to reduced excavation volumes associated with minor modifications to the tunnel near North Wolfe Road. Other changes to the Main Building would include minor modifications to the design of the entrance portal and stairway to the Main Building;removal of the Transit Center Canopy;removal of bollards adjacent to the Transit Center and introduction of 6-inch curbs; reconfiguration of the bus drop- off/pick-up spaces and the introduction of bus waiting coves to better accommodate vehicles and passengers; removal of an exterior security gate; and the introduction of a different type of stone material for the retaining wall. In addition, compared to the amount of proposed parking spaces analyzed in the Final EIR,the number of parking spaces in the basement of the Main Building would be reduced by 43 spaces, from 2,385 to 2,342 spaces. As noted above, taking into account other 5 LSA AS30CSATES, INC. changes in parking proposed to the Main Parking Structure and Central Plant,the total number of parking spaces on the site would be reduced from 10,980 spaces to 10,958 spaces. The minor modifications described above to the Main Building would not result in environmental impacts beyond those already identified in the Final EIR. The primary changes to the project in this location would be a reduction in the floor area of the Transit Center and the introduction of a new Security Operations Center. The introduction of this new use could increase the energy used on the site(if not offset by reductions in interior building space elsewhere on the site),although total site employment and traffic volumes would not be expected to change.While project energy use could increase slightly,because energy on the site would be derived from on-site photovoltaics and fuel cells, in addition to renewable sources purchased from third party providers,these minor modifications to the project would not be expected to significantly increase the greenhouse gas emissions generated by the project. In addition,because the Security Operations Center would be primarily below-grade and would be partially shielded from North Tantau Avenue by a berm and wall,it would not adversely affect the visual character of the area. The other minor modifications that are proposed(including the removal of the bollards and security gate, and reconfiguration of the bus spaces)would not change the impact conclusions in the Draft EIR. Similarly,the reduction in parking spaces under the Main Building would not change traffic patterns such that project-related traffic would substantially increase beyond that identified in the Final EIR. The adopted Transportation Demand Management(TDM)Program would ensure a continued high level of transit and other alternative transportation usage. COMPARISON TO THE CONDITIONS LISTED IN CEQA GUIDELINES SECTION 15162 The following discussion summarizes the reasons that a Subsequent EIR,pursuant to CEQA Guide- lines Section 15162, is not required to evaluate the environmental effects of the currently-proposed proj ect. Substantial Changes to the Project. As discussed above,the proposed minor modifications to the project would not result in new significant environmental impacts beyond those identified in the Final EIR,would not substantially increase the severity of impacts already identified in the Final EIR,and thus would not require the implementation of new or significantly changed mitigation measures. Therefore,the proposed changes to the project are considered minor refinements,not substantial changes, and an Addendum is the appropriate document to prepare to evaluate these minor modifications rather than a Subsequent EIR or Supplemental EIR. Substantial Changes in Circumstances. Since certification of the Final EIR,construction of the project is underway. Environmental conditions in and around the project site have not changed such that implementation of the proposed minor modifications to the project would result in new significant environmental effects or a substantial increase in the severity of environmental effects already identified in the Final EIR.No substantial changes in visual resources,noise,land use patterns,or other conditions have occurred within and around the project site since certification of the Final EIR. Therefore,the physical conditions of the project site in the future are not expected to result in substantial adverse physical environmental impacts not addressed in the Final EIR. 6 L3A AS90CIATES, INC. New Information.No new information of substantial importance,which was not known and could not have been known when the Final EIR was certified,has been identified in regard to the currently- proposed project or the project site such that the proposed minor modifications to the project would be expected to result in: 1)new significant environmental effects not identified in the Final EIR or 2) substantially more severe environmental effects than shown in the Final EIR. Likewise,the proposed minor modifications to the project would not require new mitigation measures previously determined to be infeasible, or mitigation measures which are considerably different from those identified in the Final EIR. The proposed minor modifications to the project would require no new mitigation measures because no new impacts are expected beyond those identified in the Final EIR. Substantial new information would include new data on soil or groundwater contamination,traffic conditions,and local air quality such that the environmental impacts identified in the Final EIR would be made substantially more severe.No such new information has been identified since publication and certification of the Final EIR.As described previously,minor modifications to the proposed project would not result in new or substantially more severe significant environmental effects (including effects that would be substantially more severe than impacts identified in the Final EIR). Existing regulations (including City of Cupertino General Plan policies and Zoning Ordinance regulations)and mitigation measures included in the Final EIR,and adopted and made conditions of project approval,would continue to apply. CONCLUSION The proposed minor modifications to the Apple Campus 2 Project, described in this Addendum, would not require major revisions to the Final EIR due to new or substantially increased significant environmental effects. Furthermore,there have been no substantial changes with respect to the circumstances under which these minor modifications would be undertaken that would require major revisions of the Final EIR due to new or substantially increased significant environmental effects, and there has been no discovery of new information of substantial importance that would trigger or require major revisions to the Final EIR due to new or substantially increased significant environmental effects.
