Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant, Steve Benzing, representing Shin and Cyrus Liu, is requesting approval to add 193 square feet to the rear and 298 square feet to the second floor of their existing residence at 19387 Sakura Way, which is located in a Single-Family Residential Cluster R1C zoning district. In accordance with the R1C ordinance, any minor exterior changes must be approved with a Director's Minor Modification. The proposed addition substantially conforms to the R1C Ordinance. Additionally, the proposed addition is consistent with the design and materials of the existing residence. The applicant has also obtained homeowner's association approval for the proposed project. Staff supports the proposed modifications because the height of the residence will remain the same and the overall mass of the second floor addition will be consistent with other two story residences in the planned development. The site and elevation plans were circulated to the adjacent property owners for a two-week review period. The City received a comment from a neighbor with concerns regarding the second story addition and construction process. The applicant has agreed to lower the roofline by one foot and work with the concerned neighbor and HOA to ensure that construction of the addition will minimize impacts to the neighboring property owners. DIR-2014-04 19387 Sakura Way Page 2 ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1. APPROVED EXHIBITS Approval is based on exhibits titled: "Mr. & Mrs. C. Liu, 19387 Sakura Way, Cupertino, CA 95014," prepared by Steve Benzing Architect, received January 15, 2014, and consisting of eight sheets labeled A1, A2, A4, A5, A5.1, A6 and A7; except as may be amended by the conditions contained in this resolution. 2. BUILDING PERMITS The applicant shall consult with the City Building Division to obtain the necessary building permits for the installation of the aerials and associated equipment. 3. INDEMNIFICATION To the extent permitted by law, the Applicant shall indemnify and hold harmless the City, its City Council, its officers, employees and agents (the "indemnified parties") from and against any claim, action, or proceeding brought by a third party against the indemnified parties and the applicant to attack, set aside, or void this ordinance or any permit or approval authorized hereby for the project, including (without limitation) reimbursing the City its actual attorneys' fees and costs incurred in defense of the litigation. The City may, in its sole discretion, elect to defend any such action with attorneys of its choice. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
