Subject: Director's Minor Modification, DIR-2014-10, to allow minor changes to a previously
approved Two-Story Permit(R-2013-43) and Minor Residential Permit(ItM-2013-36)
to increase the second floor area from 955 square feet to 1,181 square feet for the
proposed single-family residential home located at 903 S. Stelling Road.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
BACKGROUND
The applicant, Li Wang, obtained approval for a 3,458 square foot two-story single-family
residence from the Planning Department on December 5, 2013. The applicant is proposing
minor building and site changes to the previously approved residential design. The proposed
revisions outlined below have an effect of increasing the second floor area by 226 square feet.
1) Second floor area increased from 955 sq ft to 1,181 sq ft
2) First floor area reduced from 2503 sq ft to 2281 sq ft
3) Two new second story windows on the north elevation
4) One new second story window on the east elevation
DISCUSSION
The proposed modifications are consistent with the City's Single Family Residential(R1) Zones
ordinance.Additionally, the applicant has obtained privacy protection waivers from the
neighbors affected by the additional second story windows and square footage. The proposed
revisions will result in a net increase of 4 square feet for a total building area of 3,463 square
feet. No other interior or exterior changes are proposed.
The site and elevation plans were circulated to the adjacent property owners for a two-
week review period. No comments were received from the public.

ACTION
The Director of Community Development deems the modification minor and approves the
project with the following conditions of approval:
1. APPROVED EXHIBITS
This approval is based on a plan set entitled, "Yu Residence, 903 S. Stelling Road, Cupertino,
CA. 95014" consisting of nine sheets labeled "A-0, A-0.1, A-0.2 and A-1 to A-6", dated
Received February 24, 2014, except as may be amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard
to the proposed project for additional conditions and requirements. Any misrepresentation
of any submitted data may invalidate an approval by the Community Development
Department.
3. BUILDING PERMITS
The applicant shall consult with the City Building Division to obtain the necessary building
permits for the installation of the aerials and associated equipment.
4. INDEMNIFICATION
To the extent permitted by law, the Applicant shall indexnnify and hold harmless the City,
its City Council, its officers, employees and agents (the "indemnified parties") from and
against any claim, action, or proceeding brought by a third party against the indemnified
parties and the applicant to attack, set aside, or void this ordinance or any permit or
approval authorized hereby for the project, including (without limitation) reimbursing the
City its actual attorneys' fees and costs incurred in defense of the litigation. The City may,
in its sole discretion, elect to defend any such action with attorneys of its choice.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90-day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
This Director's approval is effective Apri17, 2014. The fourteen calendar day appeal period will
expire on Apri121, 2014. Please be aware that if this permit is not used within two years, it shall
expire on Apri17, 2016.
