Subject: Director's Minor Modification (DIR-2014-06) to allow minor site changes for a bus shelter
improvement at an office center and a Tree Removal Permit (TR-2014-11) to allow the removal
and replacement of 11 trees due to declining health and poor structure, located at an existing
office center on Results Way.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen calendar
days.
DISCUSSION
Lisa Vogel, representing Apple, proposes a private bus shelter and the removal and replacement of
eleven(11) trees at an existing office complex.
Location
The project site is located on the south side of existing Apple office building at 16 Results Way, bounded
by Union Pacific Railroad tracks to the east, the Results Way to the south, and additional office buildings
to the north and west.
Site Improvements
The project includes the demolition and reconstruction of the existing bus stop unloading/loading area
(remove curb, sidewalk and asphalt), installation of a bus shelter, and relocation of a street light. The
improvements are interior to the office center and will not result in significant visual impacts to the
general public.
Landscaping
The plans call for the removal of eleven (11) trees that are decl_it�ing in health and/or poor in structure,
including one (1) Italian stone pine, one (1) purple plum, eight (8) raywood ash, and one (Nichol's
willow leafed peppermint) tree (ranging from 6" to 30" in diameter). Replacement planting includes a
total of eleven 36-inch box trees, consisting of two (2) oak trees, five (5) olive trees, and four (4) redwood
trees to infill gaps in the evergreen screen and to fit into the existing groves. The removal of trees #1 and
#2 (Exhibit 2) will mitigate overcrowding with adjacent trees to remain.

ACTION
In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development
deems the modification minor and approves the modification described in the plan set titled: "RESULTS
WAY BUS SHELTER IMPROVEMENTS" prepared by BKF architecture and Studio Five Design, and
consisting of twelve (12) sheets labeled C1.0 through C5.0, L0.1, L0.2, L1.0, L�.O, L5.OA, L5.1, and S1 last
revised 01/31/14 and stamped as received 1/31/2014, and Arborist Report and Replacement Planting Plan
prepared by Samuel Oakley (WE-9474A) dated December 2, 2013 except as may be modified by the
conditions enumerated below.
1) ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of
the building plans.
2) BUILDING PERMIT REQUIRED
This approval does not constitute building permit approval; a separate building permit is
required.
3) ACCURACY OF THE PROJECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but
not limited to property boundary locations, building setbacks, property size, building square
footage, any relevant easements and/or construction records. Any misrepresentation of any
property data may invalidate this approval and require additional review.
4) TREE RELACEMENTS
The applicant is required to plant eleven 36-inch box trees in accordance with approved tree
replacement plan. Modifications to the tree species and location may be made to the approved
replacement planting plan pending staff approval. The replacement trees shall be planted rior to
building final.
5) CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.
6) INDEMNIFICATION
To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its
City Council, its officers, employees and agents (the "indemnified parties") from and against any
claim, action, or proceeding brought by a third party against the indemnified parties and the
applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby
for the project, including (without limitation) reimbursing the City its actual attorneys' fees and
costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any
such action with attorneys of its choice.
7) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Govemment Code

Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of
Section 66020, you will be legally barred from later challenging such exactions.
This approval is effective March 25, 2014. The fourteen calendar day appeal period will expire on April
8, 2014. If no appeal is made within the appeal period, the tree(s) may be removed on Apri19, 2014.

TREE PROTECTION NOTES
1. DESIGNATED TREES ON SITE SHALL HAVE PROTECTIVE FENCING ERECTED AROUND THEM
TO AVOId SOIL COMPACT�ON OR CONTAMINATiON,MECHANICAL INJURY TO THE ROOTS.
TRUNKS.BRANCHING OR FOLIAGE,AND TO DELINEATE THE TREE PROTECTION ZONE.
2. FENCING SHALL BE ERECTED BEFORE DEMOLITION,GRADING OR CONSTRUCTION BEGINS
AND SHALL REMAIN IN PLACE FOR THE DURATION OF THE PROJECT. PROJECT ARBORIST
SHALL CERTIFY THE INSTALLATION OF THE TREE PRESERVATION MEASURES PRIOR TO ANY

4. DO NOT USE HEAVY EQUIPMENT NOR CONDUCT ANY ACTIVITIY THAT WILL CAUSE

5. PROVIDE PROTECTION FOR ROOTS CUT DURING CONSTRUCTION OPERATIONS.
TEMPORARILY COVER EXPOSED ROOTS WITH WET BURLAP TO PREVENT DRYING OUT.COVER
WITH EARTH AS SOON AS POSSIBLE. SIMILARIY PROTECT SHRUB AND GROUNDCOVER AREAS
TO REMAIN. ROOT REMOVAL WITHIN THE DRIPLINE OF TREES SHALL ONLY OCCUR UNDER THE
DIRECT SUPERVISION OF THE CITY ARBORIST.
6.THE MATURE TREES SHALL BE IRRIGATED WITH EXISTING TREE IRRIGATION SYSTEM ON SITE
THOROUGHLY ONE TIME EVERY 5-6 WEEKS ONCE THE WINTER RAINS STOP.THE TREE
TRUNKS SHALL STAY DRY.
7. PLANTS TO BE REMOVED OR RELOCATED SHALL BE TAGGED IN THE FIELD BY THE
LANDSCAPE ARCHITECT.
8. THE CANOPIES OF TREES ADJACENT TO DRIVEWAYS MAY NEED TO BE RAISED IN ORDER TO
PROTECT THEM FROM IMPACTS WITH DELIVERY TRUCKS.ANY TREES THAT MAY HAVE THEIR
TRUNKWOOD DAMAGED FROM OELIVERIES SHALL HAVE THEIR EXPOSED WOOD WRAPPED
WITH 2"X 4"'S 8 WIRE FENCING TO LESSEN THE DAMAGE THAT MAY BE CAUSED BY�MPACTS.
