Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION Proposed Modifications The applicant, Rachel Fenton representing NSA Wireless/Verizon, proposes to add an in-building repeater system which will assist tenants (Apple) by mimicking outside coverage inside the building. Equipment for this system includes two diamond shaped panel antennas being placed on the roof the building, connected by a cable to a receiver in the building. Location The subject project site is located at 10431 N. De Anza Boulevard, bounded by N. De Anza Boulevard to the east, Bandley Drive to the east, and office uses to the north and south. Background During the application review period, the applicant placed the subject equipment on the roof (without the benefit of a permit) for staff review and approval. While the equipment remains on the roof, the applicant asserts that it has not been installed nor has been activated at this time. Visibility The proposed receiver is centrally located on the roof of an existing four story office building, behind a 3' tall parapet wall, outside of the rooftop mechanical equipment screen. Staff conducted a site visit to assess the visual impact of the equipment from multiple vantage points and determined the equipment was not visible from any public right-of- way. DIR-2013-08 10431 N De Anza Blvd 3 Equipment The proposed equipment is comprised of one 6' tall two panel antenna pole mounted on a non-penetrating rubber mat—weighted by CMU blocks. A length of conduit will run across the rooftop to the interior of the mechanical equipment screen, where it will penetrate the roof and connect to an interior wall mounted receiver. M2 q e'nora��wr. au ua+s� ser yaurr �°�� a+eueea�w►r ANTENNA ELEVATION 3 ACTION In accordance with Cupertino Municipal Code Section 19.164, the Director of Community Development deems the modification minor and approves the modification described in the plan set titled: "Apple De Anza" prepared by EN of Connell Design Group, LLC, and consisting of four (4) sheets labeled T-1, T-2, A-1 and A-2 last revised 01/13/13 and stamped as received 2/25/2013, except as may be modified by the conditions enumerated below. 1) BUILDING PERMIT REQUIRED This approval does not constitute building permit approval; a separate building permit is required. 2) ACCURACY OF THE PROTECT PLANS The applicant/property owner is responsible to verify all pertinent property data including but not limited to property boundary locations, building setbacks, property size, building square footage, any relevant easements and/or DIR-2013-08 10431 N De Anza Blvd 4 construction records. Any misrepresentation of any property data may invalidate this approval and require additional review. 3) CONSULTATION WITH OTHER DEPARTMENTS The applicant is responsible to consult with other departments and/or agencies with regard to the proposed project for additional conditions and requirements. Any misrepresentation of any submitted data may invalidate an approval by the Community Development Department. 4) NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 5) ABANDONMENT In the event the antennas, associated equipment, or any portion of the facility thereof, are left unused for a period of 18 months the property owner or applicant shall bear the entire cost to remove the subject equipment and to restore the site to its previous condition. This approval is effective November 25, 2013. The fourteen calendar day appeal period will expire on December 9, 2013.
