CC Resolution No. 02-134RESOLUTION NO. 02-134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A JOINT USE AGREEMENT WITH THE SANTA CLARA VALLEY WATER DISTRICT FOR THE SAN TOMAS AQUINO-SARATOGA CREEK TRAIL (REACH 5) WHEREAS, the San Tomas Aquino-Saratoga Creek Trail Reach 5 Improvement Project master plan was adopted by the City Council on October 4, 1999; and WHEREAS, a Joint Use Agreement with the Santa Clara Valley Water District is necessary because the trail passes over land owned by the County; and WHEREAS, said Agreement will allow for the use of the land for construction and provide for use of the trail when the project is completed. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby authorizes the City Manager to negotiate and execute a Joint Use Agreement for construction and future use of Reach 5 of the San Tomas Aquino-Saratoga Creek Trail on behalf of the City of Cupertino.
